Hazardous materials in cargo tank motor vehicles.

(a) General requirements. (1) No person may offer or accept a hazardous material for transportation in a cargo tank motor vehicle except as authorized by this subchapter. (2) T o or more materials may not be loaded or accepted for transportation in the same cargo tank motor vehicle if! as a result of any mixture of the materials! an unsafe condition ould occur! such as an explosion! fire! excessive increase in pressure or heat! or the release of toxic vapors. (") No person may fill and offer for transportation a specification cargo tank motor vehicle for hich the prescribed periodic retest or reinspection under subpart # of part 1$% of this subchapter is past due until the retest or inspection has been successfully completed. This re&uirement does not apply to a cargo tank supplied by a motor carrier ho is other than the person offering the hazardous material for transportation (see '1$%.(%)(a)(1) of this subchapter)! or to any cargo tank filled prior to the retest or inspection due date. (b) Loading requirements. (1) * hazardous material may not be loaded in a cargo tank if during transportation any part of the tank in contact ith the hazardous material lading ould have a dangerous reaction ith the hazardous material. (2) * cargo tank may not be loaded ith a hazardous material that ill have an adverse effect on the tank+s integrity or, (i) -ay combine chemically ith any residue or contaminants in the tank to produce an explosion! fire! excessive increase in pressure! release of toxic vapors or other unsafe condition. (ii).(iii) /0eserved1 (iv) -ay severely corrode or react ith the tank material at any concentration and temperature that ill exist during transportation. (v) 2s prohibited by '1)".21 or '1)".2( of this subchapter. (") *ir pressure in excess of ambient atmospheric pressure may not be used to load or unload any lading hich may create an air.enriched mixture ithin the flammability range of the lading in the vapor space of the tank. (() To prevent cargo tank rupture in a loading or unloading accident! the loading or unloading rate used must be less than or e&ual to that indicated on the cargo tank specification plate! except as specified in '1)"."1$(b)(3). 2f no loading or unloading rate is marked on the specification plate! the loading or unloading rate and pressure used must be limited such that the pressure in the tank may not exceed 1"%4 of the -*56. (c) Maximum Lading Pressure. (1) 6rior to loading and offering a cargo tank motor vehicle for transportation ith material that re&uires the use of a specification cargo tank! the person must confirm that the cargo tank motor vehicle conforms to the specification re&uired for the lading and that the -*56 of the cargo tank is greater than or e&ual to the largest pressure obtained under the follo ing conditions7 (i) 8or compressed gases and certain refrigerated li&uids that are not cryogenic li&uids! the pressure prescribed in '1)"."19 of this subchapter. (ii) 8or cryogenic li&uids! the pressure prescribed in '1)"."1$ of this subchapter. (iii) 8or li&uid hazardous materials loaded in :;T specification cargo tanks e&uipped ith a 1 psig normal vent! the sum of the tank static head plus 1 psig. 2n addition! for hazardous materials loaded in these cargo tanks! the vapor pressure of the lading at 119 <8 must be not greater than 1 psig! except for gasoline transported in accordance ith =pecial 6rovision >"" in '1)2.1%2(c)(") of this subchapter. (iv) 8or li&uid hazardous materials not covered in paragraph (c)(1)(i)! (ii)! or (iii) of this section! the sum of the vapor pressure of the lading at 119 <8! plus the tank static head exerted by the lading! plus any pressure exerted by the gas padding! including air in the ullage space or dome. (v) The pressure prescribed in subpart >! :! #! 8! ?! or @ of this part! as applicable. (vi) The maximum pressure in the tank during loading or unloading. (2) *ny =pecification -A "%%! -A "%1! -A "%2! -A "%"! -A "%9! -A "%3 or -A "12! cargo tank motor vehicle ith no marked design pressure or marked ith a design pressure of " psig or less may be used for an authorized lading here the pressure derived from '1)".""(c)(1) is less than or e&ual to " psig. *fter :ecember "1! 1BB%! a cargo tank may not be loaded and offered for transportation unless marked or remarked ith an -*56 or design pressure in accordance ith (B A80 1$%.(%9(k). (") *ny =pecification -A "1% or -A "11 cargo tank motor vehicle may be used for an authorized lading here the pressure derived from '1)".""(c)(1) is less than or e&ual to the -*56 or -56! respectively! as marked on the specification plate. (() *ny cargo tank marked or certified before *ugust "1! 1BB9! marked ith a design pressure rather than an -*56 may be used for an authorized lading here the largest pressure derived from '1)".""(c)(1) is less than or e&ual to the design pressure marked on the cargo tank. (9) *ny material that meets the definition of a :ivision 3.1! 6acking ?roup 2 or 22 (poisonous li&uid) material must be loaded in a cargo tank motor vehicle having a -*56 of 29 psig or greater. (3) Substitute packagings. Cnless other ise specified! here -A "%)! -A "12! :;T (%) or :;T (12 cargo tanks are authorized! minimum tank design pressure is 1)2.( k6a (29 psig) for any 6acking ?roup 2 or 6acking ?roup 22 li&uid lading that meets more than one hazard class definition. (d) Relief system. (1) Non.reclosing pressure relief devices are not authorized in any cargo tank except hen in series ith a reclosing pressure relief device. @o ever! a cargo tank marked or certified before *ugust "1! 1BB9 hich is fitted ith non.reclosing pressure relief devices may continue to be used in any hazardous material service for hich it is authorized. The re&uirements in this paragraph do not apply to -A ""%! -A ""1 and -A ""$ cargo tanks. (2) #ach cargo tank motor vehicle used to transport a li&uid hazardous material ith a gas pad must have a pressure relief system that provides the venting capacity prescribed in '1)$."(9.1%(e) of this subchapter. The re&uirements in this paragraph do not apply to -A ""%! -A ""1 and -A ""$ cargo tanks. (") * cargo tank motor vehicle made to a specification listed in column 1 may have pressure relief devices or outlets conforming to the applicable specification to hich the tank as constructed! or the pressure relief devices or outlets may be modified to meet the applicable re&uirement for the specification listed in column 2 ithout changing the markings on the tank specification plate. The venting capacity re&uirements of the original :;T cargo tank specification must be met henever a pressure relief valve is modified.

(e) Retention of hazardous materials in product piping during transportation. :;T specification cargo tanks used for the transportation of any material that is a :ivision 3.1 (poisonous li&uid) material! oxidizer li&uid! li&uid organic peroxide or corrosive li&uid (corrosive to skin only) may not be transported ith hazardous materials lading retained in the piping! unless the cargo tank motor vehicle is e&uipped ith bottom damage protection devices meeting the re&uirements of '1)$."").1% or '1)$."(9.$(b) of this subchapter! or the accident damage protection re&uirements of the specification under hich it as manufactured. This re&uirement does not apply to a residue hich remains after the piping is drained. * sacrificial device (see '1)$."(9.1 of this subchapter) may not be used to satisfy the accident damage protection re&uirements of this paragraph. (f) *n -A ""1 type cargo tank may be used here -A "%3! -A "%)! -A "12! :;T (%3! :;T (%) or :;T (12 type cargo tanks are authorized. *n -A "%)! -A "12! :;T (%) or :;T (12 type cargo tank may be used here -A "%3 or :;T (%3 type cargo tanks are authorized. * higher integrity tank used instead of a specified tank must meet the same design profile (for example! an -A ""1 cargo tank must be lined if used in place of a lined -A "12 cargo tank.) (g) Remote control of self closing stop !al!es"M# $$%& M# $$' and M# $$( cargo tanks. #ach li&uid or vapor discharge opening in an -A ""% or -A ""1 cargo tank and each li&uid filling and li&uid discharge line in an -A ""$ cargo tank must be provided ith a remotely controlled internal self.closing stop valve except hen an -A ""% or -A ""1 cargo tank is marked and used exclusively to transport carbon dioxideD an -A ""$ is used to transport argon! carbon dioxide! helium! krypton! neon! nitrogen! or xenonD or an -A ""$ utilizes an external self.closing stop valve to comply ith the re&uirements in '1)$.""$.11(b). @o ever! if the cargo tank motor vehicle as certified before Eanuary 1! 1BB9! this re&uirement is applicable only hen an -A ""% or -A ""1 cargo tank is used to transport a flammable li&uid! flammable gas! hydrogen chloride (refrigerated li&uid)! or anhydrous ammoniaD or hen an -A ""$ cargo tank is used to transport flammable ladings.
