ASWSUV Nineteenth Senate 2009-10 Session

AN ACT Adding Title XII, Amending By-law 150.01, and Amending the Table of Contents.

BE IT ENACTED BY THE ASWSUV SENATE:

Sec. 1. The By-laws shall be amended to read:


Title XII–ASWSUV Code of Ethics

1200.00 Purpose

1200.01 ASWSUV will, through the implementation of its Code of Ethics:


A. Seek to promote the well being of students by representing the integrity,
dignity, and worth of individuals, with the acknowledgement of differences.
B. Provide advocacy, leadership, and activities to the student body while
maintaining a professional environment.
C. Require those in positions of leadership within ASWSUV to refrain from
behaviors which threaten the freedom and respect every individual deserves.
D. Ensure that any violation of the Code of Ethics will be dealt with in the
appropriate manner.

1210.00 Code of Ethics

1210.01 No ASWSUV Senate, Executive, Judicial, or Staff legislation, order, ruling, or


action shall be in direct conflict with the Code of Ethics.

1211.00 Organizational Ethics

1211.01 ASWSUV Senators, Executives, Justices, and Staff will:


A. Place the interests of the membership of ASWSUV above any personal goals
and values.
B. Distinguish clearly the differences between statements that represent any
personal views and those of ASWSUV.
C. Recognize that ASWSUV is a legal organization under Washington State Law
and will, therefore, obey all lawful authorities, including the Articles of Incorporation, ASWSUV
Constitution and By-laws, Vancouver City Ordinances, State of Washington Administrative
Codes, the Revised Code of Washington, and laws of the United States.
D. Read and seek to understand the ASWSUV Constitution and By-laws prior to
accepting any position of responsibility and will act in accordance with the spirit and intent of
those documents.
E. Acknowledge and make public any potential conflict of interest arising from
any other involvement.
F. Actively seek to involve diverse groups of students in ASWSUV programs and
services.
G. Work to uphold a positive image of the Association.
H. Recognize that student leaders serve as role models and will refrain from
conduct involving dishonesty, fraud, deceit, misrepresentation, discrimination, and other forms
of conduct prohibited by the WSU Conduct Code.
I. Refrain from action that misuses the tangible and intangible resources of the
Association for personal gain.
J. Follow the approved policies for bringing about change as stated in the
Constitution and By-laws of the Association.

1212.00 Treatment of Colleagues

1212.01 Professional behavior is expected of student leaders. Consequently, ASWSUV


Senators, Executives, Justices, and Staff will:
A. Demonstrate professional courtesy, emphasizing respect for others and their
opinions.
B. Recognize that rational people can reach different conclusions based on the
same information.
B. Explore just methods of resolving conflict.
C. Communicate openly and honestly in carrying out responsibilities to the
Association.
D. Recognize a fair decision-making process, which acknowledges and respects
both majority and minority voices in the absence of parliamentary procedure.
E. Delegate responsibility with the expectation that those duties will be fulfilled
reflecting personal methods and styles.
F. Support each individual's endeavors to fulfill the duties of their position.
G. Objectively evaluate the opinions and actions of others.
H. Refuse to tolerate language or actions which may discriminate against or
devalue any individual student, group of students, or student organization.

1213.00 Obligation to the Student Body

1213.01 As a public servant, every ASWSUV Senator, Executive, Justice and Staff will:
A. Be attentive and receptive to the diverse views and needs of their constituency.
B. Actively promote open, two-way communication between the ASWSUV
leadership and the students it serves.
C. Use ASWSUV powers and resources to advance the interests of the students of
WSU Vancouver.
D. View their role as more than representation of student views. They will strive
to serve as a strong advocate for students, provide leadership in times of controversy, and insure
that all viewpoints, however controversial, are recognized.
E. Foster a fair and objective decision-making process throughout the
Organization and will seek out relevant facts and opinions before decisions are made.
F. Present an accurate portrayal of the nature and extent of their qualifications and
competencies when applying for positions within ASWSUV and when representing ASWSUV.
1214.00 Leadership Ethics

1214.01 The Student Body has given members of ASWSUV the responsibility to
effectively, fairly, and efficiently lead. As such, ASWSUV Senators, Executives, Justices,
and Staff will:
A. Continue personal development as student leaders by acquiring new
knowledge, improving skills, sharing ideas and information, and participating in the
meetings and affairs of ASWSUV.
B. Encourage and facilitate the leadership development of others.
C. Stress ethical standards in any orientation session, retreat, and meetings that
are developed, offered, or presented for fellow students.

1220.00 Violation

1220.01 Any ASWSUV Senator, Senator-elect, Executive, Executive-elect, Justice, or


Staff found to be in violation will meet with the President, Vice President, Chief Justice, and
Chair Pro-tempore of the Senate.
A. This group will discuss appropriate action after the meeting with the offender.

1220.02 Upon a second violation by the same person, the action will be reported to the
President and Chair Pro-tempore of the Senate. They will then call a special meeting where the
impeachment of the offender will be on the agenda in accordance with Article IV Section 8 (b) of
the ASWSUV Constitution.
A. If the violator’s position makes impeachment impossible, the President and
Vice President will dismiss the offender.

STATEMENT OF FACT:
This will ensure that ASWSUV Senators, Executives, Justices, and Staff act in an ethical
way. ASWSUV Executives, Senators, Justices, and Staff are more than students. They are student
leaders. The duties of leadership require that Student Government hold itself to a higher
standard. The penalties of violating this Code should be severe. Sections 2 and 3 will amend the
Table of Contents.
