5. -hat the -rainee Cemployee shall undergo the training pro2ided by the igam
for a
period of one year, 'hich may be e3tended at the discretion of the igam)during
'hich period
the -rainee.employee shall diligently, faithfully and to the best of his)her ability
undergo the training and conduct and beha2e himself)herself honestly, orderly
and obediently to'ards
his)her superiors and management of the igam and 'ill de2ote his)her 'hole
time to the
duties assigned to him )her by the igam and 'ill not engage directly or
indirectly in any
trade, business or occupation till the end of the period for 'hich he)she is bound
to ser2e the
igam.
<. -hat the -rainee Cemployee shall not lea2e the igam during the prescribed
training
period of one year 'hich may be e3tended at the discretion of the igam or
during the period
of ser2ice of the igam for the stipulated period of three years after completion
of the
training e3cept for reasons of continued serious ill.health) incapacitating
him)her to 'orA
pro2ided that such ill health has not been brought about by his)her o'n neglect
, carelessness,
design or misconduct about 'hich the decision of the igam shall be
conclusi2e and binding.
D. -hat the -rainee Cemployee shall promptly obey his)her superiors and comply
'ith
their orders, instructions issued from time to time and at all times and in all
respects shall
faithfully obser2e all the *ules and *egulations of the igam.
E. -hat the -rainee Cemployee shall obser2e secrecy and )in no 'ay di2ulge or
disclose to
any person or persons 'hatsoe2er, the secrets entrusted to him)her or coming to
his)her
Ano'ledge in the course of his)her training and ser2ice 'ith the igam either in
relation to its
'orAs, business or its customers.
9. -hat the -rainee Cemployee shall not commit or cause to be committed any
'aste,
!amage, or other injury to the property and)or goods of the igam nor shall
he)she lend any
such property or goods to any person 'ithout the permission of the
management of the
igam.
@. -hat the -rainee Cemployee shall not participate in political acti2ities nor
shall become
a member of political organi>ations.

6. -hat if the -rainee.&mployee fails to complete his)her training successfully
and)or
ser2e the igam for the stipulated period of three years thereafter, the -rainee.
&mployee and
the Surety undertaAing that they shall jointly and se2erally compensate the
igam for all the
e3penses incurred by it on account of and in connection 'ith his) her training.
-he
e3penditures incurred by the igam on account of and in connection 'ith the
training of the
-rainee Cemployee shall include the stipend ,-.A. etc. paid the -rainee.employee
during the
training period, the cost of super2ision, o2erhead and other direct and indirect
e3penses
incurred by the igam on the training. -he decision of the chairman.Cum.

);eneral %anager or an oFcer nominated by the competent authority shall be

binding as to the total amount of e3penditure incurred by the igam on account
of and in
connection 'ith the training of the -rainee.&mployee. Ho'e2er, the total amount
reco2erable
under this Clause shall not e3ceed *s. 97,777) or <9,777). only as the case may
be. :urther the
-rainee.&mployee shall on the termination of his)her training)ser2ice by the
igam or on
his)her lea2ing the said training)ser2ice 'hene2er it may happen account for,
pay and
peacefully deli2er to the igam all the stocAs in trade)booAs of accounts,
documents, papers
and a=ects then in his)her possession and custody and belonging or relating to
the igam.
G. -hat at the end of the stipulated and e3tended period of training, as the case
may be,
the suitability of the abo2e -rainee.employee for employment in the ser2ice of
the igam
'ill be e2aluated by the Competent Authority of the igam on the basis of
his)her
performance during the period of training and the decision of the Competent
Authority of the
igam in this regard shall be 1nal and binding on the -rainee.employee and the
Surety. Hn case the -rainee.&mployee despite due opportunity to impro2e
himself)herself
during the initial or e3tended period of training, fails to complete the training
successfully,
he)she 'ould be liable to reimburse to the igam the e3penses incurred by it as
detailed in
Para 6 abo2e.
8. -hat if in the opinion of the Competent Authority of the igam, the trainee
employee
has successfully completed the training, the -rainee.&mployee shall be bound to
accept the
employment of the igam and shall continue to be in the employment of the
igam at its
discretion in any subsidiary of the igam or in any department or any
undertaAing of the
;o2ernment of Hndia, for a period of three years thereafter, unless his)her
ser2ices are dully
terminated by the igam before that period.

any breach on his)her part to comply 'ith any of the terms and conditions of the

*egulations of the igam for the time being in force and)or any concealment of
any disease

appointment, in

liable to reimburse to the igam the e3penditure incurred on account of and in
connection
'ith the training imparted to the -rainee.&mployee as pro2ided hereinbefore
under this Bond.
-he said Surety in his indi2idual and personal capacity hereby undertaAes and
guarantees to
pay to the igam, on demand, the e3penditure incurred on the account of and in
connection
'ith the training of the -rainee.&mployee as detailed in Para.6 abo2e, in case the
-rainee.
employee commits breach of any of the terms of and conditions of this Bond or
the training
scheme of the igam. -he said surety further agrees that the igam at its
discretion shall be entitled to enforce this bond against the surety as a Principal
!ebtor in 1rst instance, 'ithout
proceeding against the trainee.&mployee and not 'ithstanding any amounts
'hich may be
payable by the igam to the -rainee.&mployee.
5<.-hat for matters not pro2ided for in this Ser2ice Agreement Bond, the
-rainee.
&mployee shall be go2erned by the o=er of appointment and *ules and
*egulations of the
igam in force from time to time.
5D. -hat the igam, ho'e2er, may at its discretion alter, interrupt or terminate
the
training in the e2ent there are ad2erse reports regarding the progress of training
or health of
the -rainee.&mployee 'ithout thereby incurring and liability to the -rainee.
&mployee.
5E. -hat the abo2e -rainee.&mployee and Surety further agree that if the
-rainee.
&mployee lea2es training or ser2ices of the igam before the e3piry of the
stipulated period of
training and ser2ice, thereafter, he)she and the Surety 'ill not only be liable to
reimburse to
the igam the e3penses incurred by it on account of and in connection 'ith the
training, but
'ill also be re?uired to gi2e one month ad2ance notice or pay further amount
e?ui2alent to
one month salary last dra'n in lieu of notice, in terms of the o=er of
appointment.

59. -hat after completion of three years ser2ice, if the -rainee.&mployee 'ants
to lea2e
ser2ice of the igam then he)she shall gi2e one month ad2ance notice to the
igam, failing

one month
salary.
5@. -hat in the e2ent of insol2ency, lunacy or death of the Surety, the abo2e
bounden
-rainee.&mployee undertaAes to intimate the igam of the e2ent 'ith
satisfactory proof
thereof 'ithin 59 days of the occurrence, and shall e3ecute a fresh bond 'ith a
fresh Surety or
Sureties as may be acceptable to the igam, 'ithout prejudice to the rights of
the igam to
proceed against the original Surety or his estate.
56.-hat in case the -rainee.&mployee does not comply 'ith the terms and
conditions
contained in the o=er of appointment, the *ules and regulations of the igam
and the
co2enants contained in this Bond, the -rainee.&mployee and his Surety
undertaAe that they
shall jointly and se2erally pay to the igam on demand 'ithout any demur the
amount
demanded by the igam to'ards the e3penses incurred by it on account of and
in connection
'ith the training of the -rainee.&mployee including Salary, -A)!A, passage fare,
cost of
super2ision, o2erhead charges, direct and indirect charges incurred by the
igam, pro2ided
that the total amount reco2erable on account of and in connection 'ith the
training shall not
e3ceed *s. 97,777). and *s.<9,777). as the case may be plus an amount
e?ui2alent to three
months salary in lieu of notice period, if any, as per o=er of appointment
applicable and any
other amount that may be due to the igam on account other payment or on
other accounts, if
