What if someone un-intentionally forgot the niyyat in Namaz?

What is the ruling of the learned Ulama in the following case: A person stood up to pray Zuhr Salaah and after reading the four sunnats, he un-
intentionally made the niyyat for four sunnats again, whereas he had to read four fard After completing two ra!aats of Sunnah Namaaz, he realized
that he should ha"e #een performing $ard Namaaz %e thus made the intention of $ard in his heart &at this stage', that () am performing $ard* %e
regarded the first two as #eing read as Sunnah #y mista!e and thus only read Surah $aateha in the second two ra!aats with the intention of it now
#eing a $ard Namaaz Now, in the said case, is his Namaaz $ard or Sunnat Namaaz?
+he Answer: +his Namaaz is neither regarded as $ard nor Sunnat )t is not regarded as $ard, since he had not made intention for $ard in the first two
ra!aats and after doing the actions of $ard, there is no #asis for &changing the' intention , -./0 123 4 53 67849: ;<5= 67>3?@49A./0@B/0 1C )t is in Durr-e- Eu!htar
that there is no #asis of intention afterwards and this is #ased on our Eadha#
)f in reading the last two ra!aats, he did not ma!e the intention of $ard in the third ra!aat at the time of the first ta!#eer, then the intention itself is
meaningless
)f he made the intention at this time, then he has gone from the first intention towards the $ard )f he had completed the four ra!aats in this way, then
the $ard would ha"e #een done Since #y doing what he did, he terminated the initial two ra!aats and thus this too will not suffice for the Namaaz
#eing $ard Namaaz
)t is in Durr-e-Eu!htar as followsF +he Namaaz #ecomes in"alidated #y going from one Namaaz into another Namaaz, which is contrary to the first
Namaaz )t is stated in Shaami that it is li!e when a person ma!es intention in the heart with the ta!#eers to lea"e and enter into the related
+he Author of Nahr has stated that it is the eGample of a person who read one ra!aats of Zuhr Namaaz and then &suddenly' started his Asr Namaaz or
it is li!e he suddenly started Nafil Namaaz with the ta!#eer
According to the Shai!hain, if he is Saahi#-e-+artee#, then he is commencing Nafil According to )mam Euhammad either there is difference of opinion
or the Namaaz did not ta!e place
)f it was ended due to shortage of time or #ecause of eGcessi"eness, then it is fine for him to start Asr, #ecause he has made intention to attain that
which he is not already in %e has thus come out of the first Namaaz +he coming out of the first Namaaz is #ased on the condition of commencing
another Namaaz #eside the first e"en if the change was for a reason*
As for the issue of the sunnat not ta!ing place, then this is clear that he had already read the sunnats and e"en if he made the intention for fard in the
third ra!aat or any other ra!aats at the time of its first ta!#eer, then too, the sunnat would ha"e not #een "alid, since he has mo"ed towards $ard
Namaaz #ased on his intention )t must #e thus concluded that these ra!aats &which he read' will #e regarded as Nafil H230 1 4IJ K0L
