AN ACT concerning lobbyists; relating to judicial lobbyists; amending K.S.A. !-22" and !-222 and re#ealing t$e e%isting sections. Be it enacted by the Legislature of the State of Kansas: Section ".&K.S.A. !-22" is $ereby amended to read as 'ollo(s) !22". *a+ ,State o''icer or em#loyee, means: *"+ Any indi-idual ($o is an elected or a##ointed state o''icer.; *2+ any indi-idual ($o is in t$e classi'ied ser-ice or unclassi'ied ser-ice o' t$e Kansas ci-il ser-ice act.; */+ all o''icers and em#loyees o' t$e legislati-e branc$ and o' t$e go-ernor0s o''ice. irres#ecti-e o' $o( com#ensated or #eriod o' em#loyment.; and * + any indi-idual ($o recei-es mont$ly or semimont$ly com#ensation 'or ser-ices 'rom t$e state or any state agency. (b) State o''icer or em#loyee does not include any justice or commissioner o' t$e su#reme court or a!!ellate "udge or district court judge o' t$e judicial branc$ or em#loyee or o''icer o' t$e judicial branc$ or any member o' a board. council or commission ($o is a##ointed by t$e su#reme court or ($o is elected or a##ointed to e%ercise duties #ertaining to 'unctions o' t$e judicial branc$. ($en suc$ #erson is engaged in #er'orming a 'unction or duty 'or t$e judicial branc$. Also #dditionally. state o''icer or em#loyee does not include any a##ointed member o' an ad-isory council. commission or board. ($o ser-es (it$out com#ensation ot$er t$an amounts 'or e%#ense allo(ances or reimbursement o' e%#enses as #ro-ided 'or in subsection *e+ o' K.S.A. 71-/22/$ and amendments t$ereto. ($en suc$ member is engaged in #er'orming a 'unction or duty 'or suc$ council. commission or board. *b+ (c)&,Candidate, means an indi-idual ($o) *"+ A##oints a treasurer or a candidate committee; *2+ ma2es a #ublic announcement o' intention to see2 nomination or election to state o''ice; */+ ma2es any e%#enditure or acce#ts any contribution 'or t$e #ur#ose o' in'luencing suc$ #erson0s nomination or election to any state o''ice; or * + 'iles a declaration or #etition to become a candidate 'or state o''ice. *c+ (d)&,State o''icer elect, means an indi-idual ($o $as been elected to state o''ice or a##ointed to 'ill a -acancy in a state o''ice but ($o $as not yet ta2en t$e oat$ o' o''ice. lobbying; *2+ any #erson 'ormally a##ointed as t$e #rimary re#resentati-e o' an organi8ation or ot$er #erson to lobby in #erson on state-o(ned or leased #ro#erty; or */+ any #erson ($o ma2es e%#enditures in an aggregate amount o' 9"66 or more. e%clusi-e o' #ersonal tra-el and subsistence e%#enses. in any calendar year 'or lobbying. *b+& 3obbyist s$all not include) *"+ Any state o''icer or em#loyee engaged in carrying out t$e duties o' t$eir o''ice; *2+ t$e em#loyer o' a lobbyist. i' suc$ lobbyist $as registered t$e name and address o' suc$ em#loyer under K.S.A. !-2!1$ and amendments t$ereto; */+ any non#ro'it organi8ation ($ic$ $as :uali'ied under #aragra#$ */+ o' subsection *c+ o' section 16" o' t$e internal re-enue code o' "51 . as amended. ($en suc$ #erson is engaged in #er'orming a 'unction or duty 'or t$e judicial branc$; or *1+ any a##ointed member o' an ad-isory council. commission or board. ($o ser-es (it$out com#ensation ot$er t$an amounts 'or e%#ense allo(ances or reimbursement o' e%#enses as #ro-ided 'or in subsection *e+ o' K.S.A. 71-/22/$ and amendments t$ereto. ($en suc$ member is engaged in #er'orming a 'unction or duty 'or suc$ council. commission or board. (c) %udicial lobbyist &eans a lobbyist hired by the "udicial branch' (d)(ourts are not authori)ed to offer e&!loy&ent to or e&!loy lobbyists and other !ersons for lobbying or to !ay any e*!enses incurred in connection there+ith fro& the general fund of the "udicial budget' ,herefore any and all e*!enditures heretofore &ade for the !ay&ent of e*!enses incurred by the su!re&e court$ district courts or the "udicial ad&inistration office in connection +ith$ or for the !ur!ose of$ lobbying or the e&!loy&ent of lobbyists are hereby unla+ful uses of ta* !ayer funding' Sec. /.&K.S.A. !-22" and !-222 are $ereby re#ealed.
