TACLOBAN CITY ousands of faithful coming from all walks of life are to commemorate today the horrifying earthquake that struck across the region one year ago.
e 7.6 magnitude tremor that was felt in the region, particularly in Leyte and Eastern Samar provinces, on August 31, 2012 was considered the strongest to hit the region in 20 years. And despite of its high magnitude, the region was spared with destruction, enough for us to be grateful to the Lord, says Francesca Babes Custodio, station manager of DyVL and one of the convenors of the ATOM (August irty One Miracle) Magnitude 7.6. Groups probe alleged human rights abuse by mining operators in Homonhon Island
TACLOBAN CITY-Several anti-mining groups to include Alyansa Tigil Mina (ATM) have urged the government to investigate the alleged human rights abuses perpetrated by mining operators of Mt. Sinai Exploration and Development Corporation (MSEDC) in Homonhon Island, in Guiuan, Eastern Samar. On August 5, 2013, residents of the island were allegedly assaulted by the mining operators when four of its protesters, including oneyear old baby and a mother, were scooped up by a pay loader machine in an attempt to break their barricade, ATM statement reads. ...Human rights groups, particularly Task Force Detainees-Philippines (TFDP) are still completing their fact- nding report, Jaybee Garganera, ATM national coordinator, told Leyte Samar Daily Express in an interview online. Garganera, whose group is currently pushing for moratorium on mining in the country, added they have not yet raised this issue to the DENR central o ce, as the community and the local non-government organizations in the area are still waiting for legal advise from our lawyer-friends, and trying to engage the regional environment and natural resources o ce located in Tacloban. Updates of the fact- nding reports will be issued next week, Garganera said. According to ATM, the residents had their barricade starting August 1 following the expiration of a temporary restraining order to MSEDC. e group, however, demanded action from the Commission on Human Rights.

Tacloban vendors apprehended for selling cigars along campus areas


TACLOBAN CIT Y Owners of 15 stores were apprehended by a composite team created by the city government of Tacloban for selling cigarettes near school campuses. e campaign of the city government is in relation to the implementation of a national law that prohibits selling of cigarettes near school campuses and public areas. e team is headed by Dr. Gloria Fabregas, Mayor Alfred Romualdez consultant for special health project, and composed with personnel from the City Treasurers Office, City Health Office, Tra c Operation Management Enforcement and Control O ce and Tacloban City Philippine National Police. About 132 packs of cigarettes were con scated from the 15 stores and nine were issued with citation tickets worth P1,000 during the operation on Wednesday. ose that were issued tickets were given three days to pay. e composite team conducted their operations at Holy Infant College, Leyte National High School, Eastern Visayas State University, Leyte Normal University and Asian Development Foundation College. Prohibiting the selling of cigarettes along campuses would not only result from students to take the vice but ensure that they would not acquire ailments attributed to smoking, Fabregas said. Continuing as scholars include 13 students namely Ronald Ivan Laurio; Jo-an Ducducan; Harly James Manibong; Leahlyn Odal; Lezil Pacalan; Sherie Ann Llenado; Rea Beth Caboboy; Dina Jadlong; Leo Nito Caliba; Rosenie Malibago; Realyn Ciata and Joyce Digos. All are currently enrolled in various colleges in cities of Catbalogan and Tacloban. Each scholar receives P4, 000 as a nancial assistance, Colandog said. Meanwhile, Mayor Igmedio Ponferrada said he is grateful to the support of his constituents in helping out-ofschool youths continue their studies. Starting at 4 a.m., a fun run will be held with a projected 500 marathoners coming from di erent starting points, namely, San Jose rotunda, Diit police substation, DyVL station and Palo cathedral, to participate. Church hails absence of peryahan for the Borongan esta celebration


BORONGAN CITY- e Cathedral Parish ofthe Nativity of Our Lady commended one unusual decision made by Mayor Ma. Fe Abunda relative to the forthcoming city esta on September 8, which also is the feast of the whole Borongan diocese. In an open letter sent through the Facebook, Reverend Father Leroy Geli, head, Team Ministry of the Diocese, expressed their appreciation to the city government for the absence of peryahan (carnival fair) this year which had been a traditional part of esta celebration in the past. According to Fr. Geli, such initiative of Mayor Abunda is a positive step for the community of Borongan, saying that the peryahan causes great distractions from the more important spiritual activities, especially to our young who are tempted to vices like gambling, absenteeism from school, frat violence, etc. His letter added that as spiritual leaders, it had always been their constant concern that estas be celebrated with proper accord, significance and focus that they ought to have. We thereby encourage, support, and commend you for not allowing the operation of peryahan establishments this year, and hopefully in the future, Fr. Leroy said, referring to Mayor Abunda. The city government was extolled further by the Borongan diocese because of its full support in bringing back of the Angelus Prayer habit at every six oclock in the a ernoon. Seminar workshops for local government unit


TACLOBAN CITY- The municipality of San Sebastian, Samar conducted a seminar headed by the Department of the Interior and Local Government (DILG). DILG municipal government operation officer Carel Jean Uy said that the seminar was to orient the newly and re elected o cials about monitoring and supervising the local government unit (LGU). is seminar is composed of mayor, vice mayor, Sangguniang Bayan, department heads and other head o cials in different provinces. Suspected salvaged man found oating at sea in Ormoc


ORMOC CITY -- A sherman from a coastal barangay in this city discovered a lifeless body of a man believed to be a victim of summary execution oating near the shore of Ormoc Bay around 5:25 p.m. on August 27. Danilo Vicera found the unidenti ed naked body already bloated, decomposing and reeking with foul smell, believed to have been dead for more than 24 hours. Applicants for OWWA search for outstanding OFW family ends today
TACLOBAN CITY- e regional o ce of the Overseas Workers Welfare Administration (OWWA-8) is still accepting for their search on Model OFW Family of the Year (MOFYA). A l b e r t o P e a f l o r, OWWA-8 information officer, said that nomination forms and other information about MOFYA 2013 is available on their website (www.owwa.gov.ph) or interested participants may visit their o ce located at DOLE Compound, Tarcela Street, this city. The nominations for MOFYA 2013 started last May 2 and will be open until August 31. The MOFYA, which is now on its ninth year, is a medium that commends the achievements of OFWs and their families in managing the impact of overseas employment in family life. The nomination criteria, among others, includes the following: the family is headed by an OFW who is formerly or presently working abroad with a formal or informal contract of employment or work permit and with proof of OWWA membership; the OFW, either married or single, is the breadwinner of the family and has at least four years or work experience as an OFW; and the family is known as a solid and stable family in the locality. Accordingly, two regional winners will be declared and to compete on the National MOFYA participated by 17 regions from all over the country. Said competition will be held at Manila on November 15, 2013. Last year, OWWA RWO-8 representative, Captain Manuel Gabornes and family from Lawaan, Eastern Samar, was awarded as the National Model OFW Family of the Year.

Today, Tacloban says Thank You, Lord for ATOM 7.6

year ago today, Tacloban experienced a 7.6 temblor that rocked homes and establishments. It brought tremendous fear and panic among people and families. Miraculously, no one was hurt even the buildings were left unscathed save for a few cracks on glass panes. It was a horrendous experience that brought to mind apocalyptic events only seen in movies. The incident brought to mind the happenings in distant lands where people are devastated watching homes, buildings and structures totally destroyed, razed to the ground with the survivors wailing and mourning over their dead. Tacloban and the rest of Eastern Visayas were miraculously spared. Philvocs experts said we were luckier that the origin of the quake was deeper than the ones felt in other lands. But the truth is, we were lucky that there was Divine Intervention, the great hands up there stayed the great swaying of the earth and prevented the tide from rising..

The August Twenty One Miracle of 2012 calls for a Day of Prayer and Thanksgiving. Today, as we recall the terror, despair and panic, we get together physically and in spirit to pray and give thanks to the Lord for sparing us from the possible catastrophe and tragedy. We do not want a repeat of the experience but we want to show a miracle of thanksgiving from our end, a city that is one in action, thoughts and spirit. Never did it happen before, this show of oneness and unity to give back what we have received. Today, politics is set aside to give way to what matters most the realization that man is nothing, knows nothing and can do nothing without God. Today, a miracle has happened! For the rst time, the media people became one, not divided by political alliances and afliations, we are simply singing one song, a Song of Praise and Prayer.

A personal account of ATOM 7.6


It was an ordinary night, the family was relaxing ready for bed. I was lying in bed conditioning my eyes to sleep when suddenly it occurred. The bed suddenly rocked vigorously. I got frightened; I started groping for my slippers as the lights suddenly went off. As I managed my way out of our bedroom, I grabbed my small emergency bag with ashlight, water, my medicines, whistle, matches, one mother yelling for everyone in their house to get outside. Later, when the temblor stopped, I asked my husband to call our daughter in CDO to know her predicament. She is a licensed social worker and trained in disaster management, yet I feared for her well-being. My husband easily connected to her and learned she and others are all out of the hotel and safe. Large parts of Samar and Leyte province had no power or internet connections. The only lights you see are from vehicles in the streets headed to higher ground, said a radio reporter in the town of Borongan. The tsunami warning was initially issued for the Philippines, Japan, Indonesia, Taiwan, Papua New Guinea and other islands in the Pacic including the U.S. state of Hawaii. Small waves of about 16 cm (6 inches) had hit a southern Philippine island, the seismology agency said, and warned that bigger ones could follow and residents were ordered to get to ground 10 meters (30 feet) above sea level. The region has been hit by two huge quakes in the past decade. At least 230,000 people in 13 Indian Ocean countries were killed in a quake and tsunami off Indonesia in 2004. Last year, an earthquake and tsunami off Japans northeastern coast killed about 20,000 people and triggered the worlds worst The rst popular ATOM as an acronym was spelledout as August Twenty-One Movement in reference to the assassination of Senator Benigno S. The incident almost wiped-out the entire senatorial slate of the Liberal Party and the bombing was reportedly quickly blamed of an accused before his arrest, showing either acknowledgment of his guilt or an intention to save the authorities from the trouble and expense that his search and capture would require. The mere period of time that it took for Napoles to surrender is alone anathema to an intention on her part to spare the authorities of the trouble and money that will be required in searching for and capturing her. Now even on the assumption that Napoles is entitled to the mitigating circumstance of voluntary surrender, it will not do her any good all the same. She is charged for the felony of kidnapping and serious illegal detention punishable by reclusion perpetua to death, both of which are indivisible penalties. Considering that the death penalty has already been scrapped, kidnapping is now punished with a single indivisible penalty, i.e. reclusion perpetua and our penal code decrees that that penalty should be imposed by the court regardless of any mitigating circumstance that may have attended in the commission of the deed. ASPA Just when everybody thought she has already gotten away in one of her yachts and no longer within this countrys criminal jurisdiction, Janet Lim Napoles surprised us with an unusual feat. It was unusual not least because she did it two days after the mass protest akin to EDSA that called for the abolition of the very thing which has become our authorities basis for hunting her down nor because President Aquino placed a bounty on her head for her capture. It was unusual because it took her 14 long days before nally realizing there was no point in running away and hiding. Napoles was quick to reveal the reason for her surrender: she fears for her life. Although the details of it were not set out, her lawyer was similarly quick to retort that there are people who want to keep her silent permanently. Assuming that fear of hers to be just a gment of her imagination, what other good if any did her surrender do her? A modest student of law should know that voluntary surrender is one of the circumstances provided by the Revised Penal Code which mitigates the liability of an accused. Once that circumstance is found to be attendant in a particular case, it has the effect of compelling the deciding judge to either impose the lower or lowest penalty provided for the felony in case of two or three divisible penalties or the minimum period of the penalty in case of a single divisible penalty. That is however all on the supposition that there is no ag-

gravating circumstance to offset it. So did Napoles surrender to President Aquino on the night of August 28, 2013 entitle her to the mitigating circumstance of voluntary surrender? I should submit that she indeed surrendered but it wasnt voluntary as would entitle her to a mitigation of her liability. For one, considering her reason for surrendering, i.e. she fears for her life, there was nothing voluntary in her act of giving herself up to the president. In relation to voluntary surrender, an act is deemed to be marred with voluntariness when it was done for no reason other than for that which lies behind the very existence of the circumstance itself, that is to say to spare the authorities of the money and the effort in searching for her. When Napoles wailed that she surrendered because she fears people are out to get her, that negated any voluntariness in her act of surrender. Second, jurisprudence is emphatic that what the law considers as mitigating is the voluntary surrender

My other son, a teacher came down from his room and told us, he could not leave his room even if he heard me calling him as he was holding on to his TV set scared that it might fall down the shelf. It was funny but a ridiculous thing to do. But it was a lesson for everyone at home to detach oneself from material things during emergencies. I had to be coaxed to come inside the house; I was scared but laughing to learn we were all safe and okay. The incident left a soft spot in my consciousness. My personal motto that I am nothing; I can do nothing and know nothing without God became pronounced. I realized how fragile life is; one second I was serenely in bed, the next moment, I was scrambling and scared. I also wondered how life is a miracle all the time. When I realized that my two sons were outside the house that night, I suddenly realized that the reality of being apart from each other when natural occurrences and calamities happen will always be there. That is when I repeated what I have always told them. When they were still studying at CRMNHS and Sped Center, I told them not to attempt to go

Of course, everyone was thankful that God, though had allowed the Earth to shake tremendously on the dreadful night along the Philippine Plate facing the Pacic, he did not allow any life to perish, not even allowed a tsunami to happen after the quake. In the onslaught of the killer quake that slaughtered at least 20,000 lives in Japan in 2010 and the other similar earthquakes that wrought havoc and countless deaths, documentaries were released in the quad-media about the Pacic Ring of Fire where the Philippine Pacic Plate is located. There was a report that it another deadly earthquake as strong as the Magnitude 9 tremor that rocked Japan could happen anytime in the Pacic, particularly the Philippine Plate which could cause gripping destruction and death toll. When the August 31 quake off the coast of Eastern Samar last year happened, an initial reaction was that it could already be the one fear of. Yet, it was not, on the contrary, no one was seriously hurt. As for my family, such saving power of God was another compelling reason for us to ponder how ready are we to face Him when Judgment Day comes. After the earthquake, my family and I said our regular Holy Rosary prayer thankful to the Holy Trinity, Blessed Virgin Mary, St. Jude and St. Anthony of Padua for keeping us all safe. It was really, for me, a night of miracle. To God be the glory!

ATOM TESTIMONIES: August 31, 2012 was indeed a day of great miracle that the people of Eastern Visayas, especially those in the coastal areas facing the Paci c where the 7.6 magnitude earthquake emanated, have to thank and praise God Almighty for saving everyone from harm. I was at the Leyte Provincial Hospital then attending to my wife who just delivered our second baby. I was attending my wife and my new born baby girl named Aviyah. I just recited the most powerful prayer in Judaism Shema Yisrael Adonai Eloheinu, Adonai Echad. (Hear O Israel, the Lord our God, the Lord is One.) Quoted from Deuteronomy 6:4 and Mark 12:28-29. I noticed that people were panicking. Worse, the patients at the hospital including the medical sta s ran outside thinking that the building might collapsed. For fear that they might be pinned inside, people were scrambling to the exit door and I saw bundles of dreadful faces surrounded the hospital premises. Our room mate even urged us to get out of the building with haste but I calmly responded and told my wife, we are not leaving because today is Shabbat (because that was Friday eve) and HASHEM (G-d in Hebrew) will show us His salvation. To be honest, yes. I thought tsunami will hit the heart of Leyte especially that there is a warning which came from the authorities that a large sea wave will hit Region 8. Modesty aside, I was already close to Him even before that almost tragic soul breaking earthquake last year. ATTY. FERDINAND ARTHUR DIAZ, a Jew and private practitioner. I was at home having dinner with my mom when the earthquake struck, when our house started to shake. I told my mom to stay calm. Our household help started to panic and she wanted to run out of the house. I told her to stay focused. In times like these, you really have to stay focused and collected so that you exactly know what to do. Of course, you have to prepare yourself for the worst scenario but as I said, you should stay focus. We can never make sound decisions in a state of panic. I always pray to God with or without an earthquake. We should always pray for Gods forgiveness and blessings. is should be done on a daily basis. I took her from Pangasinan and brought her here to Borongan because no one is taking care of her there. In my shock and my 89-year old grandmothers fright, I carried her out of the house. It was rainy on that moment so we got terribly wet. e people panicked. en the tsunami alert broke. So what my grandmother and I did was we brought some of our belongings like cloths, biscuits, bottled water & ash light. e rst one I called was Sir Daep, the chief of the CIDG. He advised me and my lola to momentarily stay at the CIDG o ce. So that was what we did. My lola was so afraid at that time. A er few hours, authorities lowered the tsunami alert and eventually li ed it since no tsunami occurred. I am really thankful to God that the tsunami did not happen. We are very thankful to God that it did not occur and my grandmother calmed down. A little later a er the li ing of the tsunami alert, my grandmother and I returned to my boarding house safely. I was about to go to sleep when I felt that my bed was shaking. I was nervous and scared because my two grand children were in the other room.
