6 1. In April 2014, this Court entered its Order of Referral For
7 Examination By Qualified Medical Expert in connection with the above-referenced
8 matter, which originated with a Petition of the Northern Nevada Disciplinary
9 Board requesting that attorney Zachary Coughlin ("Coughlin"), Bar No. 8789, be
10 transferred to disability inactive status pursuant to Supreme Court Rule 117
11 (Proceedings when an attorney is declared to be incompetent or is alleged to be
12 incapacitated).
13 2. The Office of Bar Counsel ("OBC") subsequently located a Reno
14 psychologist, Earl Nielsen, Ph.D. ("Dr. Nielsen"), who conducts psychological
1 5 examinations. Dr. Nielsen agreed to evaluate Coughlin, and directed the OBC to
16 contact Coughlin and have him personally make an appointment.

1 3. In a Supplemental Report of Bar Counsel, which was submitted on or
2 about July 22, 2014, the OBC informed this Court that Coughlin had scheduled an
3 appointment with Dr. Nielsen for July 25, 2014. Accordingly, it appeared that
4 Coughlin was attempting to participate in the psychological examination which
5 was ordered by this Court.
6 4. Assistant Bar Counsel is hereby updating this Court regarding the
7 status of this matter since its last report.
8 5. Throughout the month of August 2014, Laura Peters ("Peters"), the
9 OBC's paralegaVinvestigator in Reno, left several messages with Dr. Nielsen
10 requesting an update of Coughlin's matter. The OBC has learned that Peters'
11 messages went unanswered because Dr. Nielsen was not in Reno for much of the
12 last month.
13 6. However, he ultimately did contact Peters and confirmed that, in fact,
14 he has evaluated Coughlin. Dr. Nielsen said that he expected to provide his written
15 report regarding Coughlin to the OBC by September 12, 2014, and also will bill
16 the State Bar for his services.

1 7. Upon receipt of Dr. Nielsen's report, the State Bar shall forward it
2 immediately to this Court for its consideration.
