April 14, 2014 Mr. Cyrus Farivar Ars Technica [ADDRESS REDACTED] Dear Mr. Farivar, This letter is in response to your Public Records Act request dated April 7, 2014 for license plate reader data regarding your personal vehicle, CA Lic/[REDACTED]. Firstly, the Piedmont Police Department does not believe information captured by ALPRs to be a public record. Accordingly, there is no obligation to provide you any information captured by ALPRs under the Public Records Act. Secondly, we also consider all data captured to be intelligence information and therefore exempt from public disclosure under 6254(f) of the Government Code. We must consider the personal privacy implications of releasing raw ALPR data, as there is not always a direct correlation between ownership of a vehicle and any particular individual, and mistaken conclusions may harm other individuals' privacy and civil liberties. Though one can prove ownership of a vehicle, that vehicle may be driven by a spouse, family member, co-worker, etc, and releasing any associated information would violate that individual's expectation of privacy. Even more broadly than the concerns that guide our ALPR privacy policies, individuals likely would not want details of their movement made public. Thank you for you inquiry,
