This Memo is to inform you of an incident on January 19
th
, 2014. While Tommy Bolack
was riding with me on the graveyard shift I happened upon a car crash that turned into a
DWI arrest. During the investigation Tommy failed to stay by the truck as I have often
instructed him to do on traffic incidents. After I concluded my investigation and placed
the suspect, Ryan Blackwater under arrest, I began preparing a tow inventory form. I
noticed that Tommy was searching the interior of the suspect vehicle. Because my camera
was recording I tried to be as tactful as possible and told Tommy that I needed him to
watch the suspect as my patrol truck does not have bars on it.

On March 5
th
, 2014 I attended an MVD hearing in reference to this case (14-2206). Prior
to the hearing the defendants attorney, Nick Cullander, spoke to me briefly about the
case. He requested a plea agreement and casually inquired about Tommy and his role at
the Sheriff's Office. While Mr. Cullander did not raise any specific concerns I was
uncomfortable with the situation as Tommy had conducted a search without
authorization and it was on video. I was abliged to support the proposed plea
agreement as I did not want Tommy on the stand as a witness in this case or any of my
cases for that matter.

While I do not doubt that Tommy means well he seems to believe that he has sufficient
training to participate in Police work more than he actually should. Merely being
present at training and not demonstrating proficiency is not sufficient for me to be
comfortable with him as anything more than a civilian ride along. Because he routinely
does not follow instructions, demands an explanation nearly every time I tell him to stay
in the truck, and routinely expresses a desire to participate in use of force incidents it is
apparent to me that he will never settle for being a civilian ride along. On top of that,
as documented above, his activities are beginning to have an effect on the outcome of

my cases. I take great pride in my cases and this is unacceptable to me. For these
reasons I ask that Tommy not be aloud to ride along with me on shift any more.
