How to be Bar At Law?

Law profession is a glorious profession in any country of the world including Bangladesh.
Many students in Bangladesh dream that they will be starting their legal profession as a
barrister. But most of them have lack of knowledge that how to become a barrister, where to
study bar-at-law course and what are the requirements for becoming a barrister. This article is
basically for them who are interested to become barrister and hope this article will meet
their all possible queries.
There are many people found to ask the differences between advocate and barrister, s he a
barrister who gets degree from Britain, etc. To answer these questions in one sentence that
barrister doesn!t mean advocate or a lawyer. "fter passing bar-at-law, he does not become a
lawyer. "ccording to the Bangladesh Legal #ractitioners and Bar $ouncil %rder, &'() , a
barrister needs to obtain the certificate of *advocate! or *lawyer! from Bangladesh bar
council.
Then he will be an advocate. That means advocate is one kind of profession and barrister is a
prestigious degree which is acquired from Britain. n British ndia, to remove the difference
between barrister and advocate the bar council act of &')+ was passed and according to this
act all barristers would be known as advocate. ,ven now barristers need to get enrolled as an
advocate in the bar council of Bangladesh including a further enrollment in list of a local bar
association list or of -upreme $ourt as well in order to practice in Bangladesh. There are
many well known lawyers who are not barrister in Bangladesh. To become a barrister a
student must complete the two stages of study namely academic stage and the vocational
stage.
The "cademic -tage is usually completed either by undertaking a recognised .ualifying Law
/egree 01.L/23 or a 4raduate /iploma in Law 014/L23 from any university of ,ngland and
5ales. 5e should keep it in our mind that LLB under a Bangladeshi 6niversity is not a
.L/, as such students having an LLB from Bangladesh must obtain further LLB or 4/L 0for
graduate in a discipline other than the law3 under any recognised 6niversity of ,ngland and
5ales in order to complete the academic stage and to be eligible for the B#T$ 0second
stage3. To know about the .L/ student may e7plore the general council of bar website. t
should be stated that there are few institutions in Bangladesh also providing the tuition of an
e7ternal LLB under British 6niversities. "nother easiest way to know about .L/ is by
seeing the course contents of a law degree. " .L/ must contain the following seven
mandatory courses along with other elective courses. These are8
i3 #ublic Law 0including $onstitutional Law, "dministrative Law3
ii3 Law of $ontract
iii3 Law of the ,uropean 6nion
iv3 $riminal Law
v3 Law of Tort
vi3 Land Law
vii3 ,quity and the Law of Trusts
Vocational stage
Bar #rofessional Training $ourse 0B#T$3 was previously known as Bar 9ocational $ourse
0B9$3. %n successful competition of QLD a student must take a BPTC 0usually one year
fulltime3 at one of the institutions authori:ed by the Bar $ouncil of ,ngland and 5ales to
offer the B#T$ and be a member of one of the four law societies (inns. %n successful
completion of the B#T$ student barristers are ;called; to the bar by their respective inns and
are elevated to the degree of ;Barrister;. <owever, before they can practice independently in
,ngland they must first undertake twelve months of pupilage, but this is not mandatory for
those who wish to practice their own countries like Bangladesh.
To get admitted into B#T$ one must meet the following requirements.
0&3 $ompletion of "cademic -tage. 6sually requires )8) in qualifying law degree 0.L/3 or
)8) equivalents in another degree plus $#,=/iploma in Law pass.
0)3 nn membership
0>3 "ll students must have achieved or be equivalent to ,LT- (.? in written and spoken
,nglish
" student wishing to practice in Bangladesh after getting the degree of barrister he may get
enrolled after a competitive e7amination conducted by the Bangladesh bar council. Then he
has to commence a pupilage ship for a period of one year. Then, on a successful competition
of pupilage under a senior lawyer having minimum ten years of e7perience as a lawyer of the
-upreme $ourt of Bangladesh, he has to sit for e7am to get permission to practice in the
-$B. f he passes the e7am duly, then he will be certified to practice in the -$B as well as
the subordinate court of which bar he belongs to.
