GAME SHOW KD: Welcome to the Global Application of the Code and Standards SHOW! So, we will have a game. You will only choose between Applicable Law or Code and Standards. But before that, Nia and Naomi will explain to you what are Applicable law and Code and Standards. Nia: Hi, so I will explain about the Applicable law. What is applicable law? Applicable law is the law that governs the members or candidates conduct. So, Applicable law is the law of a certain country that members and candidates should follow. Naomi: Code and Standards is what we call the international law . This means that Code and Standards should be followed by all of the countries. But, there are situations where you follow on applicable law than Code and Standards or vice versa. For example, the country has a law that is stricter than the Code and Standards so the members should adhere to the applicable law which is stricter. But when the country has a more strict law than the Code and Standards, then members should follow the applicable law. Nia: In short, members should follow the stricter one. KD: So lets start. Group 1 here and 2 here. Theres a price for the winning team. So representative each group. So First question, members resides in no regulations country but does business in less strict country. Which would they follow? Ready go! And the answer is Codes and Standards. Why? Because applicable law is less strict than the Code and Standards. Nia: Second question, members does business in a more strict country. Which would they follow? Ready go! The answer is Applicable law. Because obviously, applicable law is more strict. Naomi: Third question, Members resides in less strict country and does business in no regulations country so less strict law applies but it states that law of locality where business is conducted governs. Which would they follow? Ready go! The answer is Code and Standards because applicable law states that the law of the locality where the business is conducted governs and there is no local law so therefore they would adhere Code and Standards. KD: Fourth question, members resides in more strict country and does business in less strict country with a client who is a citizen of less strict country. But it states that the law of the clients home country governs. Which would they choose? The answer is, Code and Standards because applicable law states that the law of the clients home country governs (which is less strict than the Code and standards), members should adhere to the code and standards. Nia: Last question, members does business in less strict country with a client who is a citizen of more strict country. The law states that the clients home country governs. Which would they follow?
