Resolution No. (5)- 2013

In accordance with my designative authority and provision 20 (2) of the Constitution of the Sudan Peoples Liberation Movement/ Army- North (SPLM/A-N), 2013, I issue the following resolution: a) Name of Resolution and Entrance into Force: SPLM/A-N Chairperson resolution to establish a Commission for the Protection of Civilians, Women and Children (CPCWC) . The resolution enters into force on the date it was signed. b) Establishment: According to this resolution a Commission for the Protection of Civilians, Women and Children is hereby established. c) The Mandate of the Commission: the mandate of the Commission will be the following: 1. Formulation and adoption of policies to protect civilians, including in particular women and children in the liberated areas, in accordance with the constitution of the SPLM/A-N, approved laws of the civic authorities of the SPLM/A-N, and relevant regional and international instruments. 2. Protection and promotion of the rights of civilians, women and children through raising awareness of and monitoring the enjoyment of human rights and basic freedoms in the liberated areas as integrated in the Constitution of the SPLM/AN, 2013, the Penal Code, 2003, and regional and international human rights and humanitarian law instruments. 3. Functioning as a reference institution for relevant SPLM/A-N bodies and other civil society and nongovernmental organizations working on the protection of civilians and the promotion of the rights of women and children. 4. Enlightening public opinion on the rights of civilians, women and children, and ensuring the

implementation of these rights. 5. Conduction of studies that are referred by the SPLMN bodies and other civil society organizations on any subject/topic related to the protection of civilians, women and children.] 6. Design and conduct of studies, reports, initiatives and draft legislation related to the protection of civilians, women and children, including formulation of recommendations to relevant SPM/A-N bodies and other actors. 7. Contribution to the protection of civilians during conflict through awareness raising programs and activities that expose of dangers of war and their mitigation, including for example means of protection from aerial bombardment. 8. Utilization of all forms of media outlets to increase awareness among all sectors of the population on protection of civilians and the rights of women and children. 9. Cooperation with the United Nations, including its specialized agencies, and other regional bodies, civil society and non-governmental organizations and others institutions and mechanisms. 10. Submission of reports to the leadership of the SPLM/A-N on any matter related to the protection of civilians, and the rights of women and children. 11. Conduct of any other tasks that are assigned by the leadership of the SPLMN. d) Authorities of the Commission: In order to implement its mandate the Commission for the Protection of Civilians and the Promotion of the Rights of Women and Children is designated to do the following: 1. Formation of permanent or ad hoc sub committees, working groups, and conduct of consultations with individuals and institutions. 2. Conduct of investigations, in full freedom, on all mandated matters, whether an issue is referred by SPLM/A-N bodies or by other institutions, by individuals concerned about violations of their own rights or the rights of others, or promote by the Commission itself. 3. Communicate directly with the public and other concerned bodies about the Commission's work. 4. Receive reports from the Human Rights Court and directing concerned SPLMN bodies to make decisions on these reports. 5. Development and issuing of by-laws and internal procedures regulating the Commission meetings and its work. e) The Structure of the Commission: The Commission comprises of the following; 1. President, 2. Vice President, 3. Rappoture, and 4. Members.

f) Appointments: The Chairperson of the SPLM/AN appoints the following persons in the Commission: 1. Bishop Andudu Adam Al-Nil 2. Abdel-Monim El Jak 3. Bakri Yousif 4. Howida Bashir 5. g) Financial Resources: Financial resources of the Commission consist of the following: 1. Financial allocations from the civil authorities in the liberated areas. 2. Donations and supports gained by the Commission. h) Duration and Location of the Commission: a Commission for the Protection of Civilians, Women and Children is a permanent body that can include other members. The leadership Council of the SPLMN can terminate the work of the Commission. The main location of the Commission is the liberated areas.
