MC COLE
MC COLE is an investor, property owner, and
employer in the 15th District of the city of
Milwaukee. He has over 30 years in the
Hospitality industry of Tavern administration.
He has completed FULL COMPLIANCE
for Class B License for the city of Milwaukee
and the following:
All CITY departments orders.
Paid over $7,000 in 2013-2014 property
taxes.
Invested over $88,000 in the property.
Paid $1,100 in Class B License.
An Emerging and Vetted business implementation.
3-Part business plan development - timeline of 12 months.
Project a minimum of 6 full-time jobs in first project Tavern.
Project a minimum of 10 full-time jobs in first and second projects
Tavern and Restaurant.
Housing two-2 bedroom apartments.
Petition support from neighbors (17th & 18th Streets) and 19 Letters of
Support - industry colleagues.
Business plan called for engaged revenue return during November, December
2014 and New Year 2015.
He has been treated unfairly and unjustly. He has not been given a CHANCE
On October 20, 2014, MC COLE appeared1 with consultant Mary Glass,
Milwaukee Professionals Association LLC for acquiring the Class B license
required to open Hammers Den.
His application was put On Hold by the License Committee
per the recommendation of Alderman Russell Stamper II, on
October 20, 2014; in spite of MC COLE FULL Compliance.
On November 24, 2015, the city clerks office verified that the
License Committee has scheduled MC COLE for January 6, 2015 (3 meeting
cycles VOID). No notice given by Alderman Stamper or License Committee.

CODE OF CONDUCT of Class B License
LICENSE-gate in the city of Milwaukee
LICENSE-gate is a term Mary Glass, Chair/CEO/CVO, Milwaukee Professionals
Association LLC has given to her recent discoveries of Code of Conduct and

unacceptable behavior

by elected-appointed-hired-volunteered and

donor-for-hire representatives during a routine Class B license process through


the city clerk office2 and the License Committee3 for the city of Milwaukee
government structure.
The malicious pathways that have been discovered demand and call for a
thorough investigation by the city of Milwaukee Ethics Committee4, the
Administrative Appeals Board5, the Board of Alcohol Beverage Licensing Task
Force6, the Office of the Department of Justice7, Federal Trade Commission8 and
federal funding agencies9 for starters.
That the Breach of Trust seen by Alderman Russell Stamper II and members of the
License Committee - lack of due process for MC COLE (and others on October 20,
2014) revealed issues of quality assurance, best practices, transparency and
accountability of the Common Council President and FULL Common Council.

Censure Lack Due Process


FULL COMPLIANCE information was submitted to Alderman Russell Stampers
office on Friday, October 17, 2014 at 4:30pm by MC COLE and Mary Glass. The
same information was left for Chairperson Alderman Tony Zielinski and Vice Chair
Milele Coggs for the Monday, October 20, 2014 License Committee. Vice Chair
Milele Coggs, the only office that responded to the call of the City Clerk
representative, asked that the information be placed in her box.
Each office of the Common Council is scheduled to be opened until 4:45pm.
On Monday, October 20, 2014, MC COLE appeared with Mary Glass,
consultant, Milwaukee Professionals Association LLC for Class B Application
appointment before the License Committee of the city of Milwaukee for MC COLE,
property owner, investor and employer, 1810-1822 W. Fond du Lac Avenue,
Milwaukee, 53205. His application was placed ON HOLD by the License
Committee, October 20, 2014; in spite of his 100% FULL COMPLIANCE.
Alderman Russell Stamper II reasons for placing MC COLEs application on HOLD
have not been addressed in over a month. There are time-limits being avoided
here.
What was said by Alderman Russell Stamper II at the October 20, 2014 license
meeting was, I need to review the file and take it before the neighborhood. He
has not attempted to HONOR his words.
In fact, Alderman Stampers behavior has been to dishonor his Oath of office, not
honor his word, not meet in good faith as the alderperson of the district and not
to represent honorably his position as a member of the License committee.
He has breached the TRUST of his office he has been found divisive, bias,
bartering/coercing and trying to implement his own brand of antitrust
in the 15th District with restriction on Urban Caf legal hours of sell on Sunday
[(9:00am 4:00pm) per Tabernacle Baptist Church], claiming Johnson Park $3
million investment reason for HOLD and asking for a Soul Food Restaurant instead
of Hammers Den for MC COLE.

Many of the trends and wrongful behavior in License-gate were provided for the
city of Milwaukee in the 2008-2009 Recommendations by the BOARD OF
ALCOHOL BEVERAGE LICENSING TASK FORCE.
Members of the 15th District are baffle by Alderman Stampers bizarre and
ruthless behavior. The People are behind MC COLE and his right to open since he
is in FULL COMPLIANCE, tavern and restaurant seen as benefit and desired for
neighborhood; and, MC COLE has shown good faith in putting his $$$money
where his commitment is.

Alderman Russell Stamper II has

Alderman Stamper is a member of the


License Committee. He is obligated to
oversight and accountability of the Common Council. Nothing has been done.

Arbitrary and capricious delay by Alderman Russell Stamper II, 15th District that
include non-response from his office (over 3 weeks of calls from MC COLE), BIAS
selection of Donald Lewis, Urban Caf13 rather than MC COLE, failure to inform
MC COLE of YMCA-CDC second neighborhood meeting on October 18, 2014.
Since placing MC COLE Class B application on HOLD, Alderman Stamper
informed MC COLE of YMCA-CDC November 15, 2014, but Stamper and assistant
failed to show-up MC COLE was not on the Agenda. Stamper has yet to explain
to MC COLE his NO SHOW. The November 15, 2014 NO SHOW is added to his
on/off scheduling Saturday and Sunday, November 7 and 8, 2014 but Stamper
failed to SHOW-up.
Lack of oversight for due diligence by members of the License Committee for due
process of MC COLEs application as well as the bartering/coercing of
Alderman Stamper in committee for approving Donald Lewis, Urban Caf14
Cypress and Fond du Lac Avenue means they are complicit to his wrongdoings.
Arbitrary and capricious censure by Alderman Russell Stamper II revealed
complicit behavior frowned upon by law and Ethics. The Common Council has yet
to act.
Arbitrary and capricious censure, discrimination, divisiveness and bias behavior by
mayor Barrett appointees of BID 3215 while they take assessed taxes for BID 32
from MC COLE automatic assessment is reprehensible. Non-profit neighborhood
organizations with partners under the umbrella of Walnut Way and YMCA-CDC,
without cause, without authorization, have violated civil-legal-human rights of MC
COLE with behind the scenes social influencing and social engineering
BLOCKING that do not support 501 (3) status and their stated Mission to the
public.
Social Influence
Social influence occurs when one's emotions, opinions, or behaviors are
affected by others. Social influence takes many forms and can be seen in
conformity, socialization, peer pressure, obedience, leadership, persuasion,
sales and marketing.

The in-your-face, arbitrary, capricious disregard and out-of-control


interactions of charter officers of the city of Milwaukee, those they appoint and
those they work with to APPROVE, place ON-HOLD, place on SUSPENSION,
REVOKE and DENY Class B licenses do not meet the threshold for 1st Class city
management, integrity or fulfilling the Oath of Office they share. The Class B
applicant is disadvantaged, discriminated against, disenfranchised, arbitrarily
disciplined/punished, denied INFORMATION, incur heavy revenue loss, and is
taxed without representation.
TAXATION W/OUT REPRESENTATION
MC COLE has been assessed taxes since his purchase of the property at 18101822 W. Fond du Lac Avenue. In addition to regular property tax, he inherited
assessment of BID #3216 (the appointed board of Mayor Barrett) and TID 4417 a
2001 assessment for Lindsay Heights and others (some of the same umbrella
members of Virginia Dupriest - YMCA-CDC and Sharon Adams - Walnut Way).
Business Investment Districts and automatic assessment of TIDs18 are due for a
thorough investigation since they are in concert with neighborhood organizations
and holding monthly meetings that are bias and discriminatory against MC COLE.
The behind-the-scene without quality assurance and real accountability is an
ethics violation. This includes a review of practices by the Joint Review Board for
Milwaukee Tax Increment Finance Districts Mark Nicolini, Teig Whaley-Smith,
Al Shoreibah, Gerald Pace and Robert Rondini.
The city government representatives charter officers, city officers, aldermanic
representation on the Licensing Committee, city clerks office staff, city of
Milwaukee Police Department, City attorneys office and non-profit leadermembers within a specific district are folk paid and unpaid. They are in office
for some time and uses the power of automatic taxing, persuasion and
intimidation. Three (3) social influences discovered are:
1. Compliance - is when the members of the Common Council appear to
agree with others, but actually keep their dissenting opinions private.
2. Identification is when members of the License Committee, licensees and
members of the neighborhood are influenced by someone who is inauthority and represents the district, such as Alderman Russell Stamper II

15th District, members of the License Committee (Alderman Tony


Zielinski, Alderwoman Milele Coggs, Alderman Russell
Stamper, Alderman Jim Dudzik, Alderman Robert Puente) and
those in appointed and organization position at the neighborhood level, i.e.,
Sharon Adam Walnut Way, appointed BID #32 members, Virginia
Dupriest YMCA-CDC and church groups, i.e., Starlet Lever and Rev. Darius
Butler, Tabernacle Baptist Church.
3. Internalization is when the License Committee accepts a belief or behavior
and agrees both publicly and privately, i.e., FULL COMMON COUNCIL.
For this Expos, the customers are applicants seeking a Class B license on October
20, 2014, License Committee19. The applicant followed specifically in this report is
MC COLE, Hammers Den, 1810-1822 W. Fond du Lac Avenue, Milwaukee, WI
53205.
For this Expos, members of the non-profit organizations, it includes: Sharon
Adams Walnut Way, Sharon Adams and Board Members of BID 32, Virginia
DuPriest President of YMCA-CDC, umbrella organizations of YMCA-CDC and
Walnut Way and Starlet Lever and Rev. Don Darius Butler of Tabernacle Church,
2500 W. Medford, Milwaukee, 53206.
For this Expos, top accountability falls on charter and city officers. They are:

Whereas, the identifiers for this report are primarily from District 15, the overall
License-gate is about the entire city of Milwaukee process and procedures for a
Class B license New and Renewal.
The focus is on the Ethical behavior, Oath of Office and breach of PUBLIC TRUST.

PURPOSE
Reporting of License-gate is to:
1. Draw attention to and to eradicate behavior that promotes breach of
public trust, unethical behavior and disguises it Code of Conduct as best
practices for the city of Milwaukee doing business with its
taxpayers/stakeholders.
The Class B license generates over a $$million dollars in revenue per year.
The businesses, business owners, investors, property owners, restaurant
owners and tavern owners deserve a process that is fair, informative,
collaborative, customer-friendly, inclusive and accessible with quick
turnaround.
2. To document the formation of MPA LLC Vetted Business Coalition20
League of Milwaukee Tavern Owners & Alcohol Licensees, a newly
created membership organization to share industry, legislative and
marketplace information and engagements to create a VOICE for the
Hospitality industry in Urban Milwaukee w/Class B license.
3. To call for oversight and accountability by the Common Council of its
members per 4-05. Conduct of Common Council Business (1-6), ESPECIALLY
4a and 4c21.
The common council shall be the judge of the election and qualification of
its own members, and may:
a. Punish its members or other persons present, by fine, for disorderly
behavior.
b. Compel the attendance of its members upon its sessions, and employ the
police of the city for that purpose.
c. Fine or expel any member for neglecting his or her duty as such member,
or for unnecessary absence from the sessions of the council.

4. To begin the process of REFORM for increasing integrity in the


administration of the for-pay License structure of the city of Milwaukee
by exposure of wrongdoings, and call for the implementation of
transparency, BEST PRACTICES and on-the-spot accountability.
5. To focus on License Committee members (alderpersons) due diligence,
preparedness, training, respect and customer-friendliness to Class B
applicants before, during and after the License Committee meetings for
accountability of the process of doing business with taxpayers-constituents.
6. To review and upgrade the 2008-2009 Recommendations of the Board of
Alcohol Beverage Licensing Task Force.
7. To focus on methods of safety intervention and safety prevention
when rolling out recommendations during the License Committee meeting
rather than from the hip and gut responses that are not appropriate
for the event and/or situation.
This was especially noticeable in suggestions made at the October 20, 2014
License Committee meeting by Chair Tony Zielinski push into the
neighborhood discussion with one of the applicants. Chair Zielinski seem
to be setting-up a Gotcha with Class B Applicant and talked-down to
the obviously hands-on and concerned proprietor.
VICE Chair Milele Coggs suggestions of what could have been done when
dealing with questionable behavior of customers were good for a planning
and discussion seminar with Class B applicant to allow pros and cons for
appropriateness. It was not appropriate for the meeting because of the
social influence of it; and, its one size fit all scenarios.)
Since both the chair Zielinski and vice chair Coggs both are students of law
passed the bar, we expect more in leadership and fairness of due
diligence for due process less disciplinarians.
8. To address the misuse of power and inappropriate behavior of the License
Committee when conducting business for the people during the Class B
Applicant hearing.

9. MC COLE appeared before the License Committee on Monday, October 20,


2014. Alderman Russell Stamper II has failed to honor his reasons for the
ON HOLD. MC COLE was not called to the License Committee for the
November License Committee. On Monday, November 24, 2014, day
before the November Common Council meeting, Mary Glass was informed
during her call to the city clerks office; that the License Committee has MC
COLE scheduled for January 6, 2015.

No communications were given to MC COLE.


This means that:
Deliberate and willful delay was created to disenfranchise MC COLE
for 3 meetings October, November and December, 2014. A 3month deferment. Did the city defer his 2014 taxes? No. He has
paid over $7,000 and his FULL COMPLIANCE application for his paid
$1,100 Class B license is on HOLD for a 4-month cycle.
MC COLE will be held in limbo without a CHANCE for recouping
revenue during the holiday season.
MC COLE has been forced to pay taxation without representation
(October 8, 2013 to now November 24, 2014) property taxes, BID
#32 and TID 44 assessments.
MC COLE has been denied due process and members of the License
Committee, charter officers and for sure Alderman Russell Stamper
must answer to the law that governs his office, License Committee
and the U.S. Constitution that protects the rights of MC COLE.
There were moments of inappropriate and over-the-top behavior at
the October 20, 2014 License committee hearing. Here are 14 ways noted
for this Expos. They include:

Absences of members of the committee during hearings;


Unpreparedness and off-the-cuff remarks by chair Zielinski;
Inconsistent practices of approval and disapproval of Class B
applications;
On/off of Alderpersons representing constituents from their
area;
Inconsistent use of certain groups within neighborhoods
currying favor;
Inconsistent behavior shown some Class B applicants with
shootings in and around their tavern vs punitive actions and
incoherent labeling of Alderman Stamper;
Police officers reporting vague and not verified reports
but un-verified reports (AK47 Rifle) being use to penalize and
enter a 10 day suspension on Class B applicant record, i.e.,
Terry Clincy, Lorenzos Tavern by Alderman Russell Stamper II;
Chair Zielinski misrepresenting behavior of Class B applicant
and through verification by city clerk representative he was
100% wrong;
Chair Zielinski tutorial on Push into the Neighborhood lacked
reasoning, fact and appropriateness. He came across as
dictatorial and not credible - calling for Mr. Clincy to do the
job we pay the city of Milwaukee especially since Mr. Clincy
had explained his hands-on method used for his tavern.
Chair Zielinski calls for in-committee but NO REAL discussion
heard. Plus his comments objection NO objection is stated
in a fast-perfunctory way and gives no appreciation for
comments and/or objections when needed; i.e. Terry Clincy,
Lorenzos Tavern.
The appearance of bias and conflict of interest when
making a statement by those sitting in judgment (License
committee) for the license of the class B applicant;
Appearance of laughter by License committee members at
and found untruths made by chair Zielinski;
Misuse of power and complicit behavior of chair Zielinski and
Committee member Stamper to remove Mary Glass because

she was asking a question for clarity regarding process and


procedure. She and client, MC COLE, should have been made
aware of the rules of the License Committee and the city of
Milwaukee for steps to obtain information and to ensure that
their questions were asked. Instead, Alderman Stamper, who
had misused his power of office and not honored his Oath of
Office engaged fellow License Committee member Zielinski in
Breach of Trust and inappropriate behavior NOT befitting
two members of the Common Council of the city of
Milwaukee. They BLAMED the removal by police escort of
Glass on her being disrespectful to the committee.
Again, this type of information sharing was recommended in the 2008-2009 Board
of Alcohol Beverage Licensing Task Force report.
Democracy for MC COLE
To REMOVE the behind-the-scene tactics that prevent, place on HOLD, suspend
and deny Class B licenses without legitimacy and due process.
Milwaukee Professionals Association LLC was brought into the Hospitality arena
by MC COLE, investor, property owner and employer. He was not being given a
CHANCE to exercise his rights to FREE TRADING at his NEWLY purchased
property located on 18th and Fond du Lac. MPA LLC was retained by MC COLE to
represent him in the securing of his Class B License.
It has been over a month October 20, 2014, since he appeared before the
License Committee (Ald. Tony Zielinski, Chair; Ald. Milele Coggs, V.
Chair; Ald. Russell Stamper; Ald. Jim Dudzik and Ald. Robert
Puente).
Even though MC COLE was in FULL COMPLIANCE, Ald. Russell Stamper placed his
Class B application on HOLD without justification. The License Committee did
nothing.
Alderman Stamper has since shown a Code of Conduct that is a breach of his
office. And, lack of leadership for due process from the office of Common
Council President Michael Murphy, members of the License Committee, mayor
Tom Barrett and City Clerk Jim Owczarski has been deafening.

Alderman Stamper and his assistant have failed repeatedly to provide contact,
information and follow-thru of appropriate behavior consistent with the Oath of
his office for Alderman of the 15th District and as a member of the License
Committee.
The bizarre behavior of Alderman Russell Stamper II includes:
Failure to respond to MC COLE calls to his office for information before
October 20, 2014 License Committee Meeting (over 3 weeks in a row).
Failure to notify MC COLE of October 18, 2014 meeting at YMCA-CDC.
Alderman Stamper pulled Donald Lewis, Urban Caf to the side and told
him about the meeting October 18, 2014 but did not tell or inform MC
COLE. MC COLE was cited for non-attendance.
Alderman visited BID #32 August, 2014 meeting with Urban Caf and St.
Ann on the Agenda as support items. MC COLE was not on the agenda.
His refusal to meet with MC COLE Hammers Den, on-off promised
meetings with MC COLE.
Discrimination of Hammers Den application vs Urban Caf Class B
application.
Recently asking MC COLE to open a Soul Food restaurant rather than a
tavern after he has worked for over a year for FULL COMPLIANCE for his
Class B license - invested over $88,000 in purchase and repairs, $7,000 in
2013-2014 city taxes, $1,100 for Class B license application with the
minimum potential of 6 full-time position for the opening of Hammers
Den.
Telling MC COLE to be present on Saturday, November 15, 2014 for YMCACDC meeting Stamper does not show up, nor his assistant. MC COLE
was not on the Agenda.
Stamper has not contacted MC COLE to address his failure to show up or his
assistant at the YMCA-CDC, November 15, 2014 meeting.
Stamper has used Johnson Park and potential $3 million investment as the
reason for HOLD on and failure to approve the Class B license for MC
COLE. Since any government funding for Johnson Park would mostly like
include taxation of MC COLE, his assertion is ludicrous.

Ald. Stamper has been discovered to have engaged in Ethics violations Conflict of Interest with Sharon Adams Walnut Way, Sharon Adams - BID
32, Virginia Dupriest YMCA-CDC and others to BLOCK MC COLE
application.
MC COLE was attacked by the people around the table on October 10, 2014,
Walnut Way, 1836 W. Fond du Lac Avenue. Ald. Russell Stamper was
present and discoveries show he has been complicit with actions
contrary to his Oath of Office as a charter officer of the city of Milwaukee.
On November 24, 2014, we learned that 3 cycles have been willfully
bypassed by Alderman Russell Stamper II. Perhaps he thinks this is the way
the people will allow his leadership and stewardship to remain going
forward.
This is not the way District 15 will grow.
License-gate starts with local in-house investigation while asking federal DOJ and
federal funding source to weigh in.
All the while, the charter officers have been complicit since they have been sent
documented accounts and have been sought for assistance office of the
Common Council President Michael Murphy office of the mayor. No response.
