The fgcts tending to establish the foregoing grounds for issuance of a search warrant are
as

follows:

On l}llltz}l3 a search warrant was executed at2637 STILLWATER ROAD EAST Apt 3,IVIAPLEWOOD, MN 55119. This is the primary residence of KEITH MICIIAEL NbVef who is the subject of violations of Title 18, United State Code Sections 641, Theft of Government Proepty;Title 18, United State Code 1028, Fraud and Related Activity in Connection with Identification Documents; and Title 18, United States Code Section 793, Gathering, Transmitting or Losing Defense Inforrration. I viewed the federal criminal complaint as part of that atrest, and based on the findings of that complaint I(EITH MICHIAL NOVAK made several statements to FBI Undercover Employees ("UCEs") that are a threat to law enforcement and public safety. NOVAK has both the means and the ability to carry out these threats.

NOVAK had previously indicated that the subject vehicle is used as a "Command Posf' during field taining exercises he leads with his militia goup. NOVAK has made statements to the UCE that if he learned ofthe existence of an investigation, he might
flee, resort to violence or both. When providing a tour of subjects premise to the UCE on Jru/ry 23,2013 NOVAK described his actions if law enforcement would seek to arrest him at the subjects premises

NOVAK: Whenever I am working on something, I always keep this window open, 'cause if I hear my fucking door get kicked, I'm going to slide over here real quick, say dismount all, start shooting through the fucking wall. UCE: That's perfect too, because that's the hallway.

NOVAK: I always, set up my living area like that. Like there how my bed is, I've my AK in my bed. If I hear that door kick, it's going boom, boom,boom,boom, I'm just going to start putting them through the fucking wall. Another reason that I have all those rucksacks theie, I can throw them against the door. Well, also 'cause I'm still working
on them. Barricade myself, call my guys and have them show up.

UCE: Can they get here fairly quick?

NOVAK: Yeah, oh yeah I mean,I'd probty have to hold offthe fucking Mossad or whatever for about 30 to 40 minutes, but that's not a problem, I've got something, 5000
rounds, athousand of it is in magazines.

NOVAK fiyttrer stated to the UCE that he had weapons hidden throughout the state.
Dr:ring a conversation with the UCE on September28,2013 NOVAK again reiterated the danger facing law enforcement officers if they attempted to enter his premises and reinforces the fact that he has weapons hidden elsewhere.

UCE: Yoru place is set up pretty well Keith. That would be tough to get into.

NOVAK:

Oh yeah, the nice fatal fi:nnel I've got going on there.

On Septemb er 28,2013 NOVAK invited the UCE to attend a military-style field training exercise with NOVAK' s militia goup in n:ral Mirutesota.

OnNovember, 15, 2013 anFBI, Confidential Human Source (CHS) accompanied that NOVAK to a storage unit that contained six "flak vests". NOVAK stated to the CHS *riot and netting" camouflage reflective "radio to incl.ude he has a lot of equipment stored geat''taken from the U.S. military. NOVAK also advised the CHS he intends to start Urryiog caches of equipment and has prepared "geat bags" at his aparhnent to issue to his militia goup.

There has been media coverage of the above event and knowledge of the suspected cache of weapons which has lead the residents of the aparbnent complex to be concemed for their safety and contact this law enforcement agency.

Yogr Affiant requests tlre court's permission to enter the residence and subject vehicle located at2637 Stillwater Road East Apt #3 in Maplewood, MN and searchthe premises for the aforementioned items in the interest of public safety..

WHEREFORE, affiant requests a search warrant be issued, semmarrding Detective Todd Langner, (a) peace offrcer(s), of the State of Minnesota, and all other personnel under yooi di"."tion and control Between the hours of 7 a.m. and 8 p.m to search the herein before described (premises) (motor vehicle) for the described property and things and to seize said property and things and keep said property and things in custody until the sarne be dealt with according to law.

WHEREAS, Detective Todd Langner has this day on oath, made application to the said Court applytng for issuance of a search warrant to search the following described premises and motor vehicle:

2637 Stillwater Road East, Apartment 3, Maplewood, Minpesota 55109 and MN Motor Vehicle WA 208 a 1994 GMC Truck VIN # 2GTEK19IO(R1557834 located in the City of Maplewood, County of Ramsey, STATE OF MINNESOTA, for the following described property and things:

Weapons, guns firearms, ammunitions and other dangerous weapons described in Minnesota Statue 609.02 X'irearms of any type: Handguns, rifles, shotguns, or any type of firearm capable of discharging. WHEREAS, the application and supporting affidavit of Detective Todd Langner was duly presented and read by the Court, and being fully advised in the premises.

NOW, THEREFORE, the Court finds that probable cause exists for the issuance of a search warrant upon the following grounds:
1. The property above-described is in the possession of a person with intent to use such property as a means of committing a crime. In the interest of public safety.
