Dear Ms. Allen:
I a pleased to report to you that the parties in this matter have reached a written and signed
memorandum of understanding to settle this case, as a result of the mediation yesterday.
Payment is, under that memorandum of understanding, due in 30 days. We are still in need of
formal release documents, etc. Our joint proposal to the Court is for the Court to cancel the
oral argument currently set for October 7, 2014. As soon as the settlement is flly
consummated, we will report this fact to the Court in writing and take approptiate steps to
have the matter formally dismissed. We very much appreciate the Court's agreement earlier to
move the oral argument so the parties could have their mediation, which involved some
logistical challenges with schedules of folks, etc. We wanted to get this letter to you as soon
as possible so the Court need not waste its time reviewing briefing and undertaking other WQrk
on this matter. Thank you again, and please confm for us if you would that the oral
argument set for October 7, 2014 has in fact been cancelled.
