PETITIONERS MOTION TO RECONSIDER
Comes now the petitioner, pro se, requesting This Court reconsider the denial of
further relief in this matter which has been remanded from the Court of Appeals.
Petitioner is in receipt of the States proposed order which was drafted per This
Courts direction. It was agreed in open court that the order would include the
Courts fndings of facts and conclusions of law. It was further agreed that the order
would be drafted and submitted to the Court with the necessary language to be
considered fnal upon signature of the Court. It was further agreed that the order in
question would not be an agreed order requiring Petitioners signature.
Petitioner respectfully requests reconsideration based upon the confict between the
proposed order and well established rule of law. Petitioner perceives the confict as
follows:
1)The State has made no formal or informal request for This Courts
intervention which would properly bring this matter before the Court.
2) This Courts jurisdiction over Petitioner was vacated by the Appeals Court
and the record will show that This Court never properly acquired or exercised
jurisdiction over Petitioner.
3)Neither the State nor This Court were parties to the Chancery Court
proceedings and have no standing to request or order relief.
4)The Chancery Court child support Order was not a Title IV D case and if it
had been the proper venue to seek relief would have been in the Chancery
Court.
5)Neither the State nor This Court have standing to retain funds paid by
Petitioner pursuant to a vacated Order. The Appeals Court vacated the entire
proceeding leaving these proceedings wanting of due process.
