Freeware License Agreement This Freeware License Agreement (this Agreement) sets forth the terms and conditions

pursuant to which SPSS Inc., a e!aware corporation (SPSS), is offering "ou (hereinafter, "ou or the user) the right to use the Software Pac#age (defined in Section $). This Agreement is a %inding !ega! contract that imposes o%!igations on the user with regard to the Software Pac#age. &" using the Software Pac#age, "ou agree to %e %ound %" the terms of this Agreement. If "ou do not accept these terms, "ou shou!d stop using the Software Pac#age. $. Software Pac#age. Freeware License (a) Su%(ect to the terms of this Agreement, SPSS here%" grants to "ou a non*e+c!usi,e, wor!dwide, transfera%!e !icense to use, cop", modif" and'or distri%ute the Software Pac#age, free of charge (the Freeware License). (%) Pursuant to the Freeware License, "ou ma"- (i) use the Software Pac#age on an" computer in "our possession, (ii) modif", adapt or trans!ate the Software Pac#age so as to create or prepare a deri,ati,e wor# (a eri,ati,e .or#), (iii) ma#e copies of the Software Pac#age/ and (i,) distri%ute the Software Pac#age to an" third part" if such third part" e+press!" agrees to %e %ound %" the terms of this Agreement and the Freeware License set forth herein. (c) The Freeware License is su%(ect to the fo!!owing restrictions-

(i) SPSS sha!! ha,e no o%!igation to pro,ide maintenance, support, upgrades or new re!eases with regard to the Software Pac#age to "ou or an" third part". (ii) Prior to distri%ution to an" third part" of the Software Pac#age such third part" must agree to %e %ound %" the terms of this Agreement and the Freeware License set forth herein and a cop" of this Agreement must %e inc!uded with such distri%ution together with the same cop"right and other proprietar" notices pertaining to the Software Pac#age that appear in the Software Pac#age. If "ou distri%ute the Software Pac#age from the Internet or a simi!ar on*!ine source, "ou must inc!ude the 0SPSS Inc. cop"right notice for the Software Pac#age with an" on*!ine distri%ution thereof and on an" media "ou distri%ute that inc!udes the Software Pac#age. (iii) 1ou ma" not use the Software Pac#age to engage in, or a!!ow others to engage in, an" i!!ega! acti,it" or an" other acti,it" that ,io!ates the rights of an" third part". (i,) 2othing in this Agreement or the Freeware License set forth herein sha!! authori3e an"one to modif" an" portion of this Agreement or the Freeware License set forth herein/ nor is an" one authori3ed to modif" the Software Pac#age in a manner that wou!d ha,e the effect of modif"ing this Agreement or the Freeware License set forth herein. This Agreement represents the entire agreement %etween the parties with respect to the su%(ect matter hereof and supersedes and rep!aces a!! prior or contemporaneous understandings or agreements, written or ora!, with regard to such su%(ect matter.
