CONSENTAGREEMENT
BETWEEN
MARKE. DILUCIANO,M.D.,
AND
THESTATEMEDICALBOARDOFOHIO
This ConsentAgreementis enteredintobyandbetweenMarkE. DiLuciano,M.D., [Dr.
DiLuciano],and the StateMedicalBoardofOhio [Board], astateagencychargedwithenforcing
Chapter4731., OhioRevisedCode.
Dr. DiLucianoentersintothisConsentAgreementbeingfully informedofhisrightsunder
Chapter 119., Ohio RevisedCode,includingtherightto representationby counselandtheright
to aformal adjudicativehearingontheissuesconsideredherein.
BASISFORACTION
ThisConsentAgreementis enteredinto onthebasisofthefollowing stipulations,admissions
andunderstandings:
A. TheBoardis empoweredbySection4731.22(B),Ohio Revised Code,to limit,
revoke, suspendacertificate,refuseto registerorreinstateanapplicant,orreprimand
orplaceonprobationtheholderofacertificatefor aviolationofSection
4731.22(B)(26), OhioRevisedCode,for "impairmentofabilityto practiceaccording
to acceptableandprevailingstandardsofcarebecauseofhabitualorexcessiveuseor
abuseofdrugs,alcohol,orothersubstancesthatimpairabilityto practice."
B. TheBoardentersintothisConsentAgreementinlieuofformal proceedingsbased
upontheviolationofSection4731.22(B)(26),Ohio Revised Code,assetforth in
ParagraphE, below,andexpresslyreservestherightto instituteformal proceedings
baseduponanyotherviolationsofChapter4731. oftheRevisedCode,whether
occurringbeforeoraftertheeffectivedateofthisConsentAgreement.
C. Dr. DiLuciano is seekingreinstatementofhiscertificatetopracticemedicineand
surgery, licensenumber35.062171,whichwasindefinitelysuspended,butnotless
thanninetydays,pursuantto the StepIConsentAgreementBetweenMarkE.
DiLuciano,M.D.,andtheStateMedicalBoardofOhio [November2010 StepI
ConsentAgreement],effectiveNovember10,2010,acopyofwhichis attached
hereto and incorporatedherein.
D. Dr. DiLuciano statesthatheis notlicensedto practiceinanyotherstateor
jurisdiction.

E. Dr. DiLucianoadmitsthatafterenteringresidential treatmentforalcohol dependency
onorabout October21, 2010,at GlenbeighHospital,aBoard-approvedtreatment
providerinRockCreek,Ohio,hewasdischargedtreatmentcompleteonorabout
November 18, 2010. Dr. DiLucianostates,and theBoardacknowledges receiptof
informationto support,thatsincebeingdischarged from GlenbeighHospital, he has
remainedcompliantwiththeaftercarecontractheenteredonoraboutNovember22,
2010,withSt. ThomasHospital,IgnatiaHall, aBoard-approvedtreatmentproviderin
Akron, Ohio, includingattendingweeklyaftercaregrouptherapysessions,attending
at leastthreetofive TwelveStepMeetingsperweek, abstinencefrom mood-altering
substances,andrandomdrugscreeningperformedthroughFirstLab. Dr. DiLuciano
admitsthattheaforementionedaftercarecontractremains ineffect.
Dr. DiLucianoadmits, and theBoardis in receiptofinformationtosupport,that
TheodoreParran,M.D. andChristopherAdelman, M.D.,withGlenbeighHospital,
assessedDr. DiLuciano,andfound thathe is capableofpracticingmedicineand
surgeryaccordingto acceptableandprevailingstandardsofcare, withthe
recommendationthatDr. DiLucianoobtainsamonitoringphysician.
Dr. DiLucianoadmitsfurther, andtheBoardis in receiptofinformationto support,
thatRichardM. Whitney, M.D., MedicalDirectorofAddiction ServicesatShepherd
Hill Hospital,aBoard-approvedtreatmentproviderinNewark, Ohio, assessedDr.
DiLuciano,andfound thathe iscapableofpracticingmedicineand surgeryaccording
toacceptableand prevailingstandardsofcare,uponconditionsincludingthatDr.
DiLucianorefrainfrom practicingmedicinefor aperiodofapproximatelysix months
from hisadmittanceto GlenbeighHospital in October2010,opiningthatadelayed
returntopracticetoearlyApril2011 wouldallowhimacontinuedperiodofself-care
and workonhisrecoveryprogramwhichwillenhancehischancesfor sustained
sobriety.
Dr. DiLucianoadmitsfurther, andtheBoard is inreceiptofinformationto support,
thatAlanShein,M.D.,ofSt. ThomasHospital,IgnatiaHall, assessedDr. DiLuciano,
andfound thathe iscapableofpracticingmedicineand surgeryaccordingto
acceptableand prevailingstandardsofcare, uponconditionthatduringthefirst two
yearsofhissobriety,thatherestricthisworkhoursto an averageofforty-eight hours
perweekoverafour-week period,whichwouldserveto limithisworkloadbutallow
himto function oncall as an anesthesiologist.
Accordingly, Dr. DiLucianostates,and theBoardacknowledgesreceiptof
informationto support,thatDr. DiLucianohasfulfilled theconditionsfor
reinstatementofhiscertificateto practicemedicineand surgeryinthestateofOhio,
asestablishedintheabove-referencedNovember2010 Step IConsentAgreement
betweenDr. DiLucianoand theBoard.

AGREED CONDITIONS
Wherefore, inconsiderationoftheforegoingandmutualpromiseshereinaftersetforth, andin
lieuofanyfonnal proceedingsatthistime,thecertificateofDr. DiLucianoto practicemedicine
andsurgeryin theStateofOhioshall beREINSTATED,andDr. DiLucianoknowinglyand
voluntarilyagrees withtheBoardto thefollowing PROBATIONARYtenns,conditionsand
limitations:
1. Dr. DiLucianoshallobeyall federal, state, and local laws, andall rulesgoverningthe
practiceofmedicineinOhio.
2. Dr. DiLucianoshall submitquarterlydeclarationsunderpenaltyofBoarddisciplinary
actionand/orcriminalprosecution,statingwhethertherehas beencompliancewithall
theconditionsofthis ConsentAgreement. Thefirstquarterlydeclarationmustbe
received intheBoard'sofficesonthedatehisquarterlydeclarationwouldhavebeen
duepursuanttohisNovember2010ConsentAgreementwiththeBoard,oras
otherwiserequested by the Board. Subsequentquarterlydeclarationsmustbe
receivedintheBoard'sofficesonorbeforethefirstdayofeverythirdmonth.
3. Dr. DiLuciano shall appearin personfor aninterviewbeforethefull Boardorits
designatedrepresentative. Thefirstsuchappearanceshalltakeplaceonthedatehis
appearancewouldhavebeenscheduledpursuantto hisNovember2010StepI
ConsentAgreementwiththe Board. Subsequentpersonalappearancesmustoccur
everythreemonthsthereafter, and/oras otherwiserequestedbytheBoard. Ifan
appearanceis missedoris rescheduled foranyreason,ensuingappearancesshallbe
scheduledbasedontheappearancedateas originallyscheduled.
4. Dr. DiLucianoshallobtainpennissionfromtheBoardfordeparturesorabsences
from Ohio. Suchperiodsofabsenceshallnotreducetheprobationarytenn,unless
otherwisedetenninedby motionoftheBoardforabsencesofthreemonthsorlonger,
orby the Secretaryorthe SupervisingMemberofthe Boardfor absencesofless than
threemonths, in instanceswheretheBoardcanbeassuredthatprobationary
monitoringis otherwisebeingperfonned. Further,the Secretaryand Supervising
MemberoftheBoardshallhavethe discretionto grantawaiverofpartorallofthe
probationarytennssetforth inthis ConsentAgreementforoccasionalperiodsof
absenceoffourteen daysorless. In theeventthatDr. DiLucianoresidesand/oris
employedatalocationthatis withinfifty milesofthegeographicborderofOhioand
anyofits contiguousstates, Dr. DiLucianomaytravel betweenOhioandthat
contiguousstatewithoutseekingpriorapprovalofthe SecretaryorSupervising
MemberprovidedthatDr. DiLucianoisabletootherwisemaintainfull compliance
withall othertenns,conditionsand limitationssetforth in this ConsentAgreement.
5. IntheeventDr. DiLucianois found by the SecretaryoftheBoardto havefailedto
complywithanyprovisionofthisConsentAgreement,and is sonotifiedofthat

deficiencyin writing,suchperiod(s)ofnoncompliancewill notapplyto thereduction
oftheprobationaryperiodunderthisConsentAgreement.
MONITORING OF REHABILITATION AND TREATMENT
Drug Associated Restrictions
6. Dr. DiLuciano shallkeepalogofall controlledsubstancesprescribed. Suchlogshall
besubmitted,intheformatapprovedbytheBoard,onthedateuponwhichDr.
DiLuciano'squarterlydeclarationisdue,oras otherwisedirectedbytheBoard.
Further,Dr. DiLucianoshall makehispatientrecordswithregardto suchprescribing
availablefor reviewbyan agentoftheBoard immediatelyuponrequest.
7. ForthepurposesoffacilitatingDr. DiLuciano'spracticeofanesthesiology,Dr.
DiLuciano shall bepermittedto possesscontrolledsubstancesonlyto theextentthat
suchpossessionisinherentlynecessaryto administerorfurnishcontrolledsubstances
to patientsduringworkperiodsatahospital facility, in accordancewiththis
paragraph. Otherwise,Dr. DiLucianoshallnotadminister,personallyfurnish, or
possess(exceptas expresslyallowed inthisConsentAgreement)anycontrolled
substancesas definedby stateorfederal law.
Dr. DiLuciano'spossessionofcontrolledsubstancesduringworkperiodsatahospital
facility shall be limitedto controlledsubstancesobtainedby Dr. DiLucianofor
immediateadministrationto eachpatientduringtheworkperiodinwhichthe
controlledsubstancesareacquired. Priorto acceptingpossessionofanycontrolled
substances,Dr. DiLucianoshall ensurethatanaccountingoftheamountsandtypesof
controlledsubstancebeingreleasedto himhasbeenperformedand documentedby
another, who is legallyauthorizedto possesssuchcontrolledsubstances. Further,at
orpriorto theendoftheworkperiod,Dr. DiLucianoshallreturntheunused
controlledsubstancesto another,who islegallyauthorizedto possesssuchcontrolled
substances,and shallensurethatanaccountingoftheamountsandtypesofcontrolled
substancesreturned by him isperformedand documented. In addition, Dr. DiLuciano
shallprovideto the individualperformingthe accountingofthe unusedmedications,a
logdetailingtheamountandtypeofthecontrolledsubstanceadministeredto each
patientduringtheworkperiod,as wellasthenameofthepatientto whomthe
medicationwas administered,andshallensurethatacomparativeauditisperformed
to determinewhetherornotall controlledsubstancesreleasedto Dr. DiLuciano
duringtheworkperiodareappropriatelyaccounted for, and shallfurtherensurethata
comparativeauditreportis preparedreflectingtheauditfindings. Dr. DiLucianoshall
notdisposeofanyunused"waste"controlledsubstances.
In addition, Dr. DiLucianoshall ensurethatanassayis performedofthe contentsofat
leastonevial, orequivalentunit,ofunusedmedicationsreturnedduringaoneweek
period; thatsuchvial, orequivalentunit, is randomlyselected;and thatall assays

reportedare forwarded directlyto the Boardonaquarterlybasis. Thecostsassociated
withsuchassays shall be bornebyDr. DiLuciano.
Intheeventthatthecomparativeauditreportrevealsadiscrepancyrelatedto any
controlledsubstancespossessed,administered,andreturned,orshouldanassayreport
indicatethatthecontrolledsubstancetestedis adulterated, Dr. DiLucianoshall
immediatelynotifytheBoard. Suchnoticeshall bethroughtelephonecommunication
to the Boardattheearliestopportunity,andshallbe followed bywritten
communicationto theBoardwithinseventy-twohours. Inaddition,Dr. DiLuciano
shall ensurethatall suchauditreports are immediatelyforwarded directlyto the
Board.
Otherwise,all comparativeauditreportsand assayreports acquiredunderthis
paragraphmustbereceived intheBoard'sofficesno laterthantheduedatefor Dr.
DiLuciano'squarterlydeclaration. It isDr. DiLuciano'sresponsibilityto ensurethat
all reportsacquiredpursuanttothis paragrapharetimelysubmitted.
Further,Dr. DiLucianoshallkeepalogofall controlledsubstancesprescribed,
administered,orpersonallyfurnished. Suchlogshall be submittedintheformat
approved by theBoardand shall be submittedto the Boardno laterthanthedateupon
whichDr. DiLuciano'squarterlydeclarationis due,oras otherwisedirectedby the
Board. Further,Dr. DiLucianoshallmakehis patientrecordswithregardto such
prescribing,administering,orpersonallyfurnishingavailablefor reviewbyanagent
oftheBoardimmediatelyuponrequest.
Sobriety
8. Dr. DiLucianoshallabstaincompletelyfrom the personaluseorpersonalpossession
ofdrugs, exceptthoseprescribed,dispensedoradministeredto himbyanotherso
authorizedby lawwhohas full knowledgeofDr. DiLuciano'shistoryofchemical
dependency. Further,intheeventthatDr. DiLucianois soprescribed,dispensedor
administeredanycontrolledsubstance,carisoprodol,ortramadol, Dr. DiLucianoshall
notifytheBoardinwritingwithinsevendays, providingthe Boardwiththeidentityof
theprescriber;thenameofthedrugDr. DiLucianoreceived; the medical purposefor
whichhe receivedsaiddrug; thedatesuchdrugwasinitiallyreceived; and thedosage,
amount,numberofrefills, anddirectionsfor use. Further,withinthirtydays ofthe
datesaiddrugis so prescribed,dispensed, oradministeredtohim, Dr. DiLuciano
shallprovidetheBoardwitheitheracopyofthewrittenprescriptionorotherwritten
verificationfrom the prescriber, includingthe dosage, amount,numberofrefills,and
directionsfor use.
9. Dr. DiLucianoshallabstaincompletelyfrom the useofalcohol.

10. Dr. DiLuciano shall submitto randomurinescreeningsfordrugsandalcoholatleast
two timespermonth,oras otherwisedirectedby the Board. Dr. DiLuciano shall
ensurethatall screeningreportsare forwardeddirectlyto the Boardonaquarterly
basis. Thedrugtestingpanel utilizedmustbeacceptableto the Secretaryofthe
Board,and shall includeDr. DiLuciano'sdrug(s)ofchoice.
Dr. DiLuciano shall abstainfrom the use ofany substanceandtheconsumptionof
poppyseedsoranyotherfood orliquidthatmayproducealowlevelpositiveresultin
atoxicologyscreen. Dr. DiLucianoacknowledgesthathe understandsthatthe
consumptionoruseofsuchsubstances,includingbutnotlimitedto substancessuch
asmouthwashorhand cleaninggel, maycauseapositivedrug screenthatmaynotbe
ableto bedifferentiatedfrom intentional ingestion,and thereforesuchconsumptionor
useis prohibitedunderthisConsentAgreement.
All suchurinescreeningsfordrugsandalcohol shallbeconductedthroughaBoard-
approved drugtestingfacility and collectionsitepursuantto theglobal contract
betweensaidfacilityand theBoard,thatprovidesfor the Boardto maintainultimate
controlovertheurinescreeningprocessandto preservetheconfidentialityofall
positivescreeningresults inaccordancewithSection4731.22(F)(5), OhioRevised
Code,andthescreeningprocessshall requireadailycall-inprocedure. Further,inthe
eventthattheBoardexercisesits discretion, as providedinParagraph 11 below,to
approveurine screeningsto be conductedatanalternativedrugtestingfacility and/or
collectionsiteorasupervisingphysician,suchapproval shall be expresslycontingent
upontheBoardretainingultimatecontroloverthe urinescreeningprocessina
mannerthatpreservesthe aforementionedconfidentialityofall positivescreening
results.
Dr. DiLucianoshall submit,athisexpenseand onthedayselected,urinespecimens
fordrugand/oralcoholanalysis. Allspecimenssubmittedby Dr. DiLucianoshall be
negative, exceptfor thosesubstancesprescribed,administered,ordispensedto himin
conformancewiththeterms, conditionsand limitationssetforth inthisConsent
Agreement. Refusal to submitsuchspecimen,orfailuretosubmitsuchspecimenon
thedayheis selectedorinsuchmanneras theBoardmayrequest, shallconstitutea
violationofthisConsentAgreement.
Further,withinthirtydaysoftheeffectivedateofthisConsentAgreement,Dr.
DiLucianoshallenterintothenecessaryfinancial and/orcontractual arrangements
withtheBoard-approveddrug testingfacilityand/orcollectionsite inorderto
facilitatetheurinescreeningprocessinthemannerrequiredby thisConsent
Agreement. Further,Dr. DiLucianoshallpromptlyprovidetotheBoardwritten
documentationofcompletionofsucharrangements, includingacopyofanycontract
entered intobetweenDr. DiLucianoand theBoard-approveddrugtestingfacility
and/orcollectionsite. Dr. DiLuciano'sfailure to timelycompletesucharrangements,

orfailure to timelyprovidewrittendocumentationtotheBoardofcompletionofsuch
arrangements,shallconstituteaviolationofthis ConsentAgreement. However,Dr.
DiLucianoandtheBoardfurtheragreethatintheeventDr. DiLucianopreviously
enteredintotheaforementionedfinancial and contractualagreementspursuanttothe
requirementsofapriorconsentagreementwiththeBoardunderwhichDr. DiLuciano
is currentlyparticipatinginan ongoingurinescreeningprocess,thenthis requirement
shall be waivedundertheinstantconsentagreement.
Dr. DiLucianoshallensurethattheurinescreeningprocessperformedthroughthe
Board-approveddrugtestingfacility and/orcollectionsiterequiresadailycall-in
procedure;thattheurinespecimensareobtainedonarandombasis;and thatthe
givingofthe specimenis witnessedby areliableperson. Inaddition,Dr. DiLuciano
and theBoard-approveddrugtestingfacility andcollectionsiteshallassurethat
appropriatecontroloverthe specimenis maintainedand shallimmediatelyinformthe
Boardofanypositivescreeningresults.
Dr. DiLucianoshallensurethattheBoard-approveddrugtestingfacilityand/or
collectionsiteprovidesquarterlyreports to theBoard, inaformatacceptabletothe
Board,verifyingwhetherall urinescreenshavebeenconductedincompliancewith
this ConsentAgreement,and whetherall urinescreenshavebeennegative.
In theeventthattheBoard-approveddrugtestingfacilityand/orcollectionsite
becomesunableorunwillingtoserveas required bythis ConsentAgreement,Dr.
DiLucianomustimmediatelynotifytheBoardin writing,and makearrangements
acceptabletotheBoardpursuantto Paragraph 11 below,as soonas practicable. Dr.
DiLucianoshall furtherensurethattheBoard-approveddrugtestingfacility and/or
collectionsitealsonotifiesthe Boarddirectlyofitsinabilityto continueto serveand
the reasonstherefore.
Dr. DiLucianoacknowledgesthatthe Boardexpresslyreservestherighttowithdraw
its approvalofanydrugtestingfacilityand/orcollectionsitein theeventthatthe
SecretaryandSupervisingMemberoftheBoarddeterminethatthedrugtesting
facilityand/orcollectionsitehasdemonstratedalackofcooperationinproviding
informationtotheBoardorfor anyotherreason.
11. Dr. DiLucianoand theBoardagreethatitis the intentofthisConsentAgreementthat
Dr. DiLucianoshall submithisurinespecimensto theBoard-approveddrugtesting
facilityandcollectionsitechosenby theBoard. However,intheeventthatutilizing
saidBoard-approveddrugtestingfacility and/orcollectionsitecreatesan
extraordinaryhardshipuponDr. DiLuciano,as determinedinthesolediscretionof
theBoard,then subjectto thefollowing requirements,theBoardmayapprovean
alternatedrugtestingfacility and/orcollectionsite,orasupervisingphysician,to
facilitatetheurinescreeningprocessfor Dr. DiLuciano:

a. Withinthirtydays ofthe dateuponwhichDr. DiLuciano is notifiedofthe
Board'sdeterminationthatutilizingtheBoard-approveddrugtestingfacility
and/orcollectionsiteconstitutesanextraordinaryhardshipuponDr. DiLuciano,
he shall submitto the Boardinwritingfor itspriorapproval theidentityof
eitheranalternatedrugtestingfacility andcollectionsite,orthenameofa
proposedsupervisingphysician,to whomDr. DiLucianoshall submitthe
requiredurinespecimens. Inapprovingafacility, entity, oran individualto
servein thiscapacity,theBoard willgivepreferenceto afacility locatednear
Dr. DiLuciano'sresidenceoremploymentlocation,orto aphysicianwho
practicesinthesamelocaleasDr. DiLuciano. Dr. DiLuciano shallensurethat
theurinescreeningprocessperformedthroughthealternatedrugtestingfacility
and/orcollectionsite, orthroughthesupervisingphysician,requiresadailycall-
in procedure;thattheurine specimensareobtainedonarandombasis;and that
thegivingofthespecimenis witnessed byareliableperson. Inaddition,Dr.
DiLucianoacknowledgesthatthealternatedrugtestingfacilityand collection
site, orthesupervisingphysician,shallassurethatappropriatecontroloverthe
specimenis maintainedandshall immediatelyinformtheBoardofanypositive
screeningresults.
b. Dr. DiLuciano shallensurethatthealternatedrugtestingfacility and/or
collectionsite,orthe supervisingphysician,providesquarterlyreportsto the
Board,inaformatacceptableto theBoard,verifyingwhetherall urinescreens
have beenconductedincompliancewiththisConsentAgreement,and whether
all urinescreenshavebeennegative.
c. In theeventthatthedesignatedalternatedrugtestingfacility and/orcollection
site,orthe supervisingphysician, becomesunableorunwillingto so serve,Dr.
DiLucianomustimmediatelynotifythe Boardinwriting. Dr. DiLucianoshall
furtherensurethatthepreviouslydesignatedalternatedrugtestingfacility and
collectionsite,orthesupervisingphysician,also notifiestheBoarddirectlyof
theinabilityto continueto serveand thereasonstherefore. Further, in orderto
ensurethatthere will be no interruptioninhisurine screeningprocess,uponthe
previouslyapprovedalternatedrugtestingfacility, collectionsite,orsupervising
physicianbecomingunableto serve,Dr. DiLucianoshall immediately
commenceurinescreeningattheBoard-approveddrugtestingfacilityand
collectionsitechosenby the Board,until suchtime, ifany, thatthe Board
approvesasubsequentalternatedrugtestingfacility, collectionsite, or
supervisingphysician,ifrequestedbyDr. DiLuciano.
d. TheBoardexpresslyreservestherightto disapproveanyentityorfacility
proposedtoserveasDr. DiLuciano'sdesignated alternatedrugtestingfacility
and/orcollectionsite,oranypersonproposedto serveas hissupervising
physician,orto withdrawapprovalofanyentity,facilityorpersonpreviously
approvedtoso serveintheeventthatthe Secretaryand SupervisingMemberof
theBoarddeterminethatanysuchentity, facilityorpersonhasdemonstrateda

lackofcooperationin providinginformationto the Boardorfor anyother
reason.
e. In theeventthatthe Boardapprovedan alternatedrug testingfacilityand/or
collectionsite, orasupervisingphysician,pursuantto theNovember20 I0Step I
ConsentAgreementbetweenDr. DiLucianoandtheBoard,Dr. DiLucianoand
the Boardagreethattheentity, facilityorpersonpreviouslyapprovedbythe
Boardto so servepursuantto theNovember2010 StepIConsentAgreementis
herebyapproved to continueas Dr. DiLuciano'sdesignatedalternatedrug
testingfacilityandcollectionsiteorashis supervisingphysicianunderthis
ConsentAgreement.
12. All screeningreportsrequired underthisConsentAgreementfrom the Board-
approveddrugtestingfacilityand/orcollectionsite, orfrom the alternatedrug testing
facilityand/orcollectionsite orsupervisingphysician,mustbe received in the
Board'sofficesno laterthantheduedatefor Dr. DiLuciano'squarterlydeclaration. It
is Dr. DiLuciano'sresponsibilityto ensurethatreportsaretimelysubmitted.
13. TheBoardretains the rightto require,andDr. DiLucianoagreestosubmit, blood,
urine, breath,salivaand/orhairspecimensfor screeningfor drugsand alcohol,for
analysisoftherapeuticlevelsofmedicationsthatmaybe prescribedfor Dr.
DiLuciano,orforanyotherpurpose,atDr. DiLuciano'sexpenseupontheBoard's
requestandwithoutpriornotice. Dr. DiLuciano'srefusal to submitaspecimenupon
requestoftheBoardshallresultinaminimumofoneyearofactual license
suspension. Further,thecollectionofsuchspecimensshall be witnessedbya
representativeofthe Board,oranotherpersonacceptableto the Secretaryor
SupervisingMemberofthe Board.
Monitoring Physician
14. Beforeengaginginanymedicalpractice,Dr. DiLucianoshallsubmitto theBoardin
writingthe nameandcurriculumvitae ofamonitoringphysicianfor priorwritten
approval bythe SecretaryorSupervisingMemberofthe Board. Inapprovingan
individualto serve inthis capacity,the Secretaryand SupervisingMemberwillgive
preferencetoaphysicianwhopracticesinthe same localeas Dr. DiLucianoandwho
is engaged in the sameorsimilarpracticespecialty.
ThemonitoringphysicianshallmonitorDr. DiLucianoandhismedicalpractice,and
shallreviewDr. DiLuciano'spatientcharts. Thechartreviewmaybedoneona
randombasis, withthefrequencyand numberofcharts reviewed to bedeterminedby
the Board.
Further, the monitoringphysicianshallprovidetheBoardwithreportsonthe
monitoringofDr. DiLucianoand hismedicalpractice,andonthe reviewofDr.
DiLuciano'spatientcharts. Dr. DiLucianoshallensurethatthereportsareforwarded

to the Boardonaquarterlybasisand arereceivedintheBoard'sofficesno laterthan
the duedate for Dr. DiLuciano'squarterlydeclaration.
In theeventthatthedesignatedmonitoringphysicianbecomesunableorunwillingto
serveinthiscapacity,Dr. DiLucianomust immediatelyso notifythe Boardin writing.
In addition, Dr. DiLuciano shallmakearrangementsacceptableto theBoardfor
anothermonitoringphysicianwithinthirtydaysafterthe previouslydesignated
monitoringphysician becomesunableorunwillingto serve,unlessotherwise
determined by theBoard. Furthermore,Dr. DiLuciano shall ensurethatthe
previouslydesignated monitoringphysicianalso notifiestheBoarddirectlyofhis or
herinabilityto continueto serveandthe reasonstherefore.
TheBoardexpresslyreservesthe rightto disapproveanypersonproposedto
serveas Dr. DiLuciano'sdesignatedmonitoringphysician,orto withdraw
approval ofanypersonpreviouslyapprovedto serveasDr. DiLuciano's
designated monitoringphysician,intheeventthatthe Secretaryand Supervising
Memberofthe Boarddeterminethatanysuchmonitoringphysicianhas
demonstratedalackofcooperationin providinginformationto theBoardorfor
anyotherreason.
Work Hour Limitation
15. Dr. DiLuciano shalllimithison-callscheduleto no morethantwodaysperweek,and
shalllimithisactualworkhoursto no morethananaverageof48 hoursperweek
(averagedoveraperiodofeachmonth),untilotherwiseapprovedby theBoard. Dr.
DiLuciano shallkeepalogreflectingthedates,times,andfacilitiesand/orlocationsat
whichheworksand is on-call. Dr. DiLucianoshallsubmithisworkand on-calllog
for receiptin theBoard'sofficesno laterthantheduedateforDr. DiLuciano;s
quarterlydeclaration.
Anyrequestby Dr. DiLuciano for modificationofthe limitationonworkhoursand/or
on-callschedulesetforth inthisparagraphshallbe accompaniedbydocumentation
from aphysicianaffiliatedwithaBoardapprovedtreatmentprovider,orother
physicianapproved by theBoardfor thispurpose,whohasevaluatedDr. DiLuciano,
indicatingthatsuchphysiciansupportsDr. DiLuciano'srequestformodification.
Rehabilitation Program
16. Dr. DiLuciano shallmaintainparticipationinanalcoholanddrugrehabilitation
program,suchas AA,N.A,C.A,orCaduceus, no lessthanthreetimesperweek.
Substitutionofany otherspecificprogrammustreceivepriorBoardapproval.
Dr. DiLucianoshallsubmitacceptabledocumentaryevidenceofcontinuing
compliancewiththisprogram,includingsubmissionto theBoardofmeeting

attendance logs, whichmustbereceivedintheBoard'sofficesno laterthanthedue
date for Dr. DiLuciano'squarterlydeclarations.
Aftercare
17. Dr. DiLucianoshallcontactanappropriateimpairedphysicianscommittee,approved
bytheBoard,to arrangeforassistanceinrecoveryoraftercare.
18. Dr. DiLucianoshall maintaincontinuedcompliancewiththetermsofthe aftercare
contractenteredintowithaBoard-approvedtreatmentprovider, providedthat, where
termsoftheaftercarecontractconflictwithtermsofthisConsentAgreement,the
termsofthisConsentAgreementshallcontrol.
Releases
19. Dr. DiLucianoshallprovideauthorization,throughappropriatewrittenconsentforms,
for disclosureofevaluativereports, summaries,and records, ofwhatevernature,by
anyandall partiesthatprovidetreatmentorevaluationfor Dr. DiLuciano'schemical
dependencyorrelatedconditions,orfor purposesofcomplyingwiththisConsent
Agreement, whethersuchtreatmentorevaluationoccurred beforeorafterthe
effectivedateofthisConsentAgreement. Totheextentpermittedby law, the above-
mentionedevaluativereports,summaries,and recordsareconsideredmedicalrecords
for purposesofSection 149.43 ofthe OhioRevised Codeandareconfidential
pursuantto statute. Dr. DiLucianofurther agreestoprovidetheBoardwrittenconsent
permittinganytreatmentproviderfrom whomhe obtainstreatmenttonotifythe
Boardintheeventhefails to agreeto orcomplywithanytreatmentcontractor
aftercarecontract. Failureto providesuchconsent,orrevocationofsuchconsent,
shall constituteaviolationofthisConsentAgreement.
Required Reporting by Licensee
20. WithinthirtydaysoftheeffectivedateofthisConsentAgreement,Dr. DiLuciano
shall provideacopyofthisConsentAgreementto allemployersorentitieswith
whichheisundercontracttoprovidehealthcareservices(includingbutnotlimitedto
thirdpartypayors)oris receivingtraining, andthe ChiefofStaffateachhospital
wherehehas privilegesorappointments. Further, Dr. DiLucianoshallpromptly
provideacopyofthis ConsentAgreementto allemployersorentitieswithwhichhe
contractsto providehealthcareservices, orappliesfor orreceivestraining,and the
ChiefofStaffateachhospitalwherehe appliesfor orobtainsprivilegesor
appointments. In the eventthatDr. DiLucianoprovidesanyhealthcareservicesor
healthcaredirectionormedicaloversightto anyemergencymedicalservices
organizationoremergencymedicalservicesprovider,withinthirtydaysofthe
effectivedateofthisConsentAgreementDr. DiLucianoshallprovideacopyofthis
ConsentAgreementtotheOhioDepartmentofPublicSafety,DivisionofEmergency
Medical Services. Further,Dr. DiLucianoshallprovidetheBoardwithoneofthe

following documentsas proofofeachrequirednotificationwithinthirtydays ofthe

21. Withinthirtydaysoftheeffectivedateofthis ConsentAgreement,Dr. DiLuciano
shall provideacopyofthis ConsentAgreementto theproperlicensingauthorityof
anystateorjurisdictionin whichhecurrentlyholdsany professional license, as well
as any federal agencyorentity, includingbutnotlimitedto theDrugEnforcement
Agency, throughwhichhecurrentlyholds any licenseorcertificate. Dr. DiLuciano
furtheragreesto provideacopyofthisConsentAgreementat timeofapplicationto
theproperlicensingauthorityofany statein whichheapplies for anyprofessional
licenseorfor reinstatementofanyprofessionallicense. Further,Dr. DiLucianoshall
providetheBoardwithoneofthefollowingdocumentsasproofofeachrequired
notificationwithinthirtydaysofthedateofeachsuchnotification: (1)thereturn
receiptofcertifiedmailwithinthirtydaysofreceivingthatreturnreceipt,(2)an
acknowledgementofdeliverybearingtheoriginalinksignatureofthepersonto
whomacopyoftheConsentAgreementwashanddelivered,(3)theoriginal
facsimile-generated reportconfirmingsuccessfultransmissionofacopyofthe
ConsentAgreementto thepersonorentityto whomacopyoftheConsentAgreement
was faxed, or(4)anoriginalcomputer-generatedprintoutofelectronicmail
commW1icationdocumentingtheemailtransmissionofacopyoftheConsent
Agreementto thepersonorentityto whomacopyofthe ConsentAgreementwas
emailed.
22. Dr. DiLuciano shallpromptlyprovideacopyofthisConsentAgreementto all
personsand entitiesthatprovideDr. DiLucianochemicaldependencytreatmentor
monitoring. Further,Dr. DiLucianoshall providetheBoardwithoneofthefollowing
documentsasproofofeachrequirednotificationwithinthirtydaysofthedateof each
suchnotification: (1)thereturnreceiptofcertifiedmail withinthirtydaysof
receivingthatreturnreceipt, (2)anacknowledgementofdeliverybearingtheoriginal
inksignatureofthepersonto whomacopyoftheConsentAgreementwashand
delivered, (3)theoriginalfacsimile-generated reportconfirmingsuccessful

23. Dr. DiLucianoshall notifytheBoardinwritingofany changeofprincipalpractice
addressorresidenceaddresswithinthirtydaysofsuchchange.
FAILURE TO COMPLY
If, in thediscretionofthe Secretaryand SupervisingMemberoftheBoard,Dr. DiLuciano
appearstohaveviolatedorbreachedanytermorconditionofthisConsentAgreement,the Board
reservestherighttoinstituteformal disciplinaryproceedingsfor anyandall possibleviolations
orbreaches,including,butnotlimitedto,allegedviolationsofthelawsofOhiooccurringbefore
theeffectivedateofthisConsentAgreement.
IftheSecretaryand SupervisingMemberoftheBoarddeterminethatthere is clearand
convincingevidencethatDr. DiLucianohasviolatedanyterm,conditionorlimitationofthis
ConsentAgreement,Dr. DiLucianoagreesthattheviolation,as alleged,alsoconstitutesclear
and convincingevidencethathiscontinuedpracticepresentsadangerofimmediateandserious
harmtothepublicfor purposesofinitiatingasummarysuspensionpursuantto Section
4731.22(0),OhioRevisedCode.
DURATIONIMODIFICATION OF TERMS
Dr. DiLucianoshall notrequestterminationofthisConsentAgreementfor aminimumoffive
years. In addition, Dr. DiLucianoshallnotrequestmodificationto theprobationaryterms,
limitations,andconditionscontainedhereinfor atleastoneyear,exceptthatDr. DiLucianomay
makesuchrequestwiththe mutual approval andjointrecommendationofthe Secretaryand
SupervisingMember. Otherwise,theabove-describedterms, limitationsandconditionsmaybe
amendedorterminatedinwritingatanytimeupontheagreementofbothparties.
In theeventthattheBoardinitiatesfuture formal proceedingsagainstDr. DiLuciano, including
butnotlimitedtoissuanceofaNoticeofOpportunityforHearing,thisConsentAgreementshall
continueinfull force andeffectuntil suchtimethatitis superseded byratificationbythe Board
ofasubsequentConsentAgreementorissuancebytheBoardofafinal BoardOrder.
In theeventthatanyterm, limitation,orconditioncontainedinthisConsentAgreementis
determinedto be invalid byacourtofcompetentjurisdiction,Dr. DiLucianoand theBoardagree
thatall otherterms, limitations,andconditionscontainedin thisConsentAgreementshall be
unaffected.
ACKNOWLEDGMENTSILIABILITY RELEASE
Dr. DiLucianoacknowledgesthathe hashad anopportunitytoaskquestionsconcerningthe
termsofthisConsentAgreementandthatall questionsaskedhavebeenansweredina
satisfactorymanner.
Anyactioninitiatedby theBoardbasedonallegedviolationsofthisConsentAgreementshall
complywiththeAdministrativeProcedureAct, Chapter 119.,OhioRevisedCode.

July 21,2006. Dr. Dilucianostates that prior tohis 2006 admissionfor treatmentat
Glenbeighhehad no previoustreatmentforchemicaldependency.
Dr. Dilucianostates that since hehadcompleted inpatienttreatmentataBoard-approved
treatmentprovider,had violatednoother provisionof the Ohio Medical PracticeAct,
and had adheredto otherstatutoryrequirementsfor impairedpractitioners,atthetime of
his treatmentin2006 and for as long ashe maintainedsobrietyhequalifiedfor
exemptionfrom requireddisclosuretothe Board.
Dr.Dilucianoadmitsthat hemaintainedsobrietyuntil approximatelyJune 2010,when
heagain began consumingalcohol due towork-relatedand family-related stressors, and
that such consumptionofalcohol constitutesarelapse. Dr. Dilucianoadmitsthat onor
about October20,2010,hereported hisrelapse tothe Board, and that onorabout
October21,2010,he enteredtreatmentforalcohol dependenceatGlenbeigh, where he
remainstodate. Dr. Dilucianostates that his onlydrug ofchoiceisalcohol and
specificallydenies inappropriateuseofany other chemicalsubstance.
AGREED CONDITIONS
Wherefore,inconsiderationof the foregoingand mutual promiseshereinaftersetforth,and inlieu
of anyformal proceedingsatthis time,Dr. Dilucianoknowinglyand voluntarilyagrees with the
Board tothe followingterms, conditionsand limitations:
SUSPENSION OF CERTIFICATE
1. The certificateofDr. Dilucianotopracticemedicineand surgery inthe State ofOhio
shall beSUSPENDEDfor anindefiniteperiod oftime, but not less than ninety days.
Obey allLaws
2. Dr.Dilucianoshall obey all federal ,state, and local laws.
Sobriety
3. Dr. Dilucianoshall abstaincompletelyfrom thepersonaluseor personal possessionof
drugs ,exceptthose prescribed,dispensedoradministered tohim byanotherso
authorized by law who has full knowledgeof Dr. Diluciano's historyof chemical
dependency. Further,inthe eventthat Dr. Dilucianoisso prescribed,dispensedor
administeredany controlledsubstance,carisoprodol,or tramadol ,Dr. Dilucianoshall
notify the Board inwritingwithinseven days,providingthe Board with the identityof
theprescriber;the nameofthe drug Dr.Dilucianoreceived;the medical purpose for
whichhe receivedsaid drug;the date such drug was initiallyreceived;and thedosage,
amount, numberofrefills, and directionsfor use. Further, within thirty days ofthedate
said drug isso prescribed,dispensed,oradministeredto him,Dr. Dilucianoshall provide

theBoard with either acopyofthewrittenprescriptionorotherwritten verification from

4. Dr.Diluciano shall abstain completely fromtheuseofalcohol.
Absences fromOhio
5. Dr.Diluciano shall obtainpermissionfromtheBoard fordepartures orabsencesfrom
Ohio. Suchperiods ofabsence shallnotreducetheprobationaryterm, unlessotherwise
determinedbymotion oftheBoardforabsences ofthreemonths orlonger,orbythe
Secretaryorthe SupervisingMember oftheBoardforabsences oflessthanthree
months, ininstanceswheretheBoardcanbeassuredthatprobationarymonitoring is
otherwise beingperformed. Further,theSecretaryandSupervisingMember oftheBoard
shallhavethediscretiontograntawaiverofpartorallofthemonitoringtermssetforth
inthisConsentAgreementforoccasionalperiods ofabsence offourteendaysorless. In
theeventthat Dr.Diluciano resides and/orisemployedatalocation thatiswithinfifty
miles ofthegeographicborder ofOhioandanyofitscontiguous states, Dr.Diluciano
maytravel betweenOhioandthatcontiguous statewithoutseekingpriorapproval ofthe
SecretaryorSupervisingMember providedthatDr.Diluciano isabletootherwise
maintain fullcompliancewith allotherterms, conditions andlimitationssetforthinthis
ConsentAgreement.
Releases; Quarterly DeclarationsandAppearances
6. Dr.Diluciano shallprovide authorization, through appropriate written consent forms,for
disclosure ofevaluativereports, summaries, andrecords, ofwhatever nature,byanyand
allparties that providetreatmentorevaluation forDr.Diluciano'schemical dependency
orrelated conditions,orforpurposes ofcomplying withthis ConsentAgreement,
whether such treatmentorevaluation occurred beforeoraftertheeffectivedateofthis
ConsentAgreement. Totheextentpermitted bylaw,theabove-mentionedevaluative
reports, summaries,andrecords areconsidered medical records forpurposes ofSection
149.43oftheOhioRevised Codeandareconfidential pursuanttostatute. Dr.Diluciano
furtheragrees toprovide theBoardwrittenconsentpermittinganytreatment provider
fromwhom heobtains treatmenttonotifytheBoardintheevent hefailstoagreetoor
comply with anytreatmentcontract oraftercarecontract. Failure toprovide such
consent, orrevocationofsuchconsent, shallconstitute aviolation ofthisConsent
Agreement.
7. Dr.Diluciano shall submit quarterlydeclarations underpenalty ofBoarddisciplinary
action and/or criminal prosecution,statingwhether therehasbeencompliance withall
theconditionsofthis ConsentAgreement. Thefirstquarterly declarationmustbe
received intheBoard'soffices onthefirstdayofthethirdmonth following themonthin
whichthis ConsentAgreementbecomes effective, orasotherwise requested bythe

Board. Subsequentquarterlydeclarationsmust bereceived inthe Board'soffices onor
before the first day ofevery third month.
8. Dr. Dilucianoshall appearinperson foran interviewbefore the full Board or its
designated representativeduringthe third month followingthe effectivedate ofthis
ConsentAgreement. Subsequentpersonal appearancesmust occurevery three months
thereafter,and/oras otherwiserequested bythe Board. Ifanappearanceismissed oris
rescheduledfor anyreason, ensuingappearancesshall bescheduledbased onthe
appearancedate as originallyscheduled.
Drug & Alcohol Screens;Drug TestingFacility and CollectionSite
9. Dr. Dilucianoshall submittorandom urine screeningsfordrugs and alcohol atleast four
timespermonth,oras otherwisedirectedbythe Board. Dr. Dilucianoshall ensurethat
allscreeningreportsare forwarded directly tothe Board on aquarterlybasis. The drug
testingpanel utilized must beacceptabletothe Secretaryofthe Board, and shall include
Dr. Diluciano'sdrug(s) of choice.
Dr. Diluciano shall abstainfrom the useofanysubstanceand the consumptionofpoppy
seeds orany otherfood or liquid that mayproducealow level positiveresult ina
toxicologyscreen. Dr. Dilucianoacknowledgesthat heunderstandsthat the
consumptionor useofsuch substances,includingbutnot limitedto substancessuchas

to bedifferentiatedfrom intentional ingestion,and thereforesuch consumptionoruseis
prohibitedunderthis ConsentAgreement.
All such urine screeningsfordrugs andalcohol shall beconductedthroughaBoard-
approveddrug testingfacility and collectionsite pursuanttothe global contractbetween
said facility and the Board, that providesforthe Board to maintainultimatecontrol over
theurine screeningprocessand topreservethe confidentialityofall positivescreening
results inaccordancewith Section4731.22(F)(5),Ohio Revised Code, and thescreening
processshall requireadaily call-inprocedure. Further,intheeventthat the Board
exercisesitsdiscretion,as providedinParagraph 10below, toapproveurine screenings
tobeconductedatan alternativedrug testingfacility and/orcollectionsite ora
supervisingphysician,suchapprovalshall beexpresslycontingentupon the Board
retainingultimatecontrolover the urine screeningprocessinamannerthat preservesthe
aforementionedconfidentialityofallpositivescreeningresults.
Dr.Dilucianoshall submit,athisexpenseand on the dayselected,urine specimensfor
drug and/oralcoholanalysis. All specimenssubmittedbyDr. Dilucianoshall be
negative,exceptfor those substancesprescribed,administered,ordispensedtohim in
conformancewith theterms,conditionsand limitationsset forth inthis Consent
Agreement. Refusalto submitsuch specimen,orfailuretosubmitsuch specimenonthe

dayheisselected orinsuch manner astheBoard mayrequest,shall constitutea
violationofthis ConsentAgreement.
Further, withinthirty daysoftheeffectivedateofthis ConsentAgreement,Dr.Diluciano
shall enter into the necessaryfinancial and/or contractualarrangementswith theBoard-
approved drug testingfacility and/orcollectionsite inorder tofacilitate the urine
screeningprocessinthe manner required bythisConsentAgreement. Further, Dr.
Diluciano shall promptlyprovidetotheBoard writtendocumentationofcompletionof
such arrangements,includingacopyofanycontractentered into betweenDr.Diluciano
andthe Board-approveddrug testing facilityand/orcollectionsite. Dr.Diluciano's
failure to timelycompletesuch arrangements,orfailure to timely providewritten
documentationto the Board ofcompletionofsucharrangements,shall constitutea
violationofthis ConsentAgreement.
Dr.Dilucianoshall ensurethatthe urinescreeningprocess performedthrough theBoard-
approved drug testingfacility and/orcollectionsite requiresadailycall-in procedure;
thatthe urine specimensareobtainedonarandom basis;and that thegivingof the
specimeniswitnessed byareliable person. Inaddition, Dr.DilucianoandtheBoard-
approved drug testingfacility andcollectionsiteshall assure that appropriatecontrol
over thespecimenismaintainedand shall immediatelyinform the Board ofanypositive
screeningresults.
Dr.Dilucianoshall ensure thattheBoard-approveddrugtestingfacility and/or collection
siteprovidesquarterlyreports totheBoard, inaformat acceptabletotheBoard,
verifyingwhetherall urine screens have beenconductedincompliancewith thisConsent
Agreement,and whetherallurine screens have beennegative.
Intheeventthat the Board-approveddrugtestingfacility and/orcollectionsitebecomes
unable or unwillingtoserve asrequired bythis ConsentAgreement,Dr.Diluciano must
immediatelynotify theBoard inwriting, and make arrangementsacceptabletothe
Board, pursuantto Paragraph 10below, assoon aspracticable. Dr.Diluciano shall
further ensure that the Board-approveddrugtesting facility and/orcollectionsite also
notifies the Board directlyofits inabilitytocontinuetoserve and thereasons therefore.
Dr.Dilucianoacknowledgesthatthe Board expresslyreservestherighttowithdrawits
approvalofany drugtestingfacility and/orcollectionsite intheeventthatthe Secretary
and SupervisingMemberoftheBoard determinethat the drug testing facilityand/or
collectionsite has demonstratedalackofcooperationinprovidinginformationtothe
Board orforanyotherreason.
10. Dr.Dilucianoand the Board agreethat itisthe intent ofthis ConsentAgreementthatDr.
Dilucianoshall submithisurine specimenstotheBoard-approved drugtesting facility
andcollectionsite chosenbythe Board. However,intheeventthat utilizingsaidBoard-
approved drug testingfacility and/or collectionsite createsanextraordinaryhardship

upon Dr.Diluciano,asdeterminedinthesolediscretionofthe Board, then subjecttothe
following requirements, theBoard mayapprove analternatedrugtestingfacilityand/or
collectionsite, orasupervisingphysician, tofacilitate the urine screeningprocessforDr.
Diluciano:
a. Withinthirty daysofthe date upon which Dr.DilucianoisnotifiedoftheBoard's
determinationthat utilizingtheBoard-approveddrugtestingfacility and/or
collectionsite constitutesanextraordinaryhardshipupon Dr.Diluciano,heshall
submittothe Board inwriting foritspriorapproval the identity ofeither an
alternatedrug testingfacility andcollectionsite, orthe name ofaproposed
supervisingphysician,towhom Dr.Dilucianoshall submitthe required urine
specimens. Inapprovingafacility, entity, oranindividual toserve inthiscapacity,
the Board will give preferencetoafacility located near Dr.Diluciano'sresidence
oremploymentlocation, ortoaphysicianwho practicesinthe same localeasDr.
Diluciano. Dr.Dilucianoshall ensure that the urine screeningprocessperformed
throughthealternatedrug testing facility and/or collectionsite, orthrough the
supervisingphysician,requires adailycall-in procedure;that the urine specimens
areobtainedonarandom basis;andthat thegiving ofthe specimeniswitnessed by
areliableperson. Inaddition,Dr.Dilucianoacknowledgesthat thealternate drug
testingfacility and collectionsite, orthe supervisingphysician, shall assure that
appropriatecontrolover thespecimenismaintainedand shall immediatelyinform
the Board ofanypositivescreeningresults.
b. Dr.Dilucianoshall ensure thatthealternate drug testingfacility and/or collection
site,orthe supervisingphysician,providesquarterlyreports tothe Board, ina
format acceptabletothe Board, verifying whetherall urine screenshave been
conducted incompliancewith thisConsentAgreement,andwhetherallurine
screenshave been negative.
c. Inthe eventthat thedesignatedalternate drug testingfacility and/orcollectionsite,
orthe supervisingphysician,becomes unable orunwillingtososerve,Dr.
Dilucianomust immediatelynotifytheBoard inwriting. Dr.Dilucianoshall
further ensure that the previouslydesignatedalternatedrug testing facilityand
collectionsite, orthe supervisingphysician,also notifiestheBoard directly ofthe
inabilitytocontinuetoserve andthereasons therefore. Further, inordertoensure
that there will beno interruptioninhis urine screeningprocess,upon thepreviously
approvedalternatedrugtesting facility,collectionsite, orsupervisingphysician
becomingunable to serve, Dr.Dilucianoshall immediatelycommenceurine
screeningatthe Board-approveddrugtesting facility and collectionsitechosen by
the Board, until such time, ifany,thatthe Board approvesasubsequentalternate
drug testingfacility, collectionsite,orsupervisingphysician,ifrequested byDr.

d. The Board expresslyreserves therighttodisapproveanyentity orfacility proposed
toserve asDr. Diluciano's designatedalternatedrug testingfacility and/or
collectionsite, oranyperson proposed toserve ashis supervisingphysician,orto
withdrawapprovalofanyentity, facilityor person previouslyapprovedtososerve
intheeventthat the Secretary andSupervisingMemberoftheBoard determinethat
any such entity, facility orpersonhasdemonstratedalackofcooperationin
providinginformationtotheBoard orforanyother reason.
11. Allscreeningreports required under this ConsentAgreementfrom theBoard-approved
drug testing facility and/orcollectionsite,orfrom thealternatedrugtestingfacility
and/or collectionsite or supervisingphysician, must bereceived intheBoard's offices
no later than thedue date forDr.Diluciano'squarterly declaration. It isDr.Diluciano's
responsibilitytoensure that reports aretimely submitted.
12. The Board retainsthe right torequire, andDr.Dilucianoagrees to submit,blood, urine,
breath, salivaand/orhair specimensforscreeningfordrugs and alcohol,foranalysis of
therapeuticlevels ofmedicationsthat maybeprescribed forDr.Diluciano,orforany
other purpose,atDr. Diluciano's expenseupon theBoard's request and without prior
notice . Dr. Diluciano's refusal to submit a specimen upon request of the Board shall
result inaminimumofone yearofactual license suspension. Further,thecollectionof
such specimensshall bewitnessedbyarepresentativeofthe Board, oranotherperson
acceptableto the SecretaryorSupervisingMemberoftheBoard.
RehabilitationProgram
13. Within thirty days of the effective date of this Consent Agreement, Dr. Diluciano shall
undertakeand maintainparticipationinanalcohol anddrug rehabilitationprogram, such
asA.A.,N.A., c.A.,orCaduceus,nolessthan three times per week. Substitutionofany
other specificprogrammust receive priorBoard approval.
Dr.Dilucianoshall submitacceptabledocumentaryevidenceofcontinuingcompliance
with this program,includingsubmissiontotheBoard ofmeetingattendancelogs, which
must bereceived intheBoard'soffices no laterthan the duedate forDr.Diluciano's
quarterlydeclarations.
14. Immediatelyupon completionofanyrequired treatmentforchemicaldependency, Dr.
Dilucianoshall enterintoanaftercarecontractwith aBoard-approvedtreatmentprovider
and shall maintaincontinuedcompliancewith theterms ofsaidaftercarecontract,
providedthat, where theterms oftheaftercare contractconflictwith theterms ofthis
ConsentAgreement,theterms ofthis ConsentAgreementshall control.

CONDITIONS FOR REINSTATEMENT
15. The Board shall not considerreinstatementorrestorationofDr.Diluciano's certificate to
practice medicineand surgery until allofthefollowingconditionsare met:
a. Dr.Dilucianoshall submitanapplicationforreinstatementorrestoration, as
appropriate,accompaniedbyappropriatefees, ifany.
b. Dr.Dilucianoshall demonstratetothe satisfactionoftheBoard thathecanresume
practice incompliancewith acceptableandprevailingstandardsofcare under the
provisionsofhiscertificate. Suchdemonstrationshall includebutshall not be
limited to the following:
1. Certificationfrom atreatmentproviderapproved under Section 4731.25 of
the RevisedCode that Dr.Dilucianohas successfullycompletedanyrequired
inpatienttreatment,includingatleasttwenty-eightdaysofinpatientor
residentialtreatmentforchemicalabuse/dependence,asset forth inRules
4731-16-02and4731-16-08,OhioAdministrativeCode, completed
consecutively.
11. Evidenceofcontinuingfullcompliancewith,or successfulcompletionof,a
post-dischargeaftercarecontract with atreatmentproviderapproved under
Section 4731 .25of the Revised Code. Such evidence shall include, but not
belimitedto,acopyofthesigned aftercarecontract. The aftercarecontract
must complywith rule4731-16-10oftheAdministrativeCode.
111. Evidenceofcontinuingfullcompliancewith this ConsentAgreement.
IV. Two writtenreports indicatingthat Dr.Diluciano's abilitytopractice has
been assessed and that hehasbeen found capableofpracticingaccording to
acceptableandprevailingstandardsofcare. The reports shall bemade by
physiciansknowledgeableintheareaofaddictionologyandwhoareeither
affiliatedwith acurrentBoard-approvedtreatmentproviderorotherwisehave
been approved inadvance bytheBoard toprovideanassessmentofDr.
Diluciano. Further,thetwo aforementionedphysicians shall notbeaffiliated
with the same treatmentproviderormedical group practice. Prior tothe
assessments,Dr.Dilucianoshallprovide theevaluatorswith copies of patient
recordsfrom anyevaluationsand/or treatmentthat hehas received,anda
copy ofthis ConsentAgreement. The reports from theevaluatorsshall
includeany recommendations for treatment,monitoring, orsupervisionof Dr.
Diluciano,and anyconditions,restrictions,or limitationsthat should be
imposedonDr.Diluciano'spractice. The reports shall also describe thebasis
forthe evaluator'sdeterminations.

All reports required pursuant tothis paragraphshall bebased upon
examinationsoccurringwithin thethree monthsimmediatelypreceding any
applicationfor reinstatement. Further, atthediscretionofthe Secretary and
SupervisingMemberofthe Board, the Board mayrequestanupdated
assessmentand report ifthe Secretary and SupervisingMemberdetermine
that such updated assessmentand report iswarranted foranyreason.
v. Inthe eventthat the Board initiates future formal proceedingsagainst Dr.
Diluciano,includingbut not limited toissuanceofaNoticeofOpportunity
forHearing,Dr.Dilucianoshallbe ineligible forreinstatementuntilsuch
proceedingsarefullyresolved byratificationbythe Board ofasubsequent
ConsentAgreementorissuance bythe Board ofafinal Board Order.
c. Dr.Dilucianoshall enter intoawritten consentagreementincludingprobationary
terms, conditionsand limitationsasdetermined bythe Board within 180daysof
the date upon which alltheabove-specifiedconditionsforreinstatementor
restorationhave been completedor,iftheBoard andDr.Dilucianoareunable to
agree onthe terms ofawritten Consent Agreement,then Dr.Dilucianofurther
agrees toabide byanyterms,conditionsand limitations imposed byBoard Order
after ahearingconductedpursuanttoChapter 119.ofthe Ohio Revised Code. The
Board shall provide notice toDr.Dilucianothat said hearing has beenscheduled,
advisingDr. Dilucianoofhishearing rights, and statingthe date, time, and location
ofthe hearingatwhich the Board willpresentitsevidence,after which theBoard
will make adeterminationofthematter byBoard Order.
Further,upon reinstatementofDr.Diluciano' scertificatetopractice medicine and
surgery inthis state, the Board shallrequire continuedmonitoringwhich shall
include, but not belimited to,compliancewith thewrittenconsentagreement
enteredinto before reinstatementorwith conditionsimposed byBoard Orderafter
ahearingconducted pursuanttoChapter 119.oftheRevised Code. Moreover,
upon terminationoftheconsentagreementorBoard Order,Dr.Dilucianoshall
submitto the Board foratleasttwoyearsannual progress reports made under
penaltyofBoard disciplinaryaction orcriminal prosecutionstating whether Dr.
Dilucianohasmaintainedsobriety.
16. Inthe event that Dr. Dilucianohasnot beenengaged intheactive practiceofmedicine
and surgery for a period in excessof two years prior to application for reinstatement, the
Board mayexercise itsdiscretionunder Section 4731.222,Ohio Revised Code,to
require additional evidenceof Dr. Diluciano's fitness to resume practice .
REQUIREDREPORTINGBY LICENSEE
17. Within thirty days oftheeffectivedate ofthis ConsentAgreement,Dr.Di1ucianoshall
provideacopy ofthis ConsentAgreementtoallemployersorentitieswith which heis

under contracttoprovidehealth care services(includingbutnot limitedtothird party
payors) or isreceivingtraining; and the ChiefofStaffateach hospital where hehas
privilegesorappointments. Further, Dr.Dilucianoshall promptlyprovideacopy ofthis
ConsentAgreementto allemployersorentities with whichhecontractstoprovidehealth
care services,orappliesfororreceives training,and the ChiefofStaffateach hospital
where heapplies foror obtains privilegesorappointments. Inthe eventthat Dr.
Dilucianoprovidesany health care servicesorhealth care directionormedical oversight
toanyemergencymedicalservicesorganizationoremergencymedical services provider,
within thirty days ofthe effectivedate ofthis ConsentAgreementDr. Diluciano shall
provideacopy ofthis ConsentAgreementtothe Ohio DepartmentofPublicSafety,
Divisionof EmergencyMedical Services. Further, Dr. Dilucianoshall providethe Board
with one ofthe followingdocumentsasproofofeach required notificationwithin thirty
days ofthe date ofeach such notification: (1)the return receiptofcertified mail within
thirty days ofreceivingthat returnreceipt, (2)anacknowledgementofdeliverybearing
the original ink signatureofthe persontowhomacopy ofthe ConsentAgreementwas
hand delivered,(3)the originalfacsimile-generated reportconfirmingsuccessful
transmissionofacopy ofthe ConsentAgreementtothe personorentity towhom acopy
ofthe ConsentAgreementwas faxed, or(4)anoriginalcomputer-generatedprintoutof
electronicmail communicationdocumentingtheemail transmissionofacopy ofthe
ConsentAgreementtothe personorentity towhom acopy ofthe ConsentAgreement
was emailed.
18. Withinthirty days ofthe effectivedate ofthis ConsentAgreement,Dr.Dilucianoshall
provideacopy ofthis ConsentAgreementtotheproperlicensingauthorityofanystate
orjurisdictioninwhichhecurrentlyholds anyprofessional license,as wellas anyfederal
agency orentity, including butnot limitedtotheDrug EnforcementAgency,through
whichhe currentlyholdsany license orcertificate. Dr. Dilucianofurther agrees to
provideacopy ofthis ConsentAgreementattime ofapplicationtothe properlicensing
authorityofany state inwhichheapplies for anyprofessional licenseorreinstatementof
anyprofessional license. Further, Dr.Diluciano shall providethe Board with oneofthe
followingdocumentsas proofofeach required notificationwithinthirty daysofthedate
ofeach such notification: (1) thereturn receipt of certifiedmail within thirty daysof
receivingthat returnreceipt,(2) anacknowledgementofdeliverybearing the original ink
signatureofthe persontowhom acopy ofthe ConsentAgreementwas hand delivered,
(3)the originalfacsimile-generated report confirmingsuccessfultransmissionofacopy
ofthe ConsentAgreementtothe person orentity to whom acopy ofthe Consent
Agreementwas faxed,or(4)anoriginal computer-generatedprintoutofelectronicmail
communicationdocumentingtheemail transmissionofacopy ofthe ConsentAgreement
tothe personorentityto whom acopy of the ConsentAgreementwas emailed.
19. Dr. Dilucianoshall promptlyprovideacopy ofthis ConsentAgreementtoallpersons
and entitiesthat provideDr. Dilucianochemicaldependencytreatmentormonitoring.
Further,Dr. Dilucianoshall providethe Board with one ofthe followingdocumentsas
proofofeach required notificationwithin thirty daysofthe date ofeach such

notification: (l)the returnreceipt ofcertifiedmail withinthirty days ofreceivingthat
return receipt,(2) an acknowledgementof deliverybearingthe original inksignatureof
thepersontowhomacopy of the ConsentAgreementwas hand delivered,(3)the
original facsimile-generated report confirmingsuccessfultransmissionofacopyofthe
ConsentAgreementto the personorentity towhomacopy ofthe ConsentAgreement
was faxed,or (4) anoriginalcomputer-generatedprintoutof electronicmail
communicationdocumentingthe email transmissionofacopy ofthe ConsentAgreement
tothe personorentity towhom acopy ofthe ConsentAgreementwas emailed.
20. Dr. Dilucianoshall notify the Board inwritingofanychangeofprincipalpractice
addressor residenceaddresswithinthirty daysofsuch change.
DURATIONIMODIFICATION OF TERMS
The above-described terms, conditionsand limitationsmay beamendedorterminated inwritingat
anytime upon theagreementofboth parties. Inthe event that the Board initiatesfuture formal
proceedings against Dr. Diluciano, including but not limited to issuanceof a Noticeof Opportunity
for Hearing,this ConsentAgreementshall continueinfull force and effect until such time that itis
supersededbyratificationbythe Board ofasubsequentConsentAgreementor issuancebythe
Board ofafinal Board Order.
Inthe event that anyterm,limitation,orconditioncontained inthis ConsentAgreementis
determinedtobe invalid byacourtofcompetentjurisdiction,Dr.Dilucianoand the Board agree
thatallotherterms ,limitations,and conditionscontained inthis ConsentAgreementshall be
unaffected.
FAILURE TO COMPLY
If,inthediscretionofthe Secretaryand SupervisingMemberofthe Board,Dr.Dilucianoappears to
have violated orbreachedany term orconditionofthis ConsentAgreement,the Board reservesthe
right to instituteformal disciplinaryproceedingsforanyandallpossibleviolationsorbreaches,
includingbutnot limitedto,allegedviolationsofthe laws ofOhio occurringbeforethe effective
date ofthis ConsentAgreement.
ACKNOWLEDGMENTSILIABILITY RELEASE
Dr. Dilucianoacknowledgesthat hehas hadanopportunitytoask questionsconcerningtheterms of
this ConsentAgreementand that allquestionsasked have been answered inasatisfactorymanner.
Anyaction initiated bythe Boardbased onalleged violationsofthis ConsentAgreementshall
complywith the AdministrativeProcedureAct, Chapter 119.,Ohio Revised Code.

Dr. Dilucianoherebyreleasesthe Board,its members,employees,agents,officers and
representati vesjointlyand severallyfrom anyand all liabilityarisingfrom the within matter.
Thi sConsentAgreementshall beconsideredapublicrecord as that term is used in Section 149.43,
Ohio Revised Code. Further,this informationmaybereported toappropriateorganizations,data
banksand governmental bodies. Dr. Dilucianoacknowledgesthat his social securitynumberwill be
used ifthis informationisso reported and agrees to provide his socialsecuritynumbertothe Board
for such purposes.
EFFECTIVE DATE
It isexpresslyunderstood that this ConsentAgreementis subjectto ratificationbythe Board prior to
signatureby the Secretaryand SupervisingMemberand shall becomeeffectiveupon the lastdate of
signaturebelow.
