Chapter 1 Mary Steinhauser was my friend This little guy has been saying that guards at the old B.C. Pen purposefully shot and killed her is since her death in 1975? And, 35 years later it appears there may be some truth to this supposition? And, what did the Government of Canada apparently do they tried to cover this fact up with a sham investigation? Mary Steinhauser was my friend, and she deserved better from her employer the Canada government! In fact, while we were Classification Officers at the BC Pen, she was a reference for Terry Mallenby in becoming a Registered Social Worker [see Appendix 1a, 1b and 2 cited below]. We had also known each other during our undergraduate years, where we collaborated on an undergrad course where we compiled a report on The Epidemiology of Mental Illness- where we did a patient file review at one of the psych hospitals in the area Terry Mallenby believes it was for Psych 496 directed studies its been a long time since then. The BC Pen was a formidable fortress and had been around for a long time. It had had its day by the time Mary Steinhauser became a Classification Officer there. The BC Pen housed some interesting characters in its day, for example, Bill Miner (1847-1913) one of the last train hold-up men.

Chapter 3 Everyone tried to pass Mary Steinhausers death off as an accident Everywhere one looked, Mary Steinhausers death was referred to as an accident: On June 9, 1975 three prisoners at the BC Penitentiary who were about to be returned to solitary confinement took 15 hostages. The standoff with prison officials would last 41 hours and end June 11 with an emergency response team storming the hostage takers. During the raid one of the guards accidentally shot and killed one of the hostages, classification officer Mary Steinhauser, 32. Now June 9th, 1975 holds significance with my family because my father, was also a peace officer/classifications officer at the prison in 1975 and was actually Steinhauser's 'partner' if you could say, they worked together on many incidents. About a month before the incident took place, a prisoner warned my father to transfer out of the prison because something was planned. He warned the warden and others but they did not listen so he did transfer out a few weeks before the incident. If he had stayed, he believes because he is a 'tough cookie' as he says, that he would have been killed or wounded in place of Mary Steinhauser if he had remained in the prison. So that is why the day is important to us. Well a peace officer had been killed. But that still does not excuse the fact of what the prison officials did. At least my father had transfered to another prison after no one listened to him. Now, I think personally, if it hadn't been for that prisoner who had warned my father, he wouldn't be here today and I wouldn't be here today. Yeah, my dad doesn't like to talk about it too much, but after prying it out of him he is okay with talking about it know. I just wonder what would have happened if my dad had stayed. As most inmates carry shanks for their protection, and as the guards didnt seem to appreciate Classification Officers, he often wondered if the guards had purposefully had him go through the tunnel when they would have known full well that a bunch of inmates were coming the other way? The most shocking revelation was the second statement now a former paramedic who was at the scene says she was shot on purpose: The new investigation comes after a former ambulance paramedic made a statement to police last month saying he overheard a guard say, "Kill her, kill her," before the rescue attempt.3 In an exclusive interview with the Sunday Province, High said he is convinced that at least one guard intended to shoot Steinhauser. "There's no question in my mind that Mary Steinhauser was purposefully shot," he said. High's partner was on a mobile telephone requesting backup as High and the guards left the trailer for the hostages' vault. The little guy was aware of this in 1975 that the guns had mixed up, and quite openly stated that this was done on purpose so the one who [purposely] shot Mary Steinhauser could not be identified! Everyone knew that what was wrong with that idiot chief justice John Farris: The guns, all revolvers, were removed from the room and cleaned, making it impossible to say which guard fired the shots that hit Steinhauser and Bruce. Some of the spent cartridges went missing for a week, the commission heard. High does not believe that the man who said "Kill her" was the one who fired the fatal shot. Supreme Court as the author of a flawed forensic report that got basic biology wrong. Staff Sgt. Ross Spenards credibility was shredded during the recent second-degree murder trial of Charlie Rae Lincoln, an aboriginal woman convicted of stabbing to death her own two-year-old. He acknowledged misleading the court and failing to send a letter to the Crown in the case revealing the concerns about the report and his errors. Until now, Spenard testified, no one outside of the RCMP had been told about the doubt cast upon other cases, some of which have been reviewed by other specialists. The officer has been a blood-pattern analyst for five years and giving evidence on the basis of his work as a recognized expert witness. In this case, he claimed to have peer-reviewed a report he actually helped author that was based on the mistaken assumption that if someone was a possible contributor of a DNA profile, or if a person couldnt be excluded as contributing to a DNA profile, then you could say the blood came from that person. Whats wrong with that logic is obvious: Anyone with a white car may be in the pool of suspects for a hit-and-run, but being potentially responsible is not the same as being culpable. Armed with a copy of documents that Spenard thought were destroyed, defence lawyer Matthew Nathanson forced him to make a series of devastating admissions, none thankfully that affected the outcome of the trial. The officer was at pains to try and mask the rewriting and review process that led to the creation of the impugned forensic report on blood spatter and DNA evidence in the brutal child-killing. 70

The document was riddled with so many DNA misinterpretations and errors that the top experts in the field were flown in from Edmonton and Halifax to correct it. Some conclusions were not scientifically sound, they said. Spenard was ordered to submit future reports for review and told to send an explanatory letter to the Crown. But he hid that from the udge until he withered under Nathansons crossexamination. You were not being truthful, right? the lawyer said, confronting the Mountie with a transcript of his earlier testimony. I was splitting hairs, the staff sergeant conceded. Spenard admitted he wrote the report supposedly authored by Sgt. James Gallant. That was an untrue answer that you gave to this ury in this case, right? Nathanson said. Gallant] authored the report, right? And I was in error. That was untrue, was it not? Nathanson insisted. No, it was not untrue, the officer dissembled. I was in error. I was mistaken. You were confused about who had written the report? the lawyer scoffed. The circumstances, yes, said the Mountie. I realized I had written the report. 71

The performance was as bad as any at the Braidwood inquiry into the death of Robert Dziekanski, which has also featured RCMP officers seemingly uncomfortable with the truth. The force has conducted a review of other cases coming before the court in which Gallant was involved. But no review of completed cases in which he gave evidence has been done. Spenard also misled the court during earlier proceedings into believing Gallant was no longer doing blood-spatter work because he was seconded to an RCMP Olympic unit.
