1. The test for remoteness of damages is foresee-ability. The test of directness as laid down in
in Re Polemis Case has been rejected subsequently.
2. Reasons for lack of tort litigation are:a) Lack of consciousness (major reason)
b) High cost of litigation
c) Undue delay
d) Redressal in Criminal law
e) Non-report-ability of tort cases decided by Subordinate courts
f) Illiteracy
3. Arrest in consequence of complaint made to Judicial Officer would not make defendant liable
for false imprisonment even if complaint was actuated with malice. However damages for
malicious prosecution can be claimed because prosecution under tort law is not to be
understood in the same way as understood in Criminal Law. Question is based on Madan
