Section 63 of the federal Commercial Vehicle Drivers Hours of Service Regulation, (SOR/205-313) allows for a
permit to be issued exempting qualified carriers from the cycle requirements provided a motor carrier satisfies
certain criteria. To qualify for this permit exemption, Alberta has identified that a motor carrier must meet the
regulatory definition of an oil well service vehicle and the departments policies in this area. These policies have
been summarized below as to which services do and dont qualify for the permit.

The intent of this exemption is to allow a transportation service to be provided directly to or from a well head. The
exemption does not apply when traveling between any two locations that do not include a well head site.

Services allowed by the permit include:
Moving a rig and its components directly to or from an oil/gas well site;
Transportation of camp shacks and well-site trailers that are being moved in conjunction with a rig move to
or from an oil/gas well site;
Transporting materials or personnel directly to or from a well site and needed in the day-to-day operation of
the well (e.g. drilling mud, drill pipe, compressed/liquefied gases, etc.);
Directly servicing or drilling of the well head or of equipment directly associated with the drilling of the
oil/gas well site such as testing, mud filling, cementing, hydraulic fracturing, data logging, servicing done
with a water truck or vacuum truck, etc.;
Transportation of raw petroleum products (e.g. crude oil, produced water, petroleum condensate, waste
sand, tailings) from a well head (or a temporary storage tank at the well head) directly to a
storage/battery/upgrader site for processing or directly to another well head or other location for disposal;
Driving a vehicle operated under this permit directly between an oil/gas well site or a home terminal of the
permit holder and either:
a repair facility (for maintenance or for a CVIP inspection); or
a cleaning/washing facility (equipped with a specialized wastewater capture/disposal system);
Non-driving work (e.g. in a shop, warehouse, office, etc.) and operating a vehicle registered for 4,500
kilograms or less at one or more locations;
Conducting driver evaluations/re-certifications in a vehicle as long as the duration does not exceed 3 hours.
A copy of the evaluation is to be retained in the drivers file and the time must be noted in both the drivers
and the examiners daily logs.

* The use of this permit can include providing allowed services regardless of whether cargo/goods/persons are
being transported in/on the vehicle. This permit cannot be used for any services or trips other than those listed
above.

* Travelling directly may include making rest stops (no longer than 24 hours) such as at a motel, branch office, etc.
before getting to the final destination (e.g. well site or home terminal).

Services NOT covered by the permit include:
Transporting materials to or from an oil/gas well site that are used to prepare/develop the site itself or the
road leading to the site (e.g. lumber, gravel, etc.);
Transport equipment to or from a well site that is used to prepare/develop the site (e.g. dozers, backhoes);
Transporting supplies, food, or personnel to support the operation of a camp;
Transporting mixed shipments, some to a well site and the rest to another location not covered by the
permit;
Pipeline construction, maintenance or servicing;
Maintenance of vehicles at a well site;
Moving any materials, goods or equipment between two shops, storage yards, or other facilities, neither of
which are an oil well site;
Exploration activities (e.g. seismic work, explosives transport/storage, etc.);
Transportation of petroleum products (e.g. cleaned crude oil, slop oil, produced water, waste sand) away
from a main storage/battery/upgrader site to any other location.
Conducting driver training/evaluation/orientation on a new company driver.

Oil Well Service Vehicle Cycle
Exemption Permit Application

Since January 2007 the Carrier Services Section of Alberta Transportation has been processing
and issuing oil well service vehicle permits under the federal Commercial Vehicle Drivers Hours
of Service Regulations (SOR/2005-313) to members of the oil and gas service industry who are
operating commercial vehicles. This permit contains conditions intended to help balance the
risks associated with allowing drivers to take a minimum of three 24-hour periods off duty every
24 days instead of following Cycle 1 or 2 under Section 63 of the regulations.

Because of the serious nature of this permit, it is expected that all permit holders will take all
steps necessary to ensure they are meeting the specified criteria as summarized below:

have an acceptable fatigue management program in place and is being fully
implemented (minimum program criteria have been specified);
have provided acceptable hours of service and fatigue management training to all
required employees before they operate a vehicle under this permit, and each employees
file updated accordingly (minimum course requirements have been specified);
have provided General Oilfield Driver Improvement (GODI) training (or equivalent)
PLUS training in any other related ENFORM course that would be expected considering
each employees specific job (e.g. if an employee is authorized by the permit holder to
operate vehicles over 15,000 kilograms then they must have completed the GODI course
and ALSO taken any transportation components of the Oilfield Haulers course that apply
to the carriers operation and the drivers job requirements);
fully train all drivers prior to operating under the permit, however, drivers may be on the
Drivers List (as modified from time to time) and not yet have completed the training, as
long as they do not operate under the permit until they are fully trained;
have policies written into their safety program regarding compliance to the permit (a
permit condition included to reduce confusion by carrier staff and ensure continuity given
staff turnover);
have an active and effective monitoring program in place to ensure all drivers are
complying to the federal hours of service regulations and that this program at least meets
the specified expectations of verification frequency, depth, etc. (required by regulation
and attached to the permit);
are complying to all the specified policies on the use of the permit (e.g. exemption
used only to travel directly to or from an oil/gas well site to perform allowed services);
are complying to all other requirements of the federal hours of service regulations
including the daily limits and work shift hours limits; and
are complying with all other conditions specified in the permit itself.

The department may conduct an Inspection on a carrier to confirm compliance to the above
criteria and will take one or more appropriate actions to ensure compliance is achieved by the
permit holder such as:

requiring an action plan to be submitted and deficiencies corrected;
issuing the permit for a short time while the permit holder corrects their deficiencies;
cancelling or not supporting renewal of the permit;

issuing Administrative Penalties for any identified violations (up to a maximum of $10,000
per day) to the permit holder and/or the various drivers;
issuing a Long Form Information court ticket(s) to the permit holder (to a maximum of
$25,000 per violation) and/or to the various drivers (to a maximum of $5,000 per
violation).

Those collisions found to have occurred while operating under this permit must be evaluated to determine if the
collision was preventable on the part of the permit holder and/or their driver(s). Each evaluation must use the
criteria established by the National Safety Council (www.nsc.org). Each evaluation and follow-up action(s)
taken must be fully documented and retained by the permit holder for at least the current year and the following
4 years. Any collision considered non-preventable may be submitted to Alberta Transportation for verification
(see www.transportation.alberta.ca/656.htm). Verified non-preventable collisions will not be used to help
determine the carriers risk associated with operation under this permit.

Section L: Safety Review

Prior to issuance of this permit, the department will determine:

a) Whether this permit application is complete;
b) Whether your vehicles meet the requirements, as defined by this permit, and the services they are
used for;
c) Whether your companys operation of providing services to a well site meets the Departments
policies for issuing such permits; and
d) That the following information is acceptable:
i. the contents of your current Alberta Carrier Profile;
ii. past compliance to safety laws in Alberta or in any other jurisdiction;
iii. the results of an Alberta NSC Audit conducted within the last 3 years;
iv. content and implementation of applicants policies/procedures regarding driver training
on

hours of service compliance and fatigue management principles;
iv. content and implementation of Applicants written policies/procedures regarding the
Applicants compliance to the Hours of Service regulations (including driver compliance
monitoring program) and to all permit conditions;
v. content and implementation of Applicants written policies/procedures regarding
compliance to the permit conditions (including fatigue management principles, etc.) and
vi. any other information the Director considers appropriate.

At the end of this preliminary review, the Director may:

a) Issue the permit for the full year;
b) Issue the permit with a reduced time period,
c) Apply conditions to be satisfied prior to issuing or renewing the permit;
d) Table the application until it is considered complete or Applicant is verified as being in
compliance;
e) Not support issuing the permit due to safety/compliance concerns.

Section M: Permit Policies

Summary of requirements and Permit Policies:

a) Permit Holder must have and maintain an acceptable Carrier Profile (including R-Factor score),
general NSC compliance (including a pass audit score and Fatigue Violation Rate) and permit
compliance (including a pass Permit Inspection score, when available).
b) Only drivers who have been fully trained in all required industry-related courses are authorized to
utilize the permit exemption.
c) All drivers, dispatchers and transportation safety management, operating or responsible for
compliance under the permit, must have successfully complete the specified training in hours of
service compliance and fatigue management.
d) Permit Holder has an effective Fatigue Management program in place that meets the specified
requirements.
e) The hours of service cycle exemption is being used ONLY for allow transportation services
directly to and/or from an oil/gas well facility.
f) The Permit Holder must have and implement a written policy which identifies that they effectively
monitor the hours of service compliance of each driver.
g) The Permit Holder must have and implement specific written policies and procedures identified in
their safety program to ensure that all conditions of the permit are being complied with at all times
and must actively monitor compliance to all permit conditions including documenting the results of
the monitoring.

Credit Card Acceptance Policy Change
The Government of Alberta has changed the process for accepting credit card payments to
protect the security of cardholder data. As of December 31, 2013, Alberta Transportation can
no longer accept credit card numbers in any format by phone, fax, email, or mail. You cannot

The following table provides a summary of the training requirements for anyone authorized, by the holder of an Oilwell Service Vehicle Cycle Exemption permit, to

1) Equivalent courses are acceptable. Equivalencies to specified course learning objectives must be documented and retained, and the instructor(s) must be adequately knowledgeable.
2) Either LDV OR GODI course is acceptable if the driver is authorized to operate only vehicles registered between 4,501 and 5,500 kgs.
3) GODI is considered to be a prerequisite of the Oilfield Haulers course and thus is considered to not share learning objectives.
4) CAODC member companies may use this option if they have implemented CAODCs driver training program (approved by Alberta Transportation) OR an equivalent program that
meets at least the minimum specified standards. If completed, as per the permit requirements, no other industry training is required (e.g. GODI). To meet this standard:
a) Persons must have completed the Heavy Duty training component, obtained a Heavy Duty Training Certificate, completed the Fatigue and Hours of Service training component,
and passed all associated exams; or
b) Persons must have completed the Convoy Training component, obtained a Convoy Training Certificate, completed the Fatigue and Hours of Service training component, and
passed all associated exams.

Minimum Course Criteria for
Hours of Service and Fatigue Management

To ensure that training in hours of service and fatigue management is successful to meet the requirements of the
Hours of Service exemption Permit, it is required that the course Instructor or the Carrier Representative ensure that
the following minimum criteria are met.

A. Course Administration:
Course Duration: minimum of 4 to 14 hours depending on the needs of the company and/or driver(s). If
required by permit or exemption, managers and supervisors should have a minimum of 8 to 14 hours training.
Learning methods: May use self study, classroom, computer CD or on-line, practical exercises, etc.
Material Required: Traffic Safety Act (relevant sections), Federal and/or Provincial Hours of Service
legislation, Application Guide to Federal Regulations (if applicable), sample log, etc.
Instructor and the carrier are required to retain: course date and location, record of class list, individual test
marks, copy of course material delivered and instructors name.
Owner/Operators who have NO other drivers except the owner also need to take appropriate actions to meet
these minimum requirements. This may be done by acquiring and retaining the necessary information and
learning it themselves (e.g. by obtaining the relevant modules from the departments Education Manual).
Although it would not be necessary for the Owner/Operator to write an exam, it would be of value. Information
regarding completion of the training must be added to the owners driver file (e.g. date, material covered, etc.).

C. Evaluation Method(s):
Test participants knowledge of the subject matter taught. The test may be open book but must be written and
quantifiable. e.g.: conduct knowledge test with sample log exercises, etc. (Duration: minimum 1/2 to 1 hour)
Provide the student with results of test and review it (e.g.: return test to student and review areas of concern).
Reissue a second different test, as necessary. Student must retake course if they dont pass a second exam.

D. Issuance of Certificate:
Issue certificates to successful students (pass mark should be at least 80% for any regulatory subject).
Record the results of knowledge testing with the class list and retain the original list and tests for your
records.
Retain a copy of the certificate on the individual drivers file.

Monitoring Driver Compliance
Under the Federal Hours of Service Regulations
This information is an excerpt from Module 24 Daily Log Audits of Alberta Transportations document titled Alberta
Reference Guide for Hours of Service Training Development. This document explains the regulatory requirements of
the federal Commercial Vehicle Drivers Hours of Service Regulations (SOR/2005-313) and can be found on the

Section 87 of these federal regulations states:
87. (1) A motor carrier shall monitor the compliance of each driver with these Regulations.
(2) A motor carrier that determines that there has been non-compliance with these Regulations shall take
immediate remedial action and record the dates on which the non-compliance occurred, the date of issuance
of a notice of non-compliance and the action taken.
Motor carriers are liable for the actions of their employees even if the carrier contends that it did not require or permit
the violations to occur. Neither intent to commit, nor actual knowledge of a violation is a necessary element of
liability. Carriers permit violations of the Regulations by their employees if they fail to have management systems in
place that effectively prevent such violations.
One of the most effective ways to monitor driver compliance is for the motor carrier to conduct an internal daily log
audit that should then be used to verify that the frequency of hours of service violations are being reduced (i.e. the
carriers fatigue violations rate decreases over time).
This daily log audit needs to include the following:
Verify that all drivers have a record for all calendar days
Check all drivers to ensure that drivers apply the Regulations to all roads, both public and private (forestry
roads), as well as waterways (ferries) in Canada
Check all drivers for all form and manner compliance (i.e. name, date, etc.)
Check all drivers in detail at least once a year for fatigue-related violations (i.e., driving over hours, two
logs for 1 day, false logs, etc.)
Have written policies in their Safety program that address the following:
Use independent (i.e., that the driver does not create or can modify) supporting documents to
verify logs (e.g. fuel receipts, tach cards, bills of lading with shipping times, etc.)
Check new drivers / dispatchers / safety staff more frequently until carrier is satisfied that they
understand the rules
Check drivers / dispatchers / safety staff with previously identified problems more frequently until
carrier believes they now are following the rules
Check a random percentage of all drivers / dispatchers / safety staff at least monthly (e.g. 10% of
drivers monthly will ensure all drivers are selected at least yearly)
Record dates on which non-compliance occurred and record date that the motor carrier issued a
notice of non-compliance
Identify who is responsible for performing these checks, preparing the summary reports, taking
actions, etc. and ensure that these employees have the necessary skills and knowledge
Address all identified deficiencies with individual staff, taking appropriate actions (e.g. re-training
or discipline) and documenting the actions taken in the staff's file
Prepare a summary report at least monthly of the findings of this internal audit, the corrective
actions taken; provide this report at least to carrier's senior management; and retain all such
reports for at least 6 months (longer is recommended)
It is the motor carriers responsibility to ensure that the all drivers, including new drivers, comply with the Regulations.
If the motor carrier cannot obtain copies of the daily logs from the previous carrier, at the very least, the motor carrier
should obtain a signed statement from the driver that specifies the total on-duty and off-duty hours for the previous 14
days.
