CHAPTER 04: WACIC Gun File SECTION 01: Introduction Procedure #: 04.01.000 Special Order: Supersedes: WACIC Manual 2003 Edition Applies to: ACCESS Users I. DEFINITIONS A. Purpose of the Gun File 1. The Gun File assists in the recovery of stolen or missing guns and locating guns used in the commission of a felony. It also aids in the return of recovered or pawned guns to legal owners. Agencies may inquire to see if a department holds an active stolen or loss report. They may verify if an agency is seeking the weapon in connection with a felony, has recovered the weapon, or if it has been pawned. B. Definition of a Gun 1. To make an entry in the Gun File, any weapon, including a starter gun that will or is designed to or may be converted to expel a projectile by compressed air or gas or by the action of an explosiveis considered a gun. Included are antique guns, cannons, machine guns, pistols, rifles, shotguns, the frame or receiver of any such weapon, any firearm muffler or firearm silencer, destructive devices (such as grenades, mines, missiles, and rockets), and disguised guns (such as knife guns, pen guns, belt buckle guns, and cane guns). 2. BB guns are not considered weapons and should be entered in the Article File. Pellet guns are considered weapons and are entered in the Gun File. Effective Date: August 1, 2006 See Also: CALEA:

C. Criteria for Entry in the Gun File 1. Any stolen gun that has a unique serial number may be entered into WACIC/NCIC Gun Files when a valid report has been signed. WSP recommends the reporting party and the investigating officer sign the theft report. 2. A record may be entered for a weapon believed to have been used in the commission of a felony as long as this fact is documented in the case file and the location of the weapon is unknown. 3. A record for a lost or missing weapon may be entered into WACIC and NCIC if the entering agency has supporting documentation. 4. Recovered (abandoned, seized, and found) guns that have no stolen report on file may be entered into WACIC/NCIC as "Recovered Gun." A recovered gun entry must remain in the possession of the entering agency, or be readily available for examination, while the record is in WACIC/NCIC. When the entering agency loses custody of the recovered gun in any manner, the entry must be cleared from the computer system. 5. Pawned guns should be entered into WACIC. This will afford a record for follow-up if the gun is later reported stolen. All stolen, missing, felony and recovered gun entries will be entered into WACIC and NCIC. Pawned guns are only entered into WACIC. D. Retention Period for Guns 1. Stolen, Felony and Missing Guns a. Stolen, felony, and missing guns that have not been located remain on file until cleared or cancelled by the entering agency. b. Located gun records remain in WACIC until the first file realignment during the month following the month of locate. c. Located gun records remain in NCIC for ten days following the date of locate, then NCIC suppresses them and purges on the next file realignment. 2. Recovered Guns a. Guns entered as "recovered" will remain on file for the balance of the year entered plus two years, unless cleared or cancelled sooner by the entering agency, whichever is first.

3. Pawned Guns a. Pawned guns remain on file for 120 days from the date pawned. 4. Cleared Records b. Cleared records remain on file in the WACIC system for 14 days from the date of clear. Cleared records are removed entirely from NCIC upon receipt of the clear message. E. Validation 1. Stolen, felony, missing, and recovered gun records are validated monthly. Each record entered will be subject to validation three months after entry and annually thereafter.

1. Inquiries can contain these search elements: a. Serial number (SER), with or without gun make (MAK) and caliber (CAL) b. WACIC number (WAC) c. NCIC number (NIC) 2. Inquiries on SER with or without MAK and CAL can be either Message Field Code (MFC) driven or positional. If MFC's are used (SER/, MAK/, CAL/), those fields immediately follow the ORI in the inquiry. 3. If MFC's are not used, then the inquiry is "positional" and the fields must be in the order shown above with each field accounted for, even if not filled. Only SER is required, but including MAK and/or CAL will limit invalid hits returned.

4. If the serial number exceeds 20 characters, the rightmost 20 characters should be inquired upon first. If the response is negative, the leftmost characters should be queried. 5. Inquiries may contain a RSH field. If RSH is Y, secondary hit responses will be returned for all records with the same ORI/OCA as the primary hit response and all records linked by the LKI/LKA contained in the primary hit response. 6. If the hit response contains more than 20 hit responses (primary and/or secondary), the following will be included after the first 20 hit responses to indicate a file is being created with up to an additional 100 hit responses. ADDITIONAL HITS AVAILABLE, FILE NOTIFICATION TO FOLLOW A $.B. administrative message will be sent to the ORI to identify the file name to be requested to retrieve the hit responses. B. Guidelines for Inquiries 1. If no ORI is included in an inquiry, the ACCESS system inserts the default ORI assigned to the terminal submitting the inquiry. If an ORI is included, it must be an ORI which the terminal is authorized to use. C. NCIC Conversion of Alphabetic "O" to Zero 1. Refer to Chapter 1, Section 6 for explanation. D. An inquiry with SER, WACIC will search gun records on file for any record with a SER or owner-applied number (OAN) which matches the SER in the inquiry. If MAK and/or CAL are included in the inquiry, they will be used to exclude any records with a matching SER or OAN. b. An inquiry with WAC will be searched for an exact match only. c. An inquiry with RSH/Y will also return records with the same ORI and OCA or LKI and LKA as in the matched record(s). 2. NCIC Search Procedure a. NCIC searches gun inquiries: (1) An inquiry that contains a serial number only or serial number and caliber retrieves any record on file with a matching serial number.

(2) An inquiry that contains a make, serial number, and CAL/45 retrieves any record on file with a matching serial number, regardless of the MAK field code or CAL code. (3) An inquiry that contains a serial number, a make other than CLT, REM, SW, or WIN, with a caliber other than 45 or without caliber, retrieves any record on file with a make other than CLT, REM, SW, or WIN, and a matching serial number. (4) Any inquiry that contains a serial number, with a caliber other than 45 or without caliber, and MAK/CLT, REM, SW, or WIN, retrieves any record on file with a matching serial number and the same make (CLT, REM, SW, or WIN), or MAK/US or USA. (5) Alphabetic characters appearing between numeric characters (embedded alphabetic characters) in a serial number are not considered by NCIC for matching purposes. 1. MKE (Message Key) a. The MKE field must be a valid message key. 2. ORI (Originating Agency Identifier) a. The ORI field must be a valid NCIC assigned ORI. The first two characters must be alphabetic. b. The ORI field of any gun record must contain the valid NCIC ORI of the agency holding the theft or recovery report, or the valid NCIC ORI of an agency authorized to act as holder of the record for such entry. 3. SER (Serial Number) a. The SER field contains a maximum of 20 alpha-numeric characters. A single zero, run of zeros, single alphabetic, or run of alphabetics indicating the serial number is not known cannot be used. Serial number and owner-applied number cannot be identical. A serial number must be entered omitting spaces, hyphens, and symbols. Alphabetic characters, which are part of the serial number, should be included. b. If the serial number exceeds 20 alpha-numerics, place the last 20 characters in the SER field and enter the entire SER in the MIS field. c. The true (manufacturer's) serial number of the gun MUST BE ENTERED. If the number applied by the manufacturer of the gun is determined not to be a unique serial number, but rather a match number, model or stock control number, etc., THE GUN SHOULD NOT BE ENTERED. If it is already in the file, the record should be cancelled.

major criminal investigation, in which case the point of identification or the connection to the major criminal investigation must be fully described in the MIS Field. e. In the event more than one number appears on the firearm, the frame or receiver number should be entered in the SER field and the other number(s) should be entered in the MIS field. The frame number is the number stamped into the permanent frame of the gun rather than a removable part, such as the barrel, cylinder, bolt, etc. f. Each separate wartime manufacturer of Luger pistols used their own system of serializing the weapons, thus generating duplication of numbers. Therefore, the make, serial number, type, and caliber do not sufficiently describe a Luger for entry in WACIC/NCIC. Accordingly, it is essential to include: (1) Any letter prefix or suffix which appears with the serial number (without the letter, if present, the serial number is incomplete). (2) The year of manufacture engraved over the chamber. (3) Identifying trademark of the manufacturer. With reference to the trademark, you should place in the MIS field the manufacturer's initials or name found on the center toggle link on top of the gun. For example, "byf" appears on Lugers manufactured by Mauser (see BYF in MAK codes of the NCIC Code Manual). 4. MAK (Make Code) a. Valid MAK Field codes are listed in Gun Data Codes, NCIC 2000 Code Manual. For NCIC 2000, the make of the firearm should be taken from the frame or receiver only, except for U.S. military-issue weapons. This field has been expanded to 23 characters in NCIC 2000 transaction formats. This allows for the entry of free text in positions 4 through 23 of the MAK Field. 5. MAK Code When Gun Make Not Listed a. If the make code is not listed in the NCIC 2000 Code Manual, the code ZZZ should be placed in the MAK Field, and the make of the firearm should be entered in positions 4 through 23.

b. If the MAK code is ZZZ and positions 4 through 23 are blank, the MAK field will be translated by NCIC as MAK/UNKNOWN in the message response. If there is any data in positions 4 through 23, they will be included in the response as entered. 6. MAK Code When Gun Make Unknown but Country Where Manufactured Is Known a. If the make of a firearm is unknown but the country of manufacture is known, the appropriate code for that country should be entered in the MAK Field and positions 4 through 7 should contain UNKN. Country codes are listed in the NCIC 2000 Code Manual, State and Country Codes. b. The code US should be entered in the MAK Field when all of the following conditions exist: 1) The make of the firearm is not known. 2) The country of manufacture is the United States. 3) The firearm is not a U.S. militaryissue weapon as described in this chapter. 7. MAK Code If Neither Make Nor Country Where Manufactured Is Known a. If a firearm has a distinct point(s) of identification or is connected with a major criminal investigation, and neither the make of the gun nor the country where it was manufactured is known, a gun record can be entered in WACIC and NCIC 2000 provided the gun has a serial number. Otherwise, a record for the firearm should not be entered. b. The code ZZZ should be entered in the MAK Field with positions 4 through 23 left blank. The distinct point(s) of identification or connection to major criminal investigation should be noted in the MIS FIELD. 8. MAK Codes for U.S. Military-issue Weapons a. Firearms (including surplus weapons) that are U.S. military-issue weapons use the MAK Field code USA. MAK Codes for Nonmilitary U.S. Government Weapons a. The manufacturer MAK Field code should be used for a nonmilitary weapon bearing a U.S. Government property inscription and the manufacturer's name on the frame or receiver; for example, Smith and Wesson or Colt revolvers bearing the inscription U.S. Border Patrol, Naval Investigative Service, U.S. Air Force, Treasury Department, etc., should be entered with the MAK codes SW or CLT, respectively. 10. MAK Codes for Foreign Military Weapons a. Foreign military firearms should be coded according to the make on the firearm. If the make is undeterminable, the firearm should be coded according to the country where it was manufactured. If neither the make nor the country of manufacture is known, instructions set forth in this section should be followed. 11. MOD (Model) a. The MOD field contains a maximum of eleven alphanumeric characters. The model number or a recognizable abbreviation of the model name should be entered. For example, Smith and Wesson Chiefs Special Model revolver should be entered in the model field as CHIEF SPEC; Remington Model 870 pump action shotgun should be entered as 870. 12. CAL (Caliber) a. The CAL must be one to four numeric characters. Use a valid code as shown in the NCIC Code Manual.

b. American and British calibers are expressed in decimals of an inch. Metric calibers are expressed in millimeters (mm). Frequently the caliber description for a specific firearm contains not only the caliber, but also a partial or complete description of the appropriate cartridge for its chamber. Caliber descriptions are commonly compounded to show: (1) Standard weights of smokeless powder first used in loading the cartridge. For example, .30-30 (.30 is the caliber and 30 is the weight of the powder). (2) Year of adoption. For example, .30-06 (.30 is the caliber and 06 is the year of adoption). (3) Relative case length where more than one case length exists in a specific chamber. For example, 8x57mm (8mm is the caliber and 57mm is the case length). (4) Originating firm, country of issue, designer, etc. For example, .375 Holland and Holland Magnum (.375 is the caliber and Holland and Holland is the originating firm); .41 Swiss (.41 is the caliber and Swiss indicates the country of issue); .257 Roberts (.257 is the caliber and Roberts is the designer). c. Since periods are not permitted in any field, do not use decimal points when entering the appropriate caliber. Do not convert American to British, American to Metric, British to American, etc. d. When entering the caliber for a combination rifle-shotgun, the rifle caliber should be entered in the CAL field and the shotgun gauge entered in the MIS field. 13. TYP (Type Code) a. The TYP must be one or two alphabetic characters. It must use a valid code found in the NCIC Code Manual. The first alpha character cannot be L, N, T, U, W, X, or Y. The second character cannot be M, Q, Y, or Z. If the first position contains the letter S, P, or R, the second position must be filled. If the first position contains the letter P, the second position cannot be an A.

b. This field is coded exactly the same as the Vehicle Color (VCO) field in a Vehicle File record. If filled, must be either three alphabetic characters or seven characters consisting of a three-character color code, a slash (/), and a second three-character color code. c. Only valid color codes listed in the Vehicle Data Codes, of the NCIC Code Manual are allowed. This field is valid in WACIC only; it is not forwarded to NCIC. 15. OAN (Owner-Applied Number) a. Maximum of 20 numeric or alpha-numeric characters. Single zero, run of zeros, single alphabetic, or run of alphabetics cannot be used. Serial number and owner-applied number cannot be identical. (1) An owner-applied number which has been assigned in connection with a theft prevention program such as "Operation Identification" or "Stop Thief" may be entered in the OAN field. (2) An owner-applied number must be entered omitting spaces, hyphens, and symbols. (3) Alphabetic characters that are part of the owner-applied number should be included in the number. 16. DOT (Date of Theft) a. The DOT must have eight numeric characters representing year, month, and day in that order. The numbers in the month positions cannot exceed 12. The numbers in the day positions cannot exceed the number of days in the month indicated. The month and date cannot exceed the date entered. The date entered cannot be ----0229 when the year is not a leap year. 17. VAL (Value) a. The VAL code must have a maximum of six numeric characters to indicate the value, in dollars, of the gun. This field is valid in WACIC only; it is not forwarded to NCIC.

18. OCA (Originating Agency Case Number)

a. The OCA has a maximum of twenty alphabetic and/or numeric characters. It must not contain a single zero, a run of zeros, the first seven characters of the ORI field, or the word NONE. A hyphen is permitted as part of the twenty characters. b. With the addition of the Pawnbroker Name (PBN) field for pawned article records, it is no longer necessary to enter the locally assigned pawn shop number in the OCA field. Nonetheless, the OCA is still required in all entries, including pawned articles. If your agency does not assign a case number to pawned articles and you do not use a generic OCA for pawned article entries, you may wish to use the former pawn shop number in the OCA field. Pawn shop numbers should be the same as the ORI's third through sixth digit, with additional sequential numbers of four digits making a total of eight digits. The first character is always P. P27030001 could be used for ABC Pawn Shop, Tacoma, Washington. 19. LKI (Linkage Agency Identifier) a. The LKI field has nine alphanumeric characters. It must be a valid NCIC 2000 assigned ORI. The LKI and LKA cannot be identical to the ORI and OCA. LKI and LKA are entered as a set. 20. LKA (Linkage Case Number) a. The LKA field has a maximum of 20 alphanumeric characters. It must not contain a single zero only, a run of zeros only, a single alphabetic only or the word NONE. The first seven characters of the LKA cannot equal the first seven characters of the LKI. The only valid special character is the hyphen. The LKA must be valid for the LKI. (There must be an ORI and matching OCA in the System).

b. The Linkage ORI and OCA Fields are provided as separate fields to associate incidents that are handled by multiple departments. An agency entering a record which shares the same incident of a record entered by a different ORI and/or OCA can link the records by entering the associated ORI and OCA in the linkage fields (LKI and LKA). The record will be rejected if the LKI/LKA Fields are the same as the ORI/OCA Fields, or if the first seven characters of the LKA are the same as the first seven characters of the LKI. 21. MIS (Miscellaneous) a. This field allows a maximum of 200 free text characters. (1) If the serial number exceeds 20 characters, the last 20 characters should be entered in the SER field and the complete serial number must be listed in the MIS field. 22. BBL (Barrel Length) a. If available, the barrel length should be entered and expressed in inches and/or fractions of an inch. b. Use a slash to separate a numerator and denominator of fractions. For example, a 2-inch barrel would be entered as BBL21/2. c. The chamber (that part of the inside of the barrel of the gun at the breech formed to accept the cartridge) is included when measuring the length of a pistol (non-revolver), rifle, or shotgun barrel since the barrel and chamber are usually one piece. The chamber is not included when entering the barrel length of a revolver, since the chamber is part of the cylinder. 23. Color and Finish Data a. Use codes found in the NCIC Code Manual. 24. Cartridge Capacity a. Cartridge capacity should be expressed as maximum capacity. Those firearms fed from a clip, magazine, or a tubular magazine should be indicated as CLIP or TUBL, rather than by cartridge capacity. For example: 6SHOT, CLIP, or TUBL MAG.

25. INSC (Inscription Data) a. When describing a gun with an inscription, name, monogram, date, etc., first list the code INSC followed by a dash and the exact or abbreviated inscription. For example: INSC-MDM (MDM represents a person's initials); INSC-US PROP; INSC-TOM 071184 (name and date represented). 26. SSL (Silencer Length) a. If the silencer length is available, it should be entered and expressed in inches and/or fractions of an inch. Silencer length may be in exact or closely approximated dimensions, depending on available data. A slash (/) should separate numerator and denominator of fractions of an inch. For example, 2-inch silencer would be expressed as SSL21/4 and a 2-inch silencer as SSL2. 27. NOA (Notify Originating Agency) a. If an entering agency believes notification each time its record is hit will provide investigative leads, regardless of whether the location of the property is known, enter Y in the NOA field. If this field is left blank it defaults to N for no. 28. PBN (Pawn Broker Name) a. Pawned gun (MKE EGP) records remain in WACIC. This field contains a maximum of 30 alphabetic characters. The PBN field is required if the entry MKE is EGP. It is used to indicate the name of the pawn shop. 28. NAM (Name of Pawner) a. The NAM field must have a minimum of five and maximum of 30 characters, including alphabetics, one comma, hyphen(s), and spaces; comma must follow last name; no more than one space after comma. Refer to the Personal Descriptors section of the NCIC Code Manual for coding instructions.

29. DOB (Date of Birth of Pawner) a. The DOB field must have eight numeric characters representing year, month, and day in that order. The numbers in the month positions cannot exceed 12. The numbers in the day positions cannot exceed the number of days in the month indicated. The month and date cannot exceed the date entered. The date entered cannot be --0229 when the year is not a leap year. If the name of pawner is entered (NAM), this field is required. 30. SEX (Sex of Pawner) a. The SEX field must contain one alphabetic character: M for male or F for female. This field is required if name of pawner (NAM) field is filled. 31. RAC (Race of Pawner) a. The RAC field contains one alphabetic character. If filled, it must be a valid race code as listed in the Personal Descriptors section of the NCIC Code Manual. 32. WAC (WACIC Number) a. I. DEFINITIONS
A. Clear Transaction 1. When a clear message is sent, the first character of the message key is changed to C and the record is retained in the WACIC system for 14 days from the date of clear. If the record must be re-entered before the end of this 14-day period, it must first be cancelled before it can be re-entered or the entry will be rejected as a duplicate record on file. Cleared records are removed entirely from the NCIC system upon receipt of the clear message. B. When to Use a Clear Transaction 1. The clear transaction indicates the recovery of a stolen or missing gun or the release of a recovered or pawned gun, and to remove the record from the file. Clearance of a record is restricted to the agency that entered the record. 2. An agency clears a recovered gun when a stolen report is received or is otherwise disposed of by the recovering agency. If the recovering agency originates the stolen report or disposes of the weapon, only the date of disposition is required after the two record identifiers. If an agency other than the recovery agency takes a theft report on the recovered gun, the ORI of the reporting agency and their case number should be included in the clear transaction. 3. A pawned gun is cleared only when the gun is found to be stolen after being entered as pawned. The clear transaction must include the date the item was reported stolen, the agency identifier of the agency taking the stolen report, and the reporting agencys case number.
