Resumo - O presente artigo tem como objetivo contextualizar a problemtica da reincidncia de
menores infratores a partir das doutrinas de consultores na rea do Direito da criana e do
adolescente de forma a identificar as causas dessa reincidncia. Como a abordagem desse tema
um pouco complexa, ser de suma importncia fazer um panorama da situao dos menores de 18
anos em relao legislao brasileira tratando-se, sobretudo, da inimputabilidade penal atribuda
aos mesmos. E, tambm, abordar-se- o histrico jurdico da criana e do adolescente para se estar a
par da evoluo dos direitos que os mesmos alcanaram na Legislao Vigente- ECA. O mtodo de
abordagem a ser utilizado ser o dedutivo em vista da combinao de idias que ir caminhar do
geral para o particular. Sendo, tambm, necessrio o estudo da doutrina de alguns autores para
verificar seus argumentos a respeito das possveis falhas de execues das medidas scio-educativas
que refletem no aumento de reincidncia dos menores infratores.

Abstract- This article aims to contextualize the problem of recidivism of juvenile offenders starting
from the doctrines of law of the consultants in the area of children and adolescents in order to
identify the causes of recidivism. How to approach this issue is somewhat complex, will be of
paramount importance make an overview of the situation of under-18s in relation to Brazilian law,
in the case especially nonimputability criminal attributed to them. And also, will approach the legal
history of children and adolescents to be aware of the evolution of the rights that they achieved in
the Governing Law-SCA. The method of approach used was deductive, owing of the combination of
ideas from the general to the particular. Is also necessary to study the doctrine of some authors to
check their arguments about the possible failure of executions in socio-educational measures that
reflect the increased recidivism of juvenile offenders.
