*. Subscriber;s "es%onsibility
The subscriber has the following res%onsibilities for the %ro%er installation, o%eration an$
maintenance of the service re5ueste$
#nsure an$ un$ertake that the Service installe$ shall be use$ for .D(*4*ST".T*<# P,"P-S#S
-4=>. Thus the subscriber agrees not to lease or sublease the Service, use the Service to
%rovi$e e5uivalent or similar service to any thir$ %arty for whatever %ur%ose, or %ermit the
use of the Service by any thir$ %arty. The subscriber shall $isallow the connection,
$isconnection, movement, an$&or alterations of any an$ all P=DT instruments or facilities by
%arties other than those $uly authori:e$ by P=DT.
4ot use nor allow the use of the Service as a means of %rovi$ing telecommunications
services to the %ublic or for the resale of national or international tra1c.
Disallow the use of the Service in by%ass activities or the con$uct of any activity that ten$s
to by%ass the PST4 of P=DT or be use$ in %rohibite$ activities such as callback, $ial back,
unauthori:e$ au$io te)t, *nternational Sim%le "esale ?*S"@ an$ other similar services
?collectively, the AProhibite$ .ctivitiesB@. <iolation of this %rovision will authori:e P=DT to
imme$iately $isconnect the facilities *nterconnecting the =an$line Plus Service to P=DT;s
network an$ terminate the service without incurring liability on the %art of P=DT. Such
$isconnection shall not relieve the subscriber from any un%ai$ obligations accruing %rior to
the $isconnection or from any liability to P=DT as a conse5uence of such violation.
P=DT shall be entitle$ to a by%ass com%ensation fee on account of any of the Prohibite$
.ctivities. *n case of violation of this %rovision, u%on $eman$, P=DT shall be entitle$ to a
by%ass com%ensation fee %lus a$$itional %enalty of 60C thereof ?the ATotal Dy%ass
0om%ensationB@. The Total Dy%ass 0om%ensation is %ayable, without any limitation from the
time the Prohibite$ .ctivities occurre$ or was $iscovere$ by P=DT, whichever is earlier, until
the actual cessation thereof. *n a$$ition, P=DT shall, u%on $iscovery of the Prohibite$
.ctivities, have the right to full access to the relevant books an$ all other recor$s of the
subscriber in or$er to ascertain the volume of tra1c an$ total amount of the Total Dy%ass
0om%ensation. *n the absence of recor$s, P=DT shall have the sole $iscretion in the
$etermination of the Total Dy%ass 0om%ensation.
The Subscriber agrees to be solely res%onsible for any security breach such as, but not be
limite$ to hacking, in8house frau$, unauthori:e$ call forwar$ing, or illegal connection through
house cable wire ta%%ing, that may aEect the Service, an$ agrees to be liable for all charges
accruing as a result of such breach.
The Subscriber shall likewise be liable for any unauthori:e$ calls that may arise from availing
of an$&or activating the s%ecial features of the Service.
Subscriber shall e)ercise $ue care in the han$ling of P=DT;s e5ui%ment. .ny $amage to or
$eterioration to P=DT;s e5ui%ment, other than those $ue to or$inary wear an$ tear, shall be
for the sole account an$ res%onsibility of the Subscriber.
The Subscriber shall %ermit $uly authori:e$ P=DT %ersonnel to enter or leave the
Subscriber;s %remises at all reasonable hours or at such fre5uency as may be necessary for
the %ur%ose of installing, ins%ecting, maintaining, an$& or removing its instruments an$
facilities in connection with the Service.

"ates shall be subFect to revisions as authori:e$ by the 4ational Telecommunications
0ommission ?4T0@ from time to time. .ny increase or $ecrease in the authori:e$ rates shall
automatically revise the current charges on the $ate such increase or $ecrease took eEect.
Payment of charges shall be in accor$ance with P=DT;s rules an$ regulations $uly a%%rove$
by the former Public Service 0ommission an$ any future amen$ment or su%%lement as the
4T0 shall a%%rove.
The charges 5uote$ hereun$er shall be e)clusive of a%%licable <alue .$$e$ Ta)
?<.T@&-verseas 0ommunications Ta) ?-0T@. .%%licable ta)es may a%%ly for services %rovi$e$
by foreign carriers ?.%%lies to international services only@.
***. Payment Terms
P=DT has the o%tion to %rovi$e the Subscriber with the bill in either of the following means
electronic mail, 0D or %rinte$ an$ sent through courier or mail.
,%on recei%t of the bill as aforementione$, the Subscriber shall %ay the charges within the
sti%ulate$ $ue $ate as in$icate$ in the bill. *n cases of $is%ute$ charges %ro%erly a$vise$ in
writing by the Subscriber, the Subscriber agrees an$ un$ertakes to %ay, within the %erio$
re5uire$ herein or %ertinent laws, rules an$ regulations, the amounts not $is%ute$. P=DT
reserves the right to $iscontinue %rovi$ing the Service for non8%ayment of charges not un$er
$is%ute.
*<. 0ontract Perio$
0ontract term is minimum of one ?1@ year&s from the $ate of activation of the service. *f P=DT
$oes not receive any written a$vice from the Subscriber at the en$ of the contract $ate, the
contract shall be automatically renewe$ for another year un$er the same terms an$
con$itions.
<. Pre8termination of 0ontract

*n the event that the Subscriber %re8terminates this .greement without cause or for cause not
attributable to the fault of P=DT, such %re8termination shall not relieve the Subscriber from any
monetary obligations accruing %rior to the %re8termination.
<*. Disconnection of Service
P=DT have the right to $isconnect the service without incurring any liability whatsoever in the
following cases
P=DT shall $iscontinue the =an$line Plus Service $ue to non8%ayment of over$ue
accounts. P=DT reserves the right to automatically bar access to toll services for non8
%ayment of the allowable toll charges without %reFu$ice to the e)ercise of other reme$ies
un$er e)isting law, rules an$ regulations.
P=DT may refuse to %rovi$e the Service to any subscriber or %remises, or $iscontinue the
same if it $etermines that the subscriber is not actually taking service at the %lace of
installation or when necessary to %rotect itself against abuse or frau$.
P=DT may $iscontinue %rovi$ing the Service if a Subscriber fails to com%ly with any of the
terms an$ con$itions herein.
P=DT reserves the right to $iscontinue the Service for failure of the Subscriber to %ay bills not
un$er $is%ute.

P=DT shall not have any liability whatsoever or be $eeme$ to be in $efault for any $elay or
failure in %erformance un$er this .greement resulting from acts beyon$ its control, inclu$ing
without limitation acts of Go$, acts of regulations of any governmental or su%ranational
authority, war or national emergency, acci$ent, Hre lightning, riot, strikes, lock8outs,
in$ustrial $is%utes ?whether or not involving P=DT;s em%loyees@ or e%i$emics.

*I. <iolation of the .cce%table ,se Policy
The use of the Service for any activity that is contrary to morals, customs or %ublic %olicy or
which violates any or$inance, law, $ecree, or$er or regulation, or aEects, interferes with or
$isru%ts the use of the Service by other %arties or the manner by which P=DT %rovi$es the
Service or any other services shall be $eeme$ ina%%ro%riate behaviour an$ shall be
consi$ere$ as a violation of the acce%table use of the service un$er these Terms an$
0on$itions.
P=DT reserves the right to investigate sus%ecte$ violations of these Terms an$ 0on$itions,
inclu$ing the gathering of information from the user or users involve$ an$ the com%laining
%arty, if any, an$ the e)amination of any information on P=DT;s servers an$ network.
*f the Subscriber is foun$ to have violate$ any of the %rovisions of these Terms an$
0on$itions, P=DT shall, among others, have the right either to $isconnect the Service.
