Re:

State of Texas vs. Eddie Ray Routh Cause No. CR14024, in the 266th Judicial District Court, Erath County, Texas The Grand Jury convened for service to the 266th Judicial District issued a True Bill of

Indictment formally charging Eddie Ray Routh with Capital Murder in the deaths of Chad Littlefield and Chris Kyle on February 2, 2013.

A copy of the Indictment is provided as a courtesy with this Release of Information and is also available as public record with the Clerk of the Court.

Also included with this Release is a copy of the Order Regarding Pre-Trial Publicity entered by the District Court on July 24, 2013.

Additional infonnation concerning this case will be available exclusively through public filings and public proceedings in the District Court.

IN THE NAME AND BY AUTHORITY OF THE STATE OF TEXAS:
The GRAND JURY, for the County of Erath, State of Texas. duly selected, empanelled. sworn, charged, and organized as such at the July Term, AD., 2013, of the 2661h Judicial District Court for said County, upon their oaths present in and to said Court at said term that EDDIE RAY ROUTH, hereinafter styled Defendant, on or about the 2 nd day of February, AD., 2013, and before the presentment of this indictment, in the County and State aforesaid, did then and there intentionally or knowingly cause the death of an individual, Christopher Scott Kyle, namely, by shooting him with a firearm, and did then and there intentionally or knowingly cause the death of another individual, namely, Chad Hudson Littlefield. by shooting him with a firearm, and both murders were committed during the same criminal episode.

RESTRICTIVE AND PROTECTIVE ORDER


On the 24t11 day of July, 2013, the Court, on its own Motion, enters the following Order restricting comments by: the 266t11 District Attorney and office staff; the Erath County Attorney and office staff; the Erath County Justice Courts and staff; the defendant and all family members of the defendant; the defense team and their staff; the Stephenville Police Department; the Erath County Sheriff's Office; the Texas Rangers and the Texas Department of Public Safety personnel; and all other law enforcement personnel involved in this case; the Bailiffs of the Court; the Erath County District Clerk and deputies; and all court personnel as set out below (hereinafter "the participants"), The Court takes judicial notice of: 1) the unusually emotional nature ofthe issues involved in this case; 2) the extensive local and national media coverage this case has already generated; 3) the various and numerous public events, including the memorial of Chris Kyle held in Cowboys Stadium, that have been published and broadcast by local and national media; and, 4} the unique nature ofsecurity issues presented by this case. The Court FINDS that the participants' willingness to give interviews to the media would only serve to increase the volume of pre-trial pUblicity.

The Court FINDS that if the participants grant interviews to the media, the pre-trial pUblicity will interfere with the defendant's right to a fair trial by an impartial jury. The Court FURTHER FINDS that no less restrictive means exists to treat the specific threat to the judicial process generated by this pre-trial pUblicity. The Court FURTHER FINDS that an order restricting extra-judicial commentary by the participants is necessary to preserve all venue options and a delay in proceedings would not lessen the publicity generated by this case.

In order to ensure against the substantial likelihood of extrajudicial statements being


made which would prejudice this criminal proceeding pending the final disposition of this case, and to provide for a fair trial for all concerned, IT IS ORDERED that all persons referenced above are prohibited from releasing any information in any form concerning the above referenced case except as herein provided: 1) The general nature of the charges or defense; 2) Information contained in a public record; 3) The scheduling or result of any step in the trial; 4) The identity of the accused; 5) The fact, time and place of arrest; and/or 6) The identity of investigating and arresting officers or their agencies. Nothing herein prohibits attorneys, investigators, or law enforcement persotmel from discussing the case with witnesses or prospective witnesses, nor prohibits witnesses from discussing the case with attorneys, investigators, and law enforcement personnel in the course of investigating this matter or preparing for trial.

The Clerk of this Court is. directed to forward a copy of this Order as soon as possible to the Erath County District Attorney, Erath County Attorney, the Erath County Justice Courts, the defense attorney, the Erath County Sheriff's office, the Stephenville Police Department, the Texas Department of Public Safety - Erath County' office and the Texas Rangers. Each of those individuals or entities shall be responsible for making their staff aware of this Order. In the case of the defendant and his family, the defendant's attorney shall be responsible for delivering a copy of this Order to the defendant and members of his immediate family.
