Te respondent, a native and citizen of Mexico, appeals te Jauary 11, 2012, decision of the
Immgation Judge fnding h removable ad ganting hs request fr volunta depae. The
Depament of Homelad Securty opposes the appeal. We review fndings of fct fr clea eror,
but questions oflaw, discretion, ad judgent, and al other issues in appeals, de novo. 8 C.F.R.
1003 .1 ( d)(3)(i). The record will be remanded fr fher proceedigs.
Durng the pendency of his appeal,2 the respondent fled a motion to reopen to apply fr
adjustent of status, accompaied by evidence that he claims was not available durng his
origal proceedings (espondent's Motion to Reopen at 5). Applicable regulations prvide that
a motion to reopen "shall state te new fcts that will be proven at a heaing to be held if the
motion is gated ad shall be supported by afdavits or other evidentiay material." 8 C.F.R.

The respondent's agument on appeal as stated i his Notice of Appeal (NOA) is that his
attorey was not allowed to be present and was not notifed of the heag despite having fe a
notice of appearance. However, a review of the record ad tascript of proceedigs does not
refect that a notice of appearace was fled befre the Immigration Court. Althoug the
respondent's cuent counsel, Alaa M. Gars, submited with the NOA a copy of a Notice of
Enty of Appeaace as a Attorey or Representative Befre te Immgation Court (For
EOI-28), siged December 21, 2011, tere is no indication tat the fr was fled with te
Imigation Court. Futher, the transcript reveals that the respondent stated that he had retaned
a attorey naed "Manuel Corales," who filed to appea fr hs hearng (Tr. at 5).

requirements fr a motion to remand are essentially the same as the requirements fr a motion to
reopen); Matter of Coelho, 20 l&N Dec. 464, 471 (BIA 1992); 8 C.F.R. 1003.2(c)(4). In
addition, the regulations provide that a motion to reopen "shall not be granted unless it appears to
the Board that evidence sought to be ofered is material and was not available and could not have
been discovered or presented at the frmer hearing." Id.
Section 245(a) of the Act provides that the Attorey General may, in his discretion, adjust the
status of an alien to that of a lawfl permanent resident if the alien ( 1) makes an application fr
such adjustment, (2) is eligible to receive an immigrant visa and is admissible to the
United States fr peraent residence, and (3) has immediately available to him a immigant
visa at the time that his application is fled. In conjunction with his motion to reopen, which we
construe a motion to remand, the respondent has submitted twenty-two documents that predate
te Jauary 11, 2012, decision of the Immigration Judge. The respondent has not provided an
explanation fr why this infration was not provided ealier. Furher, he has not established
prima fcie eligibility fr adjustment of status, nor has he submited an application fr relief.
The respondent has not explained how the evidence he provided may have changed the outcome
of the heang. Thus, this new evidence does not warrant a remand fr frther proceedings. See
Matter of Rajah, supra.
However, review of the tanscript of proceedings indicates that the Immigration Judge did
not advise the respondent, who was not represented below, of his potential eligibility fr relief
fr cancellation of removal under section 240A(b) of the Immigation and Nationality Act,
8 U.S.C. 1229b(b), in accordance with 8 C.F.R. 1240.l l(a)(2) (Tr. at 8-10). Under these
circumstces, we fnd it appropriate to remad this matter. The paries on remand should be
allowed to provide frher evidence, including additional testimony, regarding the respondent's
eligibility fr cacellation of removal. The respondent also should be aforded a opporunity to
apply fr any oter frm of relief fom removal fr which he may curently be eligible.
Accordingly, the fllowing orders will be entered.
ORDER: Te record wll be remanded.
FURTHER ORDER: The record is remanded fr fher proceedings consistent with the
fregoing opinion ad fr the entry of a new decision.
