This agreement entered this 7 th day of April 2014 in Sto. Tomas, Batangas by and between:
ROBERTO G. ESMILIO, of legal age, Filipino and a resident of 760 Ph 4 Lot 15 Blk 24, Mt. Claire Village, Sto. Tomas, Batangas, herein after called the LESSOR.
ELEZEAR PORNIAS, of legal age, Filipino and a resident at 200 A. Vausa Road, Veterans Vill., Holy Spirit Drive, Quezon City herein after refer to as LESSEE.
WITNESSETH:
That the LESSOR is the brother-in-law of the owner of the house and lot situated at Phase 2 Block 7 Lot 20, San Antonio Heights, Sto. Tomas, Batangas.
That the LESSOR hereby leases the house and lot unto the LESSEE under the following terms and conditions:
1. The monthly rental of the leased premises shall be TWENTY FIVE THOUSAND PESOS (P25,000).
2. Tenant allowed to add things inside and outside the property but not allowed to remove things. If they added things inside and outside the house but I do not agree to reduce their monthly payment. As in the future if they leave my place they can always take it with them but all the damages on house has to fixed.
3. All charges of water, light, telephone, cable, internet, garbage, homeowners fee and clubhouse, other equipment facilities within the leased premises shall be sole account of the LESSEE.
4. All ordinary repairs within the premises that arise in the daily use of the facilities herein shall be for the sole account and expense of the LESSEE without the right to reimbursement.
5. LESSEE shall be responsible for the observance of sanitary and electrical regulations required or imposed by the city government authorities regarding the use of habitation of the leased premises. LESSEE shall also exercise the diligence of a good tenant in the maintenance of cleanliness and general tranquillity in the leased premises and vicinity thereof. Regular or habitual drinking spree in the premises is not allowed.
6. Improvements introduced in the leased premise by the LESSEE shall be owned by the LESSOR upon LESSEES vacating the premises, without right to reimbursement unless the improvement introduced can be removed without damaging or impairing the leased properties. If there is a problem to fix inside the house, the tenant will be responsible to pay for it.
7. If the LESSEE decides to vacate the premises for reasons other than pursuant to demand of LESSOR; a written notice at least thirty (30) days in advance should be given by the LESSEE to the LESSOR. If the LESSEE fails to comply with this requirement, LESSEE shall be required to pay lease rental corresponding to said period. 8. LESSOR may come time to time during reasonable hours enter and inspect the leased premises for the purposes of verifying the leased property and providing whatever may be necessary to enhance its life and utility.
9. In case of litigation for non-payment of the agreed rental or any branch of this contract on the part of the LESSEE, he/she shall, in addition to the rent due and accruing, be liable for the payment of litigation expenses incurred, such as attorneys fees and other cost incident thereto.
10. Upon the expiration of the period of this leases or its renewal or extensions, the LESSEE shall be peacefully vacate the leased property and its premises, and restore possession thereof the LESSOR in as good condition as the time of delivery to the LESSEE, ordinary wear and tear expected, unless contract is renewed under such terms and conditions as agreed upon by the parties.
11. The terms of this contract shall be for a period of SIX MONTHS, beginning from April 15 to October 15, 2014 subject to renewal at the option of the LESSOR.
12. The LESSEE will pay Fifty thousand pesos (P50,000.00) for the two months deposit and another Twenty five thousand Pesos (P25,000.00) for one month advance before the LESSEE transfer in April. If the LESSEE failed to finish this contract, the amount that the LESSEE gives cannot be refunded or will be profited.
