Dear Sir/Madam, In reference to the notice of coverage (NOC) addressed to Gregorio P. Cabalida, Sr. the registered landowner of an agricultural land with TCT No./s P-7244, Tax declaration No. C-090070-A, located at Sampaguita, Veruela, Agusan del Sur, the heirs of Gregorio P. Cabalida Sr., hereby regret to advise the Department of Agrarian Reform Municipal office (DARMO) that the aforementioned landowner passed away last January 31, 2012, and therefore it is our common knowledge; That in effect, the said advisory (NOC) received by Gregorio A. Cabalida Jr. in Davao City last January 28, 2014 can no longer be complied with in pursuance to section 6 of the RA 6657, As mandated by DAR.

That instead, the heirs/siblings of Gregorio P. Cabalida Sr., would file an appropriate manifestation as prescribed thru the department of Agrarian Reform Municipal Office (DARMO) for whatever lawful procedure on inheritance due for the heirs under Philippine law to exercise their rights and privileges. That, in the process of property transfer to and among the heirs, a special power of attorney shall be executed by the family / siblings of Gregorio P. Cabalida Sr. authorizing his eldest son Armando A. Cabalida, as attorney-in-fact (AIF) to represent in behalf of the landowner all the undertakings to effect the individual and equal transfer to the heirs in accordance to DAR regulation. That the said property was placed under litigation since 1996 between the landowner (complainant) vs. Land Tenants (defendants) for violation of tenancy agreement. The case was decided by Agusan del Sur RTC branch No. VI in 2005 in favor of the plaintiff which is now subject for enforcement by the court and recovery by the heirs of Gregorio P.
