I was recently terminated by Read and Succeed, LLC, and Tutors With Computers, LLC, for bringing to their attention company operations that are in violation of the No Child Left Behind Act and SES Provider regulations. I have first-hand knowledge of the following violations, as well as some documentation to support my claims: 1. The company(ies) categorize(s) employee(s) as independent contractors; however, according to the US Department of Labor, said "independent contractor" status does not meet the requirements in that the employer has complete control over the "contractor" in regard to direction, control, etc. 2. The company(ies) do(es) not pay overtime wages to employees. 3. The company(ies) has(have) knowingly received federal funds in payment for services and supplies not delivered to the students in the program. 4. The company(ies) do(es) not provide progress reports for individual students. 5. The company(ies) award(s) prizes in violation of regulations. 6. The company(ies) do(es) not maintain adequate student records. 7. The company(ies) hire(s) people with criminal backgrounds. I told three (3) department heads and several others in management of the failures of our company to provide adequate services. Those people are Clifton Hargrove (Chief Administrative Officer), Tom Waggoner (Chief Financial Officer), David Callaway (Chief Compliance Officer), Greg Delgado (Regional Compliance Manager for N TX and W TX), and Martha Louis (North Texas Regional Manager). I filed a complaint to the USDOL in an attempt to get overtime wages that were due to me. I was terminated subsequent to bring these matters to their attention. In regard to the resolution/outcome I expect from your investigation is that these tutoring firms will be banned for life from practicing in the education industry and that the individual management team will also be flagged and unable to open operations in any other name in any other state. My personal opinoin is that this is a terroristic act upon the future of America being that the children who are supposed to be served by this program are the future of America.
