I held a telephone conference with counsel for all parties this date. They have agreed and

it is ordered that a case management conference is set for March 6, 2014 at 2:00p.m. The parties

must file a joint CMC statement and provide a courtesy copy to this department not later than

22

March 4. In that joint statement the parties must express their views, and a consensus if possible,

23

on at least these issues: (1) what issues should be tried in the Phase I trial now set for March 24;

24

(2) if the March 24 date should be continued, to which date should it be continued and for which

25

reasons; (3) if there is to be a Phase I trial, assuming it proceeds on March 24, how should the

26

pre-trial dates (e.g., those referred to in the next paragraph) be re-set.

The parties are relieved from adhering to pretrial preparation dates such as for deposition
designations and in limine motions until further order, which order I expect to issue promptly

after the next CMC.
