With regard to the Temporary Foreign Worker Program: (a) what oversight mechanisms are in place to
monitor compliance; (b) who conducts workplace inspections; (c) how many persans responsible for

Under the previous Government, no inspections were done to ensure that employers were following the
rules, even though the previous Liberal Government created the low skill stream of the Temporary Foreign
Worker Program (TFWP) in 2002. ln 2007 the Government began conducting investigations and has
increased the number of reviews done each year significantly since then. ln 2012, the government created a
dedicated team of inspectors at Service Canada at Employment and Social Development Canada to
increase oversight of the TFWP.
The Government has made numerous reforms to the TFWP to better ensure Canadians are first in line for
available jobs including:
the authority to conduct on-site inspections to make sure employers are meeting the conditions of the
program;
the ability to ban con-compliant employers from the program for two years and immediately add their
names to a public "black list";
requiring employers who legitimately rely on Temporary Foreign Workers (TFW), due to a lack of
qualified Canadian applicants have a plan to transition to a Canadian. workfore over time;

requiring employers pay TFWs at the prevailing wage by removing the existing wage flexibility;
ad ding questions to employer Labour Market Opinion (LMO) applications to en sure that the TFWP is
not used to facilitate the outsourcing of Canadian jobs;
introducing fees for employers for LMO processing., and increased fees for work permits, so they are
not subsidized by taxpayers; and
making English and French the only languages that can be used as job requirements when hi ring
through the TFW process.
Service Canada's lntegrity Services Branch has the authority to conduct workplace inspections.
Under the previous Government, there were no dedicated inspectors. The current Goverriment created a
dedicated team of inspectors at Service Canada to increase oversight. The department continues to hire
more inspectors as they continue to reform the TFWP.

Sous le gouvernement prcdent, aucune inspection n'a t effectue pour s'assurer que les employeurs
suivaient les rgles, et ce, mme si le gouvernement libral prcdent a cr le volet des professions peu
spcialises du Programme des travailleurs trangers temporaires (PTET) en 2002. En 2007, le
gouvernement a commenc mener des enqutes et a augment considrablement le nombre
d'valuation fait chaque anne. En 2012, le gouvernement a cr une quipe ddie d'inspecteurs
Service Canada Emploi et Dveloppement social Canada pour accrotre la surveillance du PTET.
Le gouvernement a fait de nombreuses rformes au PTET afin de s'assurer que les Canadiens soient les
premiers en ligne pour les emplois disponibles, y compris:
le pouvoir de mener des inspections sur place pour s'assurer que les employeurs respectent les
conditions du programme;
la capacit de bannir les employeurs non-conformes au programme pour une priode de deux ans et
ajouter immdiatement leurs noms une liste noire publique;
exiger que les employeurs qui comptent lgitimement sur les travailleurs trangers temporaires (TET),
en raison d'un manque de candidats qualifis au Canada, aient un plan de transition vers une main-
d'uvre canadienne au fil du temps;
exiger que les employeurs versent aux TETs un taux de salaire courant en supprimant la mesure

existante de flexibilit des salaires ;
ajouter des questions l'avis relatif au march du travail (AMT) de l'employeur pour s'assurer que le
PTET n'est pas utilis pour faciliter l'externalisation des emplois canadiens;
l'introduction de frais pour les employeurs pour le traitement des ATM. et l'augmentation des frais de
permis de travail, de sorte qu'ils ne soient pas subventionns par les contribuables;
o faire de l'anglais et du franais les seules langues qui peuvent tre utilises comme exigences d'emploi
lors de l'embauche dans le processus PTET.
La Direction gnrale des services d'intgrit de Service Canada a le pouvoir d'effectuer des inspections en
milieu de travail.
Sous le gouvernement prcdent, il n'y avait pas d'inspecteurs ddis. Le gouvernement actuel a cr une
quipe ddie d'inspecteurs Service Canada pour accrotre la surveillance. Le Ministre continue
d'embaucher plus d'inspecteurs puisqu'elle continue la rforme du PTET.
