For the Old Saybrook Board of Education
On January 3, 1995, the Connecticut Independent Labor Union (Petitioner) filed a petition
with the Connecticut State Board of Labor Relations (the Labor Board) seeking designation as the
exclusive bargaining representative of “all clerical employees employed by the Old Saybrook Board
of Education excluding the Executive Secretary to the Superintendent of Schools and Supervisors
employed by the Old Saybrook Board of Education and the position of Board Secretary”. The
petitioner also sought to decertify the current bargaining representative, Local 1303-152, Council 4,
AFSCME, AFL-CIO (Local 1303-224).
After preliminary administrative steps, the Agent of the Board ordered an election to be held
on March 31, 1995.
On March 20, 1995, Local 1303-224 filed an objection to the election. Pursuant to Conn.
Gen. Stat. 6 7-471(l) an election was conducted on March 3 1, 1995. A total of fourteen ballots
were cast, thirteen voted in favor of representation by Connecticut Independent Labor Union and
one voted in favor of representation by Local 1303-224.
Local 1303-224’s sole objection to the Agent’s direction of election is that the Petitioner is
not a labor organization within the meaning of Conn. Gen. Stat. $ 7-467a because it was originally
started by a law firm to represent workers.
This is an argument that has recently been raised and answered. In New Fairfield Board of
Education, Decision No. 3 175 (1994), we found that CILUKIPU was an employee organization
established for the primary purpose of improving wages, hours and working conditions of employees
and met the requirements of !j 7-467(6) and 0 7-467a of the Act. We reaffirm that holding in the
present case. Accordingly, we dismiss Local 1303-224’s objections and issue the following
Decision and Certification of Representation.
By virtue of and pursuant to the power vested in the Connecticut State Board of Labor
Relations by the Municipal Employee Relations Act, it is hereby
CERTIFIED, that Connecticut Independent Labor Union (CILU) has been designated as the
representative for purposes of collective bargaining by a majority of all clerical employees
employed by the Old Saybrook Board of Education excluding the executive secretary to the
superintendent of schools and supervisors employed by the Old Saybrook Board of Education
and the position of board secretary and that said CILU is the exclusive representative of all
such employees for the purpose of collective bargaining with respect to wages, hours, and
conditions of employment.
