INTRODUCCIN

5. LA MARCA CCC
La marca CCC est regulada en el Announcement No I [2001] by the Certification and Accreditation Administration of the People's Republic of China (CNCA), (Anexo 2.2).

10. TRMINOS CONFUSOS EN LAS SOLICITUDES

5. ANEXO 5 ~ BACKGROUND PAPER ON THE CHINESE COMPULSORY CERTIFICATION (CCC) POLICY FOR IT SECURITY PRODUCTS ~
Chinese government plans to make the CCC scheme operational on 1 May 2010. Manufacturers will be forced to undergo additional product evaluation and certification in order to offer products in China that conform with a special Chinese standard. The well accepted international standard is the Certification standard ISO 15408, known as the Common Criteria (CC), and the Common Criteria Recognition Agreement (CCRA) is based on it. According to CCC, manufacturers will also be forced to disclose intellectual property rights for commercial off-the-shelf products. According to the Chinese government, CCC regulation will be relevant for IT security products for the field of government procurement only. But in China this term is understood in a much broader sense than in Europe. Many concerns about this significant barrier to trade have been raised in the framework of the WTO and the Market Access Strategy of the European Union, as well as by governments and industry. Besides the issue of international trade, the certification of IT security products in China also affects questions of national security in exporting EU Member States. We would therefore like to invite the European Commission to approach the Chinese Government as soon as possible at political level, and to do so in coordination with the governments of the United States, Canada, Japan and Korea, if appropriate, which have similar interests: There is no need for the Chinese government to establish a proprietary certification scheme in addition to the internationally well accepted Common Criteria standard. Instead of its own standard, China should apply the Common Criteria standard. To facilitate the export of its IT products on the world market, it would be an incentive for the Chinese government to become a member of the Common Criteria Recognition Agreement.
