RECOMMENDATION:
Authorize the City Manager or his designee to execute all necessary documents to
participate in the California Public Safety Procurement (CPSPP) Program for the 5-year
period from July 31, 2014 to July 30, 2019. (Citywide)
DISCUSSION
The Secretary of Defense (Secretary), through the Federal 1033 Excess Property Program, is
authorized to transfer excess property to Federal and State agencies that the Secretary determines
is suitable for law enforcement activities under such terms prescribed by the Secretary. The
Governor of the State of California has designated the California Office of Emergency Services (Cal
OES) to implement the 1033 Program statewide, as well as conduct management and oversight of
this program through the California Public Safety Procurement Program (CPSPP).
Under the direction of the Chief of Police, program approval allows for specified personnel of the
Police Department (PO) to access, request, and acquire excess property through the CPSPP.
Authorization must be renewed on an annual basis, and is subject to periodic audits by the Defense
Logistics Agency (DLA) on behalf of the Secretary.
Since 2005, through this program, PO has received a surplus 26-foot Boston Whaler boat and
trailer, Ford diesel pickup truck, and tactical equipment used to support existing operations. City
Council approval is requested to continue participation in the CPSPP Program for the 5-year period
from July 31, 2014 to July 30, 2019. If approval is not granted, equipment secured must be
returned to the DLA or transferred to another CPSPP certified law enforcement agency within sixty
(60) days.
This matter was reviewed by Deputy City Attorney Kendra Carney on August 27, 2014, and by
Budget Management Officer Victoria Bell on August 26,2014.

TIMING CONSIDERATIONS
City Council action on this matter is requested on September 9, 2014, to comply with Cal OES and
DLA audit requirements.
FISCAL IMPACT
There is no cost to continue participation in the California Public Safety Procurement (CPSPP)
Program. In the event the Police Department (PD) requests surplus property through the program,
costs associated with the acquisition, transfer, licensing fees, maintenance costs, permits, and/or
repossession of CPSPP property will be the responsibility of the PD. Costs for program
administration to comply with the reporting requirements of the CPSPP are budgeted in the
General Fund (GF) in the Police Department (PD). There is no local job impact associated with this
recommendation.

Approve recommendation.
