17 EMPLOYEE ELECTRONIC INFORMATION RESOURCES ACCEPTABLE
USE POLICY
4.17.1 Condition of Employment
A. Acceptance of and an agreement to abide by the Employee Electronic Information Resources Acceptable Use Policy constitutes a condition of employment by the Tooele County School District. All employees are subject to the terms and conditions of this policy and implicitly agree to abide by its terms by accepting or continuing in the employment of the Tooele County School District.
B. Each employee shall receive information regarding this acceptable use policy on an annual basis. New employees shall receive information regarding this policy within 30 days of the first day of employment. Each employee must provide a signature verifying receipt of the Employee Information Resources Acceptable Use Policy, and failure to provide this signature verification shall constitute insubordination and will be grounds for termination.
4.17.2 Scope
A. Electronic information resources include but are not limited to telephone voice and facsimile services; video recording or replay systems; voice mail or other messaging systems; E-mail; Internet access; printing, scanning, and copying devices; data storage devices; information processing devices; and network files and accounts. These resources are provided to employees to promote excellence and efficiency in the workplace by facilitating improved student instruction, increased access to information, more convenient and effective communication, and to promote innovation and cooperation,
B. World-wide access to computers and people made possible by these electronic information resources may involve the availability of materials, images, or information that are illegal, considered to be inappropriate, or of no professional or educational value. At its sole discretion, the District may employ any filtering devices or other controls and precautions to restrict access to material it deems inappropriate. The District has unrestricted authority to make judgments about the usefulness, value, legality, or appropriateness of materials that may be accessed using District electronic information resources.
C. The District does not have control over the content which may be available through electronic information resources. While the District may take precautions to restrict access to inappropriate or illegal content, employee access to any inappropriate or illegal materials that may occur despite District precautions is a violation of this policy.
D. The District has no responsibility or liability for any damage or harm that an employee may suffer through his or her use of electronic information resources that are in violation of this policy. These damages include but are not limited to loss of data, reliance on inaccurate information retrieved via electronic information resources, delays in transmission or receipt of data or materials, or service interruptions, regardless of the cause. The District specifically is not responsible for the accuracy of information obtained through electronic information resources.
E. It is not the intent of the District to place unreasonable restrictions on employees who may use District electronic information resources for reasonable and limited personal communication. This policy shall not be construed to prohibit such occasional and reasonable use. However, extensive use of District electronic information resources for private or personal business is prohibited, and judgments regarding what constitutes occasional and reasonable use are reserved entirely to the District.
4.17.3 Restrictions on the use of District electronic information resources
A. The use of electronic information resources is provided to employees at the Districts discretion. The District may restrict or prohibit the use of electronic information resources by any employee based on reasonable suspicion of inappropriate use or other violation of this policy.
B. Inappropriate use of District electronic information resources may result in disciplinary action up to and including termination, and/or referral to appropriate legal authorities. A principal, supervisor, or network administrator may limit, suspend, or revoke access to electronic information resources at any time.
C. The use of an assigned electronic information resource or account must be in support of the educational or operational purposes and objectives of the District. Each employee is responsible for this provision when using District electronic information resources.
D. Employees may be assigned passwords or user ID that provide for access to District electronic information resources. Employees who receive a password or user ID are responsible for any and all use of District electronic information resources that occurs under their password or user ID. Failure to maintain the confidentiality of a password or user ID is a violation of this policy. Employee use of any password or user ID not specifically assigned to the employee is prohibited
E. Recording, replaying, creating, transmitting, downloading, copying, or receiving of any inappropriate materials, images, or information in violation of law or District policy is prohibited. This includes, but is not limited to, illegal use, copying, or transmission of copyrighted material or images; threatening, profane, or obscene material, images, or information; material protected as a trade secret; material, information, or images pertaining to the design, use, or construction of explosive devices; materials, images, or information relating to or supporting criminal activities, terrorist acts, sexism, sexual harassment, racism, or hazing; pornographic materials, images, or information; gambling; illegal solicitation; use for financial gain; and political lobbying unless approved by the Superintendent. Attempts to transmit or receive material, images or information prohibited by this policy shall be considered to be the same as actual transmission or receipt.
F. Any employee who creates information or material that may be accessed by electronic information resources must abide by District publishing guidelines. These include informing the employees supervisor of the publication, receiving permission to publish the materials or information, and providing the supervisor with copies of any publication. Illegal or inappropriate publishing activities or uses of any kind that do not conform to the rules, regulations, or policies of the District are prohibited.
G. Vandalism through the use of District electronic information resources is prohibited. Specifically, vandalism or any other malicious attempt to harm or destroy the property, data, or materials of any other user of the District network, the Internet system, or other District electronic information resource is prohibited. Vandalism includes, but is not limited to, purposely overloading a network, downloading or creating a computer virus, or intentionally disrupting services.
4.17.4 District monitoring of use of electronic information resources
A. The District may, at its sole discretion, monitor the use of District electronic information resources by employees. This includes monitoring and tracking internet and email use, tracking telephone voice and facsimile use, and monitoring and tracking computer use. The District may use any legal means to gather information relating to employee use of District electronic information resources that it deems appropriate.
B. Employees have no expectation of privacy regarding the use of District electronic information resources other than that provided by state and federal law. Any data created or stored in any District electronic information resource is considered District property except as provided for by state and federal law. Specifically, records of internet access, use of school or District computer and telephone networks and email are District information and may be used in the application and enforcement of this policy.
C. All records created or maintain under this policy which relate to an individuals use of District electronic information resources shall be considered private records under the provisions of the Government Records Access and Management Act of 1992 (63-2-101 through 63-2-909 U.C.A) and shall be subject to all the provisions of that Act.
