Victor Frankenstein vs.

The Creature (Mock Trial) Each student will actively be involved in the mock trial of Victor Frankenstein for negligence, malpractice, emotional distress, and/or physical distress. The trial, like the novel, may include fictional and fantasy elements. Each student (team) will be given time in class to prepare for his or her role by reviewing elements of the novel. The team made up of the Judge and Jury will collaborate with one another and predict what they think each lawyer will try to prove, who they think will win, and why? The case will be heard in a civil court, where a suit is brought by one individual (plaintiff) against another (defendant), whereas in criminal court, the case is between the state (prosecution) and the defendant. After students have identified the charges and reviewed terms (Wizardly Words: Civil Case, Plaintiff, Defendant, Malpractice, Negligence, Direct Examination, Cross Examination, Emotional Distress, and Physical Distress), they will each take a role in the court case. Roles for this mock trial will be broken up into three teams: Team "Victor": Lawyers for the defendant, Victor Frankenstein, William Frankenstein, Elizabeth, Robert Walton, Ethicist, and a Medical Expert. Team "Creature": Lawyers for the plaintiff, the Creature, Justine Moritz, Henry Clerval, DeLacey, Ethicist, and a Medical Expert. Team "Judge and Jurors": Judge and his/her jurors The mock trial will include the following process: Opening Statements (plaintiff's attorney and defendant's attorney): These opening statements must be typed out and handed in prior to the mock trial. Each team (lawyers for the plaintiff and the defendant) must develop an opening statement which will outline the strategy and purpose of each team in a well-organized and informative manner. (Direct Examination) Interrogation of plaintiff's witnesses: These questions/responses should be prepared, practiced, and handed in prior to the mock trial. These questions and responses should be logically developed and practiced (rehearsed). Cross Examination of plaintiff's witnesses: These questions/responses will be handed in

after the mock trial. These questions should be relevant and developed in a critical and insightful way. It should be quite evident during this time that each witness "knows" his/her character. (Direct Examination) Interrogation of defendant's witnesses: These questions/responses should be prepared, practiced, and handed in prior to the mock trial. These questions and responses should be logically developed and practiced (rehearsed). Cross Examination of defendant's witnesses: These questions/responses should be handed in after the mock trial. These questions should be relevant and developed in a critical and insightful way. It should be quite evident during this time that each witness "knows" his/her character. Closing Arguments (plaintiff's attorney and defendant's attorney): These closing statements must be typed out and handed in at the conclusion of the mock trial. Each team (lawyers for the plaintiff and defendant) must develop a closing argument which will outline the key detalis that their team pointed out during the trial. The Verdict: The jurors (and judge) must type out a written response which explains who won the trial and why they won the trial. Each juror must provide evidence from the trial in their responses. Damages: If the jury (and judge) find the defendant is guilty, the Judge must prepare a written response regarding the damages that must be paid to the Creature.
