37.Allfeesreferredtoinsection3orchargeableunderthisActshall collectionoffees bystamps. becollectedbystamps. 38.ThestampsusedtodenoteanyfeescharegableunderthisAct Stampstobe shallbeimpressedoradhesiveorpartlyimpressedorpartlyadhesive,asthe impressedor adhesive. AllsuchrulesshallbepublishedintheOfficialGazette,andshall thereuponhavetheforceoflaw.

40.NodocumentwhichoughttobearastampunderthisActshallbeof anyvalidity,unlessanduntilitisproperlystamped. But,if any such document is through mistakeor inadvertence received, filed or used in any Court or office without being properly stamped,thepresidingJudgeortheheadoftheoffice,asthecasemaybe, or,inthecaseoftheHighCourt,anyJudgeofsuchCourt,may,ifhethinks fit,orderthatsuchdocumentbestampedashemaydirect;and,onsuch document being stamped accordingly, the same and every proceeding relativetheretoshallbeasvalidasifithadbeenproperlystampedinthefirst instance.

41.Whereanysuchdocumentisaamendedinordermerelytocorrecta mistakeandtomakeitconformtotheoriginalintentionoftheparties,it shallnotbenecessarytoimposefreshstamp. 42.NodocumentrequiringastampunderthisActshallbefiledoracted upon in any proceeding in any Court or office until the stamp has been canceled. SuchOfficerastheCourtortheheadofofficemayfromtimeto timeappointshall,onreceivinganysuchdocument,forthwitheffectsuch cancellation by punching out the figurehead so as to leave the amount designatedonthestampuntouched,andthepartremovedbypunchingshall beburntorotherwisedestroyed.
