Facts
Cantre accompanied by Saano crossed paths with Bulalacao, who was then with Calimutan.
Bulalacao and Cantre were not in good terms, so when they came closer, Cantre punched Bulalacao. As
Bulalacao ran away, Calimutan picked up a stone and threw it to Cantre who was hit at the back of his
head. Shortly after the incident, Cantre got home and eventually died.
Calimutan was found guilty of Homicide.
Issue
Whether or not the petitioners act of throwing a stone, which caused the death of Cantre,
qualifies as homicide.

Ruling
Calimutan was only proven guilty of reckless imprudence resulting in homicide, because his act
of throwing the stone was only done with the intent to inflict pain.
