FLORIDA DEPARTMENT OF LAW ENFORCEMENT INVESTIGATIVE REPORT

On April 1, 2013, Inspector Brett Lycett of the Florida Department of Law Enforcement (FDLE), Office of Executive Investigations received correspondence from attorney Gilbert Feltel, legal counsel for former Lieutenant Governor Jennifer Carroll. The correspondence and accompanying supporting documentation was in response to questions presented to Carroll and Feltel regarding Carroll's relationship with Allied Veterans of the World, her state required financial disclosure forms, and her 2010 campaign finance activity. The following is a summary of the information provided by Feltel: Carroll had previously been questioned about her amended 2009 financial disclosure form and why it did not document the $24,000 of income her business (3N & JC) received from AVOTW, and instead documented that her business "net income" did not exceed $1000. Feltel's correspondence responded by explaining that the revenues received by Carroll's company from AVOTW "offset" losses Carroll had accumulated through another business venture operated under 3N & JC. Feltel provided Carroll's 2009 business tax forms which he indicated supported this explanation, showing 3N & JC with a net loss for the year. Feltel explained, because of the business operating in the negative for 2009, Carroll's amended 2009 financial disclosure form was correct when documenting "net income," less than $1000. Additionally, Carroll was asked about the identity of the individual(s) who completed her amended 2009 financial disclosure form. Feltel's correspondence explained that Carroll's amended 2009 financial disclosure form was completed by lawyers, including Trevor Potter, who assisted in Rick Scott's 2010 campaign for Governor. Of note, Inspector Lycett subsequently contacted Potter and asked if he recalled anyone assisting Carroll in completing her amended 2009 financial disclosure form. Though Potter could not recollect any specific information, he indicated that it was very likely someone from the campaign assisted and/or completed Carroll's amended financial disclosure form after reviewing her tax information. Regarding her 2010 financial disclosure form, Carroll previously advised FDLE that the information documented regarding 3N & JC's "net income" was incorrect. Carroll previously stated that she copied the information from her 2009 financial disclosure form and attached it to her 2010 financial disclosure form because, as she indicated, her financial status had not significantly changed. Feltel explained in his correspondence that Carroll failed to include the positive "net income" of her business for 2010, and provided copies of Carroll's 2010 taxes to reflect the appropriate "net income." disclosure form showing $16,047 of "net income" received by 3N & JC. Upon review of the 2010 tax information provided by Feltel regarding 3N & JC, it was discovered that Carroll claimed $48,000 in total income. However, AVOTW remitted twelve checks totaling $72,000 to 3N & JC during the calendar year of 2010. When advised of this discrepancy, Feltel explained that he would discuss the discrepancy with Carroll and contact FDLE at a later date with a response. Details regarding Carroll's campaign finance activity will be documented in a separate investigative report.
