Learner Permit Minimum Holding Period Exemption Application Overseas Applicants


Road Safety (Drivers) Regulations 2009 regulation 20 --------------------------------------------------------------------------------------This form is to be used by a driver who is unable to hold a learner permit for the minimum time it must be held due to hardship and wishes to apply for an exemption. Exemptions will only be granted having regard to an applicants driving experience and circumstances to which it was obtained and where undue hardship can be proven and VicRoads is satisfied that road safety is not compromised. Any exemption granted may result in conditions imposed on the persons driver licence for a specified period which: (a) (b) (c) (d) limit the carriage of passengers; and/or limit routes of travel; and/or restrict driving to specified times of the day; and/or restrict driving to specified days of the week. Please ensure that the person supporting your application also completes Section 15 of this form - Supporting persons details.

What documentation must be provided?


To support the application, the learner driver must provide: documentation from, for example, an educational institution/course coordinator if the exemption is required due to hardship as a result of occupational circumstances; and/or documentation from his or her employer verifying the employment if the exemption is required due to hardship as a result of employment circumstances; and/or documentation from a relevant authority (eg medical practitioner, parish priest etc) if the exemption is required due to hardship as a result of family circumstances.

What is the Minimum Time a Learner Permit Must be Held for a driver/rider?
Car driver licence Road Safety (Drivers) Regulations- regulation 21 When applying for a car driver licence, a learner driver needs to have held their car learner permit for the following periods of time immediately before obtaining a car driver licence: at least 12 months if the person is less than 21 years old; or at least 6 months if the person is at least 21 years old but less than 25 years old; or at least 3 months if the person is at least 25 years old.

Motorcycle licenceRoad Safety (Drivers) Regulations - regulation 23 When applying for a motorcycle licence, a rider needs to have held a motorcycle learner permit for at least 3 months immediately before obtaining a motorcycle licence. Note: If you have had an adverse driving record, this may prevent you from obtaining an exemption from the learner permit minimum holding period.

Who is eligible to apply for an exemption?


To be eligible to apply for this exemption, you must already hold a Victorian learner permit. Any exemption granted will commence from the date your licence is issued.

When should an exemption be applied for?


An application for an exemption should only be made when the driver can demonstrate to VicRoads, by providing supporting documentation, that he or she and/or their immediate family will suffer undue hardship as a result of holding a permit for the minimum time a permit must be held due to the nature of the learners occupation, employment or family circumstances. Confirmation that an exemption has been granted by VicRoads must be obtained prior to making an appointment to take a Victorian licence test.

VicRoads reserves the right to cancel your exemption if your driver licence is cancelled or suspended. A letter will be sent to you to advise you of VicRoads intention to cancel the exemption, and you will be allowed an opportunity to show why you should be permitted to retain the exemption. If you do not respond to the notice within the required time, the exemption will be cancelled without further notice.
