Abstract: The purpose of this article is dealing on the importance of popular will in the
creation, definition, control and even extinction of the legal standard. In this context, we
exactly treat about the theory of the people’s Constituent Power, returning the
discussion between legality and legitimacy of the legal rule, and, as well said by
Arnaldo Vasconcelos, the state as judge of the legality and the nation as supreme arbiter
of legitimacy. We support the criticism of Müller, who infers a mere reference to the
people as the holder of power in the Constitution, when we know that the reality is
different, which provokes the crisis of the system of representative power. Finally, we
link every aspect of validity of the legal standard to the people, demonstrating their
importance as a source that legitimizes the Law.
