CONTRACT TO SELL (Pag-IBIG Fund Financing)

KNOW ALL MEN BY THESE PRESENTS: This contract to sell, made and entered into this _______________________ at Calapan City, Or. Mindoro at by and between: NEO CALAPAN REALTY CORPORATION, a corporation duly organized and existing under and by virtue of the laws of the Republic of the Philippines, with office address at 3rd Floor, RGV Building II, Filipiniana Complex, Roxas Drive, Barangay Sto Nio, Calapan City, represented herein by _______________________________________________, hereinafter referred to as the SELLER; - and __________________________________________, of legal age, Filipino Citizens, and with residence and postal address at ______________________________________, represented through Special Power of Attorney by _____________________ with residence and postal address at Sto. Nio, Calapan City, Oriental Mindoro, hereinafter referred to as the BUYER. W I T N E S S E T H: WHEREAS, the SELLER is the registered owner in fee simple of a parcel of land situated at what is now referred to as NEO- CALAPAN, located at Barangay Sto. Nio, Calapan City Oriental Mindoro, identified as Block No. ___ Lot No ___ with an area of ___________ square meters, more or less, covered by TCT No. _________ of the Registry of Deeds for the Province of Oriental Mindoro and more particularly described as follows, to wit: TECHNICAL DESCRIPTION OF THE HOUSE AND LOT WHEREAS, the BUYER has offered to buy from the SELLER the above described parcel of land, including whatever improvements that are existing thereon; NOW, THEREFORE, premises considered, for and in consideration of the sum _____________________________________________________ (P____________) Philippine Currency, payable in the manner hereinafter set forth, the SELLER hereby agrees to sell the parcel of land to the BUYER, and the latter agrees to buy from the SELLER, under the following terms and conditions: 1. The BUYER shall pay to the SELLER at the office of NEO CALAPAN REALTY CORPORATION in Sto. Nio, Calapan, Oriental Mindoro, without necessity of demand or notice or the services of a collector, the agreed purchase price of the said parcel of land, as follows: EQUITY in the amount of __________________________________________________ PESOS (P _______________) was paid by the BUYER to the SELLER; And the balance of ________________________________________PESOS (P ___________ ) shall be paid directly and in full to the SELLER when the Housing Loan with the HOME DEVELOPMENT MUTUAL FUND, otherwise known as PAG-IBIG FUND have been approved and Deed of Absolute Sale shall be executed thereafter. In the event that the Housing Loan granted is lower than the balance, the amount difference shall be added as equity, paid by the BUYER to the SELLER. The SELLER shall determine the payment terms with considerations on both parties. That the SELLER agree to transfer the Title in the name of the BUYER upon receipt of the Letter of Guarantee/Notice of Approval from PAG-Ibig Fund. That the SELLER allow annotation of mortgage on the Title in favor of Home Development Mutual Fund.
