Please be advised that I have reviewed all documents submitted to this office regarding
the above-referenced incident as well as two additional e-mails with attachments forwarded from
Kimberly R. Beem and submit the following as the official position of this office relative to any
possible criminal charges.

In reviewing the totality of the circumstances as reflected in all the documents presented,
the following charges were considered. These charges were considered only out of a sense of
completeness and based upon the expressed desires of the parties. The mere fact that these
charges have been considered does not, in and of itself, lend any further credence or credibility to
such allegations beyond that addressed herein.

vs. Kimberly R. Beem: Disorderly Conduct
Menacing/Aggravated Menacing
Domestic Violence

vs. Alyson Beem: Disorderly Conduct
Menacing/Aggravated Menacing
Domestic Violence
Falsification

vs. Dep. Ashley Murphy: Falsification


Upon consideration of the allegations presented and after significant deliberation, it is the
opinion of this office and the undersigned that there is insufficient credible, admissible evidence
to establish probable cause which might warrant the filing a complaint(s) alleging any of the
offenses set forth above. Equally important, there is insufficient credible, admissible evidence to
establish proof beyond a reasonable doubt necessary to sustain a verdict of guilty at trial on any
of the listed charges.

And finally, while my opinion in this regard was not specifically solicited, it is my
professional opinion that the allegations of impropriety, unprofessional conduct, and/or
falsification raised by Kimberly R. Beem against Dep. Ashley Murphy and/or Sgt. Tim Tyo are
completely and totally without any quantum of merit whatsoever.

Please find attached all documents previously forwarded to this office for review. Given
our review and rejection of any possible charges, this office considers the matter and all issues
surrounding Incident Number 11421-10 to be closed and neither the undersigned no any member
of the legal staff of this office will have further involvement in consideration of this matter.
Because I have received e-mail correspondence directly from Ms. Kimberly R. Beem, I will be
providing Ms. Beem a copy of this Memorandum by e-mail so that she will be aware of this
status of this case vis--vis this office.
