The United States of America acting through the
Millennium Challenge Corporation (MCC) and the
Government of the Republic of Indonesia (the
Government) have entered into a US$600,000,000
Compact for Millennium Challenge Account
assistance to help facilitate poverty reduction through
economic growth in Indonesia. The Government of
Indonesia, acting through the Millennium Challenge
Account Indonesia (MCA-Indonesia) intends to
apply a portion of MCC funding to eligible payments
under a contract for which this Call for Qualifications and Fee is issued. We are
looking for competence, capable, highly qualified and highly motivated person
for this assignment :

Participatory Land Use Planning Consultant (GP-A-001)
The Individual Consultant will focus on land tenure, land law and land
administration as supporting elements to effective management of land
resources and sustainable renewable energy investments in Indonesia and
specifically the four starter districts of the Green Prosperity Project; Muaro
Jambi and Merangin in the Province of Jambi and Mamasa and Mamuju in the
Province of West Sulawesi, and other districts that will be defined. The focus of
this work is technical, developmental and operational.

The duration of the assignment is approximately 12 months (extensions are
possible), full-time, 40 hours per week, in Jakarta, Indonesia. Frequent field
travel (up to 60% of time) within the provinces of Jambi and West Sulawesi and
other provinces and districts to be determined. Travel to Washington DC may
also be required.

INTRODUCTION

1. The United States of America acting through the Millennium Challenge Corporation (MCC) and
the Government of the Republic of Indonesia (the Government) have entered into a
US$600,000,000 Compact for Millennium Challenge Account assistance to help facilitate poverty
reduction through economic growth in Indonesia through three projects: the Green Prosperity (GP)
Project; the Community-Based Nutrition to Prevent Stunting Project; and the Procurement
Modernization Project. The Government of Indonesia, acting through the Millennium Challenge
Account Indonesia (MCA-Indonesia) intends to apply a portion of MCC funding to eligible
payments under a contract for which this Call for Qualifications and Fee is issued. Any payments
made under the proposed contract will be subject, in all respects, to the terms and conditions of the
Compact and related documents, including restrictions on the use and distribution of MCC funding.
No party other than the Government and MCA-Indonesia shall derive any rights from the Compact or
have any claim to the proceeds of MCC funding.

2. The GP Project is comprised of four Activities: (i) Participatory Land Use Planning; (ii) Technical
Assistance and Oversight; (iii) GP Investment Facility for renewable energy and natural resources
management projects; and (iv) Green Knowledge. The Participatory Land Use Planning (PLUP)
activity, with funding of US$25million, is designed to put in place the foundational spatial planning
elements needed to enable and sustain the specific investments in renewal energy and natural
resource management funded by the GP Investment Facility, as well as to support the implementation
of environmental and social safeguards.

3. The PLUP is expected to: (i) enhance capacity for improved spatial planning at the District level; (ii)
reduce land disputes as a means to improve the investment climate for renewal energy and natural
resource management projects; and (iii) empower village communities and provide spatial certainty
through participatory geo-location and mapping of village settlements and natural resource areas.

SCOPE OF WORK


4. The Consultant will focus on land tenure, land law and land administration as supporting elements to
effective management of land resources and sustainable renewal energy investments in Indonesia and
specifically the four starter districts of the GP Project; Muaro Jambi and Merangin in the province of
Jambi and Mamasa and Mamuju in the province of West Sulawesi, and other districts that will be
defined.. The focus of this work is technical, developmental and operational as opposed to strictly
research.

5. The specific tasks to be completed are arranged into three task groups: (i) support and logistical; (ii)
technical analysis; and (iii) operational analysis and planning

DELIVERABLES

6. The Consultant will provide the following deliverables:
(i) Inception Report, 30 days after contract signing:
(ii) Monthly Reports, last day of each month during contract period; and
(iii) Final Report, 12 months after contract signing.

QUALIFICATIONS

7. Interested Individual Consultants shall have the following qualifications:
at minimum seven (7) years of demonstrated professional experience;
graduate level degree in geography, land tenure, property rights law, land use planning, rural
sociology or land economics;
experience in spatial planning in the Indonesian context and national/local/community institutional
structure for land administration and management;
research, field or project experience in land tenure, real property rights systems, community
participatory planning or land use concessions in Indonesia;
specific experience of the institutional structure and administrative processes for land tenure and
land use planning at the national, local or community level in Indonesia;
experience in government village boundary setting and recent participatory village boundary
setting exercises in Indonesia;
previous experience with technical and operational design and budgeting of investment
operations; and
fluent in Bahasa Indonesia and English (speaking, reading and writing), including the ability to
translate documents between both languages.

DURATION AND PLACE OF PERFORMANCE

8. The duration of the assignment is approximately 12 months (extensions are possible), full-time, 40
hours per week, in Jakarta, Indonesia. Frequent field travel (up to 60% of time) within the provinces
of Jambi and West Sulawesi and other provinces and districts to be determined. Return trips to
Washington, DC may also be required to work with the MCC Teams.

HOW TO APPLY

9. MCA-Indonesia hereby invites interested Individual Consultants to submit their Curriculum Vitae
and other documents identified below (Section 10), in addition to a financial proposal (with an all-
inclusive daily fee rate) in separate sealed envelopes. Individual Consultants shall only disclose
their all-inclusive daily fee rate in their financial proposal which shall be placed in a sealed envelope,
separate from the documents requested below. Both envelopes shall be sealed and placed in another
envelope. The financial proposal shall be marked: Financial Proposal, Do Not Open until after the
Technical Review.

Financial proposals shall not include any travel or per diem. MCA-Indonesia shall provide airfare
and per diem when the Consultant is required to travel beyond Jakarta.

The Consultant shall provide their own laptop computer with business software needed to complete
the work (e.g.: Microsoft Word, Excel, Power Point, etc.). MCA-Indonesia shall provide office space
and materials, internet, and printer access at their offices in Jakarta.

10. Interested Individual Consultants also shall submit the following:
(i) Curriculum Vitae (CV), using the CV template provided by MCA-Indonesia, detailing the
consultants professional qualifications, areas of expertise, and experience carrying out similar
assignments;

(ii) Proof of all professional qualifications and work experience indicated in their CV. This shall
include: copies of all the diplomas and certificates (if available); letters from the previous

clients certifying their work experience, or copy of contracts or any other written document(s)
that can prove, beyond any doubt, that the consultant has the work experience and
qualifications indicated in his/her CV, using CV template provided at the address below in
Section 14.

(iii) Professional references (at least three (3) referees) with contact details, including a valid email
address.

Failure to submit the information requested in Section 10 and the financial proposal in Section 9
(above) will render the application incomplete and may have a negative effect on the selection of the
Consultant. Any submission without a Financial Proposal will be rejected.

11. CVs and all the supporting documents shall be in English.

SUBMISSION DATE AND TIME

12. Interested Consultants shall submit their CVs (along with other documents mentioned in Section 10,
above) and financial proposals to the address below on or before December 20, 2012, by 5:00pm.
Envelopes should be clearly marked: Participatory Land Use Planning Consultant. Applications
received after this date and time shall not be considered. Electronic submissions shall not be
accepted.

SELECTION PROCESS

15. An Individual Consultant will be selected following the Individual Consultant procedures (IC) as
defined in the MCC Program Procurement Guidelines (available at the following Website:
http://www.mcc.gov/pages/business/guidelines)

16. Individual Consultants CVs and related documents will be reviewed to determine if the Consultant
meets the qualifications requirements stipulated in Section 7 (above). Consultants who do not meet
all the qualification requirements stipulated in Section 7 will be disqualified. The Consultant with
the lowest all-inclusive daily rate, from those that met all of the requirements specified above in
Section 7 will be invited to negotiate a contract subject to conditions set out in Section 18, below.

17. Final selection will be subject to verification of CV, interview, reference checks and price
reasonableness of proposed fee. If verification is not satisfactory or the proposed fee is not
reasonable, negotiations will be terminated and the next ranked Consultant may be invited for
negotiations.

18. MCA-Indonesia is not bound to accept any of the CVs or other documents submitted, and may cancel
the selection process at any time without providing any justification to the Consultants.

4. Specifically, Compact funding will support the following PLUP activities.
(a) Village boundary setting, including:
(i) the development of district level guidelines for participatory setting of administrative
village boundaries using established Government processes combined with
international best practices, modern survey and mapping technology and including
meaningful involvement of women and disadvantaged groups, and
(ii) based on the guidelines, the participatory determination, geographic delineation and
physical demarcation of village boundaries in target districts.

(b) Updating and integration of land and other natural resource information,
including:
(i) completing of inventories of existing and pending licenses for land and natural
resource use, other use rights, community claims, and select biophysical data, and
(ii) technical assistance to relevant government agencies to support integration,
administration and sharing of spatial data, in order to improve their ability to conduct
transparent licensing, determine the most effective land use and investments, and to
make land information widely available to the public as required by Indonesias law
on Public Information Transparency of 2008.
(c) Enhancement of district spatial plans, by including the improved land and natural
resource information developed by the land use inventory and boundary setting
activities into updated spatial plans.
5. In order to finalize the development, articulation and scoping of the specific activities of
the PLUP, and as a basis for implementation planning, the Millennium Challenge
Indonesia (MCA-I) requires the services of a land use planning/ land resources
consultant.

SCOPE OF WORK

6. Objective: The Consultant will engage with and form an integral part of the current MCA-
I Team so as to provide expert land use planning and land resources management
guidance in the technical and operational aspects of the PLUP Activity of the GP Project.

7. The Consultant will focus on land tenure, land law and land administration as supporting
elements to effective management of land resources and sustainable renewal energy
investments in Indonesia and specifically the four starter districts of the GP Project;
Muaro Jambi and Merangin in the province of Jambi and Mamasa and Mamuju in the
province of West Sulawesi and other districts that will be defined. The focus of this work
is technical, developmental and operational as opposed to research.

8. The specific tasks to be completed are arranged into three task groups: (i) support and
logistical; (ii) technical analysis; and (iii) operational analysis and planning. These tasks
are illustrative and may include but not be limited to the following:

8.1 Support and Logistical
(i) serve as first-level operational and logistical liaison between the MCA-Indonesia
and MCC land sector lead responsible for oversight of the PLUP Activity;
(ii) serve as first-level liaison for communications and logistics between MCA-I/MCC
and national government agencies in general and specifically with the provincial
and district government agencies in Jambi and West Sulawesi, as well as and civil
society organizations and their representatives;
(iii) provide for pre-trip organization and direct arrangements and facilitation of
meetings and provide related logistical arrangements with governmental, donor,
NGO, civil society and academic representatives and community stakeholders in
support of and during MCC land sector lead trips to Indonesia;
(iv) accompany MCC land sector lead during their missions to Indonesia, including
trips to starter districts;

(v) provide translation (Bahasa Indonesia/English) as needed for MCC land sector
lead and others during technical meetings in Indonesia;
(vi) communicate regularly (and as needed) via telephone and email with the MCC
land sector lead on issues that arise;
(vii) participate in bi-weekly, and as needed, teleconference communication with MCC
Team to identify issues and discuss latest actions and accomplishments in the field
and provide updates and recommendations on key land-related issues and follow-
up on actions to address these issues; and
(viii) conduct necessary activities as requested by MCA-Indonesia GP Director.
8.2 Technical Analysis
(i) thoroughly review background and existing documentation and become familiar
with the existing PLUP activities as included in the GP Project;
(ii) engage with and hold meetings as needed with PLUP stakeholders, including
national and local government agencies, NGOs, civil society organizations, to
present and describe the PLUP, to determine issues and aspects related to land use
and land tenure in particular and identify and analyze specific risks, best practices
and opportunities in particular in the starter districts
(iii) conduct analysis of land resources, land tenure, land administration and spatial
planning related legislation, policy documents and analytical reports and prepare
translated briefs of important documents (as identified and agreed with MCA-
Indonesia and MCC land sector lead);
(iv) work closely with the MCC land sector lead to provide in-country assistance in
supervising and monitoring, as well as evaluating the work of the other MCC-
funded consultants contracted to provide Support Services for District Readiness
Assessment & Project Implementation Preparation for the Green Prosperity
Project in Indonesia (DRA/Land Use Consultants); in particular Task 3: Land
Use and Spatial Planning Needs Assessment in Starter Districts, and Task 4:
Prepare District Guidelines for Village Boundary Setting for Starter Districts;
(v) collaborate with the DRA/Land Use Consultants to identify and establish contacts
with PLUP stakeholders at the national, provincial and district government, civil
society and private sector level; and
(vi) provide MCA-Indonesia management and MCC Land Sector Lead with
constructive and critical advise and reports on the technical and operational
advancement of the DRA/Land Use Consultants as related to Tasks 3 and 4.
8.3 Operational Analysis and Planning
(i) conduct analysis in support of the final determination, planning, budgeting and
documentation of MCC-funded activities related to the PLUP Activity for fiscal
year quarters 2, 3 and 4;
(ii) conduct, technical, legal, institutional, financial and operational analysis in
support of the final determination and planning of PLUP activities;
(iii) working with the MCC land sector lead, take the lead role in preparing and
finalizing a detailed budget of the PLUP Activity;
(iv) working with the MCC land sector lead, take the lead role in preparing and
finalizing the Terms of Reference and estimated budget for a consultant that will

eventually be contracted to implement the PLUP activities included in the GP
Project;
(v) working with the MCC land sector lead, take the lead role in preparing a detailed
annotated time-line of activities and milestones for the periods: 1 ) DRA/Land
Use Consultants to Compact Entry Into Force (EIF); and 2) EIF to mobilization of
PLUP contractors; and
(vi) identify additional analysis and/or human resources that may be required to ensure
the advancement of the DRA/Land Use Consultants and the overall advancement
of the PLUP activities;
DELIVERABLES

9. The Consultant will provide the following deliverables:

(i) Inception Report: this brief written report will include: a) the Consultants general
observations on the PLUP activities identifying any specific issues or risks that
may affect the implementation of the PLUP Activity; b) an outline/format to be
used for subsequent Monthly Reports; c) a general timeline for monitoring the
DRA/Land consultants activities related to PLUP; d) an initial draft of the
annotated timelines and milestones as presented in 2.6(v); and e) an initial work
plan and timeline for completing the PLUP implementation Terms of Reference as
presented in 2.6(iv);
(ii) Monthly Reports: these written reports will: a) provide updates on the activities
included in the Inception Report; b) provide updates on the work of the
DRA/Land consultants and the CIF-funded activities; c) present the analysis of
land resources, land tenure, land administration and spatial planning related
legislation and policy documents as completed during the reporting period; and d)
present issues and aspects related to land use and land tenure in particular and
identify and analyze specific risks, best practices and opportunities; and
(iii) Final Report: this report will include: a) final observations and recommendations
of the Consultant highlighting any additional analysis and/or human resources that
may be required to ensure the overall advancement of the PLUP Activity; b) final
detailed description of the PLUP Activity; c) detailed budget estimate for the
PLUP Activity; d) final Terms of Reference for the contract to implement the
PLUP Activity; and e) final estimated timeline for the PLUP preparation and
implementation.

10. The deliverable schedule is as follows:

to Washington, DC to work directly with the MCC Team may be required to complete the
specific task related to the Terms of Reference for the eventual PLUP Activity
implementation consultant.
