Annual General Meeting Dispute of election of Officers and Board Of Directors

To Whom It May Concern: We the undersigned members of the Brockville Dog Park Association (BDPA,) as defined in Article 2 Section 1 of the BDPA Constitution, do hereby officially dispute the results of elections held at the Annual General Meeting on August 14, 2013. As a result of the integrity of the election process being compromised, we the undersigned members of the BDPA, exercise our right to call a special meeting to hold the elections for the Officers and Board Members of the BDPA. This dispute is based on the following actions: 1. Proxy ballots accepted then rescinded - On Wednesday, August 14, 2013 at the Annual General Meeting, the Secretary of the BDPA brought forward a motion to use proxy votes for the election of BDPA Chair. The topic was discussed and the Secretary was issued two ballots for the election of BDPA Chair. The Secretary was advised that the current BDPA Chair and BDPA Treasurer reserved the right to see confirmation that the absent members did indeed issue the proxy. The election was held with the understanding that the two proxy votes would be counted in the vote. The ballots were counted with Mac MacLean being voted in as Chair 11 votes to 10. After the proxy votes were allowed and the election results were announced the proxy votes were disputed and it was decided that the vote would be re-counted with the proxy votes being removed. The re-vote provided the results of Wayne Mielke being voted in as Chair 10 votes to 9. We the undersigned members of the BDPA dispute the results of the election due to the grievous lack of integrity surrounding the proxy vote process. 2. Ballots marked during a secret ballot vote On Wednesday, August 14, 2013 at the Annual General Meeting, the Secretary of the BDPA brought forward a motion to use proxy votes during a secret ballot election. The Secretary was advised to mark the proxy ballots with a P, thereby removing the anonymity of the ballot. We the undersigned members of the BDPA state that the marking of a secret ballot calls the integrity of the election process into question. According to Article 2 Meetings Section 3 Special Meetings of the BDPA Constitution, The secretary shall call special meetings at the request of the members. A notice stating the time, place, and proposed agenda shall be posted at the BDP at least one (1) week in advance. If a vote is noted on the agenda, members may submit absentee ballots to an officer prior to the meeting. In the absence of a Secretary, this notice of dispute and call for special meeting is being posted at the Brockville Off Leash Dog Park, emailed to those members who have given previous consent to be contacted, as well as posted for members to respond via Social Media on Terrys Brockville Off Leash Dog Park Facebook page. We call for the meeting to be held Wednesday, September 4, 2013 at 6:00pm at the Brockville Off Leash Dog Park. With the intention of receiving nominations for Officers from the floor, absentee ballots will be accepted in the form of a proxy. I hereby give my proxy to__________________ and authorize him/her to vote on my behalf on any item or issue arising at any BDPA meeting of members. Proxy votes will be submitted to an officer of the BDPA prior to the meeting start time of 6:00pm on Wednesday, September 4, 2013. If there is no officer present prior to the meeting start time of 6:00pm, members will be given the opportunity to present proxy votes in exchange for ballots before the nomination/election process begins.

We the undersigned hereby declare that we agree with the disputes listed above and would like to call a special meeting to elect the Officers and Board Members of the BDPA on Wednesday, September 4, 2013 at 6:00pm at the Brockville Off Leash Dog Park located on Broadway Avenue, Brockville.
