If the application of the proper penalties for violation of section 6 of Rule 005-01, sub-sections (a) and (b), where any of the elements of section 7 of Rule 005-01 are present, the higher penalty shall be imposed. Fictitious business transactions; Falsifications of Company or Company Client's records/data/documents/invoices/reports; fictitious issuance's of billings/office receipt; misappropriation or embezzlement of Company funds; withholding of funds due to the Company; kiting of collections or of Company funds; unauthorized retrieval of materials by converting the same to cash for personal use; unremitted or short remittance of collections; non-issuance or misissuance of invoices and/ or receipts as well as commercial documents to customers; forgery; misuse, abuse or defalcation of funds for market development program and/ or company funds; conspiring or conniving with, or directing others to commit any of the foregoing, other anomalies similar or analogous to the foregoing whether committed within a calendar year or not; analogous cases: a. b. For violation of section 9 of Rule 005-01, where the damage or loss to the Company is incurred: Each transaction or the total transactions where the amount involved is P 500.00 or less 15 days suspension without pay

In the application of the proper penalties for violations of section 9 of Rule 005-01, sub-section (a) thereof, where any of the elements of sub-section (b) thereof is / are present in each case, the heavier penalty shall be imposed. Sec.11. (a) Other acts of negligence or inefficiency in the performance of duties or in the care, custody and for use of Company Client's or Company property, funds and / or equipment; or blatant disregard of or deviation from established control and other policies and procedures including but not limited to the care, custody and/or use of Company Client's or Company property, funds or equipment; similar or analogous acts or omissions, whether committed within a calendar year or not; analogous cases: Each act of omission constitutes one offense: First offense Second offense Third offense Fourth offense * 6 days suspension without pay * 15 days suspension without pay * 30 days suspension without pay * DISCHARGE

(b) For violation of the provisions of section 11 of Rule 005-01, where damage or loss to the Company or Company Client's is incurred:

If the amount of damage or loss is not ore than P 1,000

10 days suspension without pay

If the amount of damage or loss is more than P 1,000but not more than P 3,000 15 days suspension without pay 23

If the amount of damage or loss is more than P 3,000 but not more than P 5,000 30 days suspension without pay

If the amount of damage or loss is more than P 5,000 DISCHARGE

( c ) In the application of the proper penalties for violation of section 11 of Rule 005-01, sub-section (a) thereof where any of the elements of subsection ( b ) thereof is / are present in each case, the heavier penalty shall be imposed. Sec. 12Negligence in the Performance of Duty causes damages or loss of the Reputation of the Company, whether committed within a calendar year or not; analogous cases: (b) For violation of the provisions of Section 12 of Rule 005-01, which cause damage or lots of the Reputation of the Company, the offender shall be automatically terminated from his work although this is his first offense.
