FLORENCIO M. FLAVIANO, Filipino, of legal age and with residence address at 2 RD 3SMH Marulas, Valenzuela City hereinafter referred to as the LESSOR;
and
LANI CANDARI AND TEODORO TOREJOS, JR. both Filipino, of legal age and residents of Pandan, Antique, hereinafter referred to as the LESSEES.
WITNESSETH THAT:
WHEREAS, the LESSOR is the exclusive occupant of a house within a compound lot located at 2 RD 3 SMH, Marulas, Valenzuela City.
That the LESSEE agrees to rent portion of the room in the said house as bed spacers under the following terms and conditions, to wit:
1. That the term of this lease of contract shall be for a period of one (1) year starting this July 18, 2014 up to July 18, 2015 renewable at the option of the LESSOR. In case the LESSOR deems necessary to terminate the contract earlier than the agreed period, a notice shall be given to the LESSEE at least thirty (30) days before the expiration of this contract, otherwise the lease is considered renewed for the period of one (1) month;
2. That the LESSEE shall pay a monthly rental of TWO THOUSAND FIVE HUNDRED PESOS ONLY (P2, 500.00) exclusive of electricity and water consumption. With respect to the water consumption, the parties had agreed to a fixed amount of One Hundred Pesos (P100.00) for every month, if their consumption exceeds the said amount, the excess shall be upon the expense of the LESSEES;
3. That the LESSEE shall not occupy the garage of the house without the prior consent of the LESSOR nor shall they park any 2 vehicle or utilize the same for their own use without the prior consent of the LESSOR;
4. The LESSEE shall not make any alteration, addition, and/or improvement on the premises, without the written consent of the LESSOR, and in case of such authorized alteration, addition, and/or improvements on the premises, any and all such improvement shall become the property of the LESSOR at the expiration of this contract;
5. The LESSOR hereby warrant the peaceful possession and enjoyment of the leased premises by the LESSEE;
6. That if there is any breach by the LESSEE of any of the conditions of this lease the LESSOR may re-enter and occupy the lease premises and the LESSEE hereby waives all rights to any malice to quit possession.
7. That should the LESSEE desire and/or withdraw and/or terminate this contract before the expiration of the period, the LESSOR shall have the right to forfeit the DEPOSIT as liquidated damages
8. That the LESSEE shall not SUBLEASE, ASSIGN, NOR TRANSFER his/her rights and interests in the leased premises without the written consent of the LESSOR.
9. That the LESSEE shall not store nor permit to be stored in the premises any hazardous or highly inflammable goods and materials.
10. To surrender or yield quietly and peaceably to the LESSOR, the premises with all the fixtures; if the LESSOR needs the property for his/her personal use, the LESSEE shall at anytime upon notice vacate the same within a period of thirty (30) days.
11. That the LESSEE shall permit the LESSOR or its agents to enter and view the condition of the premises at reasonable hours in convenient manner.
12. That the failure to comply with any of the foregoing conditions by the LESSEE shall be a valid ground for his/her ejectment, and he/she be hereby waives any defense as against the LESSOR. The LESSEE shall further indemnify the aggrieved party of the sum of TWO THOUSAND PESOS (P 2,000.00) and for liquidated damages.
