LAIK UDARA apabila pesawat udara tersebut
sesuai dengan rancang bangun (type design) dan
aman untuk dioperasikan

BAB VIII
KELAIKUDARAAN DAN PENGOPERASIAN PESAWAT
UDARA
Bagian Kesatu
Kelaikudaraan Pesawat Udara
PASAL 34
(1) Setiap pesawat udara yang dioperasikan wajib
memenuhi standar kelaikudaraan.
(2) Pesawat udara yang telah memenuhi standar
kelaikudaraan sebagaimana dimaksud pada ayat
(1) diberi sertifikat kelaikudaraan setelah lulus
pemeriksaan dan pengujian kelaikudaraan.
PASAL 35
Sertifikat Kelaikudaraan sebagaimana dimaksud
dalam Pasal 34 ayat (2) terdiri atas:
a. sertifikat kelaikudaraan standar; dan
b. sertifikat kelaikudaraan khusus.
PASAL 36
Sertifikat kelaikudaraan standar diberikan untuk
pesawat terbang kategori transpor, normal, kegunaan
(utility), aerobatik, komuter, helikopter kategori
normal dan transpor, serta kapal udara dan balon
berpenumpang.
PASAL 37
(1) Sertifikat kelaikudaraan standar sebagaimana
dimaksud dalam Pasal 36 terdiri atas:
a. sertifikat kelaikudaraan standar pertama (initial
airworthiness certificate) yang diberikan untuk pesawat
udara pertama kali dioperasikan oleh setiap orang; dan
b. sertifikat kelaikudaraan standar lanjutan (continous
airworthiness certificate) yang diberikan untuk pesawat
udara setelah sertifikat kelaikudaraan standar pertama
dan akan dioperasikan secara terus menerus.
PASAL 37
(2) Untuk memperoleh sertifikat kelaikudaraan
standar pertama sebagaimana dimaksud pada ayat
(1) huruf a, pesawat udara harus:
a. memiliki sertifikat pendaftaran yang berlaku;
b. melaksanakan proses produksi dari rancang bangun,
pembuatan komponen, pengetesan komponen, perakitan,
pemeriksaan kualitas, dan pengujian terbang yang memenuhi
standar dan sesuai dengan kategori tipe pesawat udara;
c. telah diperiksa dan dinyatakan sesuai dengan sertifikat tipe
atau sertifikat validasi tipe atau sertifikat tambahan validasi
Indonesia; dan
d. memenuhi persyaratan standar kebisingan dan standar emisi
gas buang.
PASAL 37
(3) Untuk memperoleh sertifikat kelaikudaraan
standar lanjutan sebagaimana dimaksud pada ayat
(1) huruf b, pesawat udara harus:
a. memiliki sertifikat pendaftaran yang masih berlaku;
b. memiliki sertifikat kelaikudaraan yang masih berlaku;
c. melaksanakan perawatan sesuai dengan standar perawatan
yang telah ditetapkan;
d. telah memenuhi instruksi kelaikudaraan yang diwajibkan
(airworthiness directive);
e. memiliki sertifikat tipe tambahan apabila terdapat
penambahan kemampuan pesawat udara;
f. memenuhi ketentuan pengoperasian; dan
g. memenuhi ketentuan standar kebisingan dan standar emisi
gas buang.
PASAL 38
Sertifikat kelaikudaraan khusus diberikan untuk
pesawat udara yang penggunaannya khusus secara
terbatas (restricted), percobaan (experimental), dan
kegiatan penerbangan yang bersifat khusus.
PASAL 39
Setiap orang yang melanggar ketentuan standar
kelaikudaraan sebagaimana dimaksud dalam Pasal
34 ayat (1) dikenakan sanksi administratif berupa:
peringatan;
pembekuan sertifikat; dan/atau
pencabutan sertifikat.
PASAL 40
Ketentuan lebih lanjut mengenai tata cara dan
prosedur untuk memperoleh sertifikat kelaikudaraan
dan pemberian sanksi administratif diatur dengan
Peraturan Menteri.
BAB XXII KETENTUAN PIDANA
PASAL 406
1. Setiap orang yang mengoperasikan pesawat udara
yang tidak memenuhi standar
kelaikudaraan sebagaimana dimaksud dalam
Pasal 34 dipidana dengan pidana penjara paling
lama 3 (tiga) tahun atau denda paling banyak
Rp1.500.000.000,00 (satu miliar lima ratus juta
rupiah)
BAB XXII KETENTUAN PIDANA
PASAL 406
2. Jika perbuatan sebagaimana dimaksud pada ayat
(1) menimbulkan kerugian harta benda
dipidana dengan pidana penjara paling lama 4
(empat) tahun atau denda paling banyak
Rp2.000.000.000,00 (dua miliar rupiah).
BAB XXII KETENTUAN PIDANA
PASAL 406
3. Jika perbuatan sebagaimana dimaksud pada ayat
(1) mengakibatkan kematian seseorang dan
kerugian harta benda, dipidana penjara paling lama
10 (sepuluh) tahun dan denda paling banyak
Rp2.500.000.000,00 (dua miliar lima ratus juta
rupiah)

65.1 Applicability
The requirements for issue or renewal of :
Aircraft maintenance licenses, certificates and ratings, and
the privileges and limitations of those licenses, certificates
and rating

Basic Certificatesis equivalent to a license without ratings
Certificate Of Maintenance Approval (COMA) is
equivalent to license, but the group or type ratings may be
limited in respect of validity and scope

d. For AMEL rating shall complete DAC form 65.1, and

65.9 Issue of licenses, certificates and rating
a. An applicant is entitled to license, certificate or rating
if the Director is satisfied that:
1. The applicant is a fit and proper person, and
2. Has ability in reading, writing and understanding English,
and
3. Meets the eligibility requirement in the appropriate
subpart, and
4. Is not contrary to the interest of aviation safety

65.9 Issue of licenses, certificates and rating
b. The holder of license/certificate issued by foreign
contracting state is eligible to license/certificate if the
Director is satisfied that:
1. The applicant is the holder of an acceptable
license/certificate, and
2. Fit and proper person, and
3. Is not contrary to the interests of aviation safety, and
4. Has passed Air Law examination and oral examination

65.11 Validity and renewal of license and certificates
a) Remain valid for the period specified in the document, and
such period shall not exceed two years from the date of issued
or previous renewal
b) May be renewed for further period not exceeding two years.
c) An applicant for the renewal and the holder of valid
license/certificate shall not exercise the privileges unless
within preceding 24 months has for periods totaling at least 6
months:
1. exercise the privileges

2. Supervised the maintenance, related to the rating held.
3. Performed a technical training function relevant to the rating
4. Engaged in any combination of 1, 2, or 3

d) Where an applicant does not meet the requirement of c), the
applicant shall show compliance with the requirements for
initial issue
e) It shall be the responsibility of the holder to present the
original document at the appropriate office of the Director
before the date of expiry, together with experience acquired
during the previous 24 months, a current address, and the
name and address of the present employer.

65.13 Certificate of Competency
Each application for a basic examination shall be accompanied
by a certificate of competency (Form KU 071) signed by a
person approved by the Director, showing that the applicant
has complied with the technical skill requirements
65.15 License and Certificate Document
The Director shall issue to each applicant who has qualification
for the grant of license or certificate

65.17 Examination: General
a) Examination are given at times and locations, and by person,
designation by the Director
b) The minimum passing grade for each examination is 70%
c) An applicant shall pass the basic knowledge written, oral and
practical examinations in the subjects appropriate to the
category
d) The Director may issue a license or certificate to person who
pass the basic knowledge examination

LICENCE
65.41 Eligibility requirement
A basic certificate may be issued to a person who is not less than
19 years of age, and meets the applicable requirements

A license may be issue to a person who meets the following age,
knowledge, skill and experience requirements:
a) Not less than 21 years of age
b) Passed the written examination, including an examination in
Air law
c) Passed oral examination
d) Met the experience requirements
e) Is able to read, write, speak and understand either Indonesian
or English language
f) Has satisfactory completed ONE of the following:

1) A traineeship in aviation technical trade of forty eight months
of practical aviation related experience
2) A traineeship in an appropriate non aviation technical trade,
and thirty six months of practical aviation related experience
3) A total of sixty months of practical aviation related experience
4) A course of integrated training, including at least thirty six
months of supervised training and experience conducted by
the holder of AMTO (CASR 147)

65.45 Recognition of foreign licenses
a) The Director may, upon application, issue an Indonesian
license to the holder of a valid license issued by an ICAO
contracting state, provided:
1. Complies with the requirements of this Parts
2. Passes an examination of Indonesian CASR appropriate to
the rating sought

65.45 Recognition of foreign licenses
b) The license shall include ratings as included in the applicants
original license if:
1) the applicant has recent experience on such aircraft rating,
and
2) such aircraft are on the Indonesian register

65.47 Privileges
a) An aircraft maintenance engineer license authorizes the holder
to:
1) Perform or supervise the maintenance of an aircraft or
component, and
2) Release an aircraft or component to service after
maintenance has been performed

65.47 Privileges
b) The holder of an aircraft maintenance engineer license shall
not exercise the privilege unless:
1) hold a type or group rating for that aircraft or component,
and
2) is familiar with all the relevant information relating to the
maintenance and airworthy of the particular aircraft or
component, and
3) complies with 65.11 (c)

65.51 Applicability
a) regulations governing group ratings and type ratings
b) each license category may be granted rating
c) the Director may issue a license and rating with limitation
d) the privilege and limitation are as prescribed in this part

SUBPART C LICENCE RATINGS
65.51 Eligibility requirements
To be eligible, a person shall:
a) hold a current license in the category to which the rating
relates, and
b) has completed at least:
1) six months practical experience on the type or group
which the rating is sought
2) submit a schedule of experience, and
c) has successfully completed:
1) examination acceptable to the Director

65.51 Eligibility requirements (cont)
2) a course of training relevant to the type of aircraft or
component for which the rating is sought:
i) conducted by AMTO issued under Part 147,or
ii) conducted by manufactures of the applicable
aircraft or component, or
iii) approved by the competent authority of a foreign
contracting state

65.55 Privileges
a) A group rating authorizes the holder to exercise the
privileges, on any aircraft or component of the applicable
group
b) A type rating authorizes the holder to exercise the privileges,
on the type of aircraft or component specified on that rating

65.63 Eligibility requirements
To be eligible a person shall:
a) Be not less than 21 year of age, and have practical experience,
for the particular group of aircraft or component
b) For the particular type or group of aircraft or component,
1) Have successfully completed a course of training
acceptable to the Director
2) Have passed examination, including Air Law and
Airworthiness requirements

65.65 Privileges
a) A COMA specifies the privileges
b) A COMA may authorizes any person:
1) who is a license holder, to perform maintenance on, and
certify for release to service, any aircraft type for which that
person does not have the practical experience required by
Subpart C for the grant of rating

65.65 Privileges (cont)
2) Who is not the holder of a license, but a workshop engineer
who satisfies the Director, to perform or supervise:
i) the maintenance or special process on an aircraft or
component and certify that aircraft or component for release
to service
ii) Maintenance on, and certify for release to service an
aircraft issued with an experimental airworthiness certificate
under Part 21, Subpart H
