CanyougiveclarificationonthedresscodeundertheSyariahPenalCode?
Firstandforemost,itmustbeclarifiedthatthereisNOSPECIFICOFFENCEintheSyariah
PenalCode2013(SPC)regardingclothing.Assuchthereisnosuchdresscodeunder
thislaw.
However,iftheattirewornconstitutesindecency,thenitmayfallundersection197ofthe
SPC(indecentbehaviour).Section197(1)states:
Anypersonwhocommitsanactofindecentbehaviourinanypublicplaceisguilty
ofanoffenceandshallbeliableonconvictiontoafinenotexceeding$2,000,
imprisonmentforatermnotexceeding6monthsorboth.
AnactwillbedeemedtobeindecentifittendstotarnishtheimageofIslam,depravea
person,bringbadinfluenceorcauseangertothepersonwhoislikelytohaveseentheact.
Assuch,ifapersonwearsclothingthatmeetsanyoneofthesefourcharacteristicsitmay
fallunderindecentbehaviour.

Onthisnote,itisemphasisedthattheaboveanswerislimitedtothelegalaspectofthe
provision.ForMuslims,theobligationtocoveraurah(dresscodeforMuslims)iswell
knownandneednotbeexplainedhere.

IsthedresscodeapplicableforbothMuslimandnonMuslim?
Yes.TheobligationtoobservedecentbehaviourappliestobothMuslimsandnon
Muslims.

Whatisconsideredasindecentclothing?
Thereisnohardandfastruleregardingthis,noristhereanyspecificguidelineyet
explainingwhatisconsideredasindecentclothing.Thisshouldbemeasuredwithregard
tothecustomandnormsoftheBruneicommunity,takingintoaccountthefactthatBrunei
practicesMIB(MalayIslamicMonarchy)andmoreimportantly,rememberingthatIslamis
theofficialreligionofthecountry(BruneiConstitution).Generally,clothesshouldnotbe
provocative.Thefourcharacteristicsprovidedundersection197oftheSPCshouldbe
adheredto.

Willthedresscodeapplytovisitorscomingtothecountrye.g.tourists?
TheSPCappliestoallpersonsinBruneiDarussalam,includingtourists.Toensurethat
theyareawareofthislaw,abriefinghasbeengiventotravelagentsanditisexpectedthat
theywilldisseminateanyusefulinformationtoincomingtouristsusingsuitablemeans.

WilltherebeaseparatedresscodethatwillapplyduringPuasamonth?
Generally,thesameprinciplesapplythroughouttheyear.

AreallrestaurantsexpectedtocloseduringthePuasamonth?
No.TherestaurantscanremainopenforbusinessduringthePuasamonth.Accordingto
section195(2)oftheSPC,anypersonwhosellsorservesanyfood,drinkortobaccofor
immediateconsumptionatthatspot,inapublicplace,duringthefastinghoursisan
offence.Assuch,buyingtakeawaysareallowed.Onlydineinsareprohibitedduringthe
fastinghours.NonMuslimstaffcanstillpurchasefooditemsduringthedayandeatin
privateplaceswheretheywillnotbevisibletothepublic.

Inregardstothecapitalpunishment,willitbeapplicabletononMuslim?Ifyes,inwhat
scenario?
OffenceswithcapitalpunishmentsapplytononMuslimsincertaincases,includingthe
followingscenarios:
Hirabah(robbery)ifduringthecourseofaction,thenonMuslimhascauseddeath,
andthecaseisprovedeitherbyhisownikrar(confession),orbysyahadah
(testimony)ofatleasttwomalesyahidwitnesses.

Zina(adultery)ifthenonMuslimismuhshanandtheactioniscommittedwitha
Muslim,andthecaseisprovedeitherbyhisownikrar,orbysyahadahofatleast
fourmalesyahidwitnesses.

Zinabiljabar(rape)ifthenonMuslimismuhshan,andthecaseisprovedeitherby
hisownikrar,orbysyahadahofatleastfourmalesyahidwitnesses.

Liwat(sodomy)ifthenonMuslimismuhshanandthecaseisprovedeitherbyhis
ownikrar,orbysyahadahofatleastfourmalesyahidwitnesses.

Qatlulamd(intentionallycausingdeathofanotherperson)ifprovedeitherbyhis

SyariahCourt).

CananonMuslimrequestforacasetobejudgedbytheSyariahCourt?
Incriminalcases,theprosecutionwilldecidewhichcourtwillthecasebefiled,accordingto
thejurisdictionspecifiedinthelaw.IfthecaseiswithinjurisdictionofSyariahCourt,Section
3(4)oftheSPCdeclaredthatnocourtotherthantheSyariahCourtsshallhavejurisdictionto
hearordetermineanymatterarisingintheSPC.

IfacaseisapplicabletobejudgedinbothCivilandSyariahCourt,whichonewillhold

Thismatterisstillunderconsiderationandsofarithasnotbeendecidedbytheauthoritative

uzursyariei.e.conditionsrecognisedbyIslamasanexemptionfromreligious
obligations,forinstanceintoxicatedduetomedicine,travellingorduringnatural

Assuch,ifamaleworkerhasareasonableexcuseinwhichleavinghispostmayresultina
detrimenttothesocietyorhisemployer,forinstanceastaffworkingonshift,thenitfalls
withintheexceptionandnoactionwillbetakenunderthislaw.
Nevertheless,allemployersareadvisedtoensurethattheirMuslimmalestaffdonotmiss
outontheFridayprayersthreetimesinarowbywayofrearrangingtheirschedulestobe
moreflexiblesothatthestaffcanperformtheprayersalternatelyinbetweentheweeks.

Theoffenceofkhalwatisprovidedundersection196oftheSPC.Itmaytakeplacebetween
MuslimsonlyorbetweenMuslimsandnonMuslims.Thisoffenceoccursbetweenaman(or
more)andawoman(ormore),exceptthoselegallymarriedormahram(prohibitedpersons
tomarrysuchassiblings),regardlessoftimeofday,inthefollowingsituations

a) livingtogether,cohabiting,inconfinement;or

b) isolatingoneselfincloseproximitythatcanleadtosuspicionthattheyare
committinganimmoralact.

Inthesituationinquired,ifafemalestaffandamalesupervisorareinacompanyscaron
businesspurposes,generallyitisallowedduringworkinghoursanditisnecessaryforthe
purposeofcarryingouttheirrespectiveduties.Thisisalsoallowedduringnonworking

hoursiftheyareorderedorpermittedtodosobytheemployertocarryoutextraduties.
Howeverthiswilldependonthecircumstancesofthecase,forexample
Ifthecarisstationaryandisparkedinaplaceisolatedfromthepublicinclose
proximitythatcanleadtosuspicionthattheyarecommittinganimmoralact,itwill
constitutekhalwatpunishableunderthislawregardlessofworkinghours.Evenmore
soiftheyarestoppingforpurposesnotrelatedtotheirdutiessuchasrelaxing,eating,
drinking,chitchattingorattendingpersonalmatters.

Onthisnote,itisadvisablethatemployersavoidfromputtingmaleandfemalestaffonduty
alonetogethertoavoidanymisconceptionorsuspicion,exceptininstancesofhighnecessity
orunavoidablesituations.Insuchacase,thestaffareadvisednottostopinisolatedplaces
becauseitmayleadtosuspicionamongstthecommunity.Theycanrestinplacesvisibleto
thepublicsuchasrestaurantsetc.

Whatistheimplicationifafemaleworkerwhoistogetherwithhismalesupervisorina
closedofficeforaonetooneconversationstaffreport?
Itisnotanoffenceofkhalwatincaseswhereamaleandafemalestaffsitstogetherina
closedofficeforaonetooneconversationstaffreportprovidedthattheyarecarryingout
theirrespectiveduties,withintheworkinghoursandinaplacedesignatedforsuchpurpose.
Duringnonworkinghours,thesameprincipleappliesdependingwhetherthereexistsany
directiveandpermissionbythecompanyforovertimehours.

Nevertheless,toavoidanymisconception,itisadvisedifpossiblethatreasonablemeasures
betakenwithoutriskingconfidentiality,forexamplebyopeningthedoor,orbyopeningthe
blindsinroomsfittedwithwindowsorglasspanels.Ifitisnecessaryforthedoortobeshut,
itisadvisedthatitremainsunlocked.
Thistypeofcasesrequirecompleteinvestigationproceduressuchasreporttothe
authoritativebody,apreliminaryinvestigationandfollowedbyaraid.Iftheelementof
suspicionexiststhenaninvestigationwillensue.Prosecutionwilllaterbeconductedifthere
isenoughevidence,dependingonthecircumstancesandfactsofthecase.
14 Whatistheimplicationifafemalemuslimwearingtudongbutatthesametimewith

tightfitting/shortsleeveclothing?
Asexplainedbefore,todatethereisnolegalprovisionregardingwomensclothing.
EspeciallyforfemaleMuslims,althoughthereisnolegalimplicationforwearingtightfitting
orshortsleeveclothing,asaMuslim,sheshouldgiveprecedencetoherreligiousobligation
incoveringheraurah.

Whatistheimplicationifamaleworkerdressesandclotheslikeawoman?
Section198oftheSPCprovidesfortheoffenceofamanposingasawomanorviceversa.It
states:
(1) Anymanwhodressesandposesasawomanoranywomanwhodressesandposesas
amaninanypublicplacewithoutreasonableexcuseisguiltyofanoffenceandshallbe
liableonconvictiontoafinenotexceeding$1,000,imprisonmentforatermnot
exceeding3monthsorboth.

(2) Anymanwhodressesandposesasawomanoranywomanwhodressesandposesas
amaninanypublicplaceforimmoralpurposesisguiltyofanoffenceandshallbe
liableonconvictiontoafinenotexceeding$4,000,imprisonmentforatermnot

Basedontheaboveprovision,amaleworkerwhodressesandposeslikeawomaninpublic
placesmaybeliableforanactionundersubsection(1)iftheelementsarefulfilledhaving
regardtohisclothing,wayofspeechandbehaviourwithoutanyreasonableexcuse.
Similarlyisthecaseforawomanwhodressesandposeslikeaman.
