SOURCES OF LAW 1. STATUTORY LAW It is the written enactment of the will of the legislative branch of the government. In the Philippines it includes constitutions, treaties, statues proper, municipal charters, municipal legislations, court rules, administrative rules and orders, legislative rules and presidential issuances. Ex.: Public Laws, Acts, Commonwealth Acts, Republic Acts, Executive Orders, Presidential Decrees, Proclamations etc. 2. CASE LAW Cases decided by courts or by persons performing judicial functions. It is the official interpretation or manifestation of law. Also includes running in administrative and legislative tribunals such as decisions made by the Presidential or Senate or House Electoral Tribunals. Ex. Court of Appeals and Supreme Court Decisions

CLASSIFICATIONS BY AUTHORITY Primary Authority are those contain actual law or those contain law created by the three branches of government (Legislative, Executive, and Judiciary) Secondary Authority those sources are commentaries or books, treaties, writing or articles that explain, discuss or comment on primary authorities. (SCRA, DOJ opinion, BSP circulars) CLASSIFICATION BY SOURCE Primary Sources are those published by the issuing agency itself or the official respiratory Ex. Legislative Enactment Official Gazette (published by National Printing Office) Law and Resolutions (published by the Congress) Supreme Court Decisions Official Gazette (selective) Advance Supreme Court Decisions (loose leaf) Philippines Reports Secondary Sources are unofficial sources and generally refers to those commercially published.
